The Fort Worth City Council voted Tuesday to increase the amount the city can pay attorney Kenneth E. East for legal work representing former Fort Worth police officer Aaron Dean in the ongoing federal civil lawsuit stemming from the death of Atatiana Jefferson<\/a>.<\/p>\n

The vote has generated controversy on social media this week. The reaction to the vote on social media even prompted Councilman Chris Nettles to post that his vote was a mistake<\/p>\n

According to the council agenda item approved in a 9 to 1 vote, council members authorized increasing the maximum amount paid to Kenneth E. East, P.C., doing business as The Law Office of Kenneth E. East, to as much as $200,000. The attorney is serving as conflicts counsel for Dean in the lawsuit filed by David Bakutis, administrator of the Estate of Atatiana Jefferson, against Dean and others. The lawsuit is identified as Case No. 4:21-CV-665-Y.<\/p>\n

Council records show the vote passed with Councilwoman Deborah Peoples casting the lone \u201cno\u201d vote. Councilman Charlie Lauersdorf was listed as absent. The remaining council members voted in favor of the measure. City officials voted by majority to conclude that Texas Local Government Code \u00a7 143.134 requires municipalities to provide legal representation to police officers sued for conduct taken in the course and scope of their official duties, if the officer requests counsel. The city contends that Aaron Dean meets those requirements because the civil lawsuit arises from actions he took while responding to a call as a Fort Worth police officer.<\/p>\n

The action does not resolve the lawsuit but authorizes additional legal funding for Dean\u2019s representation as the case continues through federal court.<\/p>\n

Jefferson, 28, was fatally shot by Dean through a window of her Fort Worth home on Oct. 12, 2019, after police responded to a neighbor\u2019s call about an open door at the residence. Dean was convicted of manslaughter in 2022 and sentenced to nearly 12 years in prison.<\/p>\n

The federal civil rights lawsuit filed on behalf of Jefferson\u2019s estate alleges Dean violated Jefferson\u2019s constitutional rights through the use of excessive force. A federal appeals court ruled in February 2025 that Dean was not entitled to qualified immunity on the excessive force claim, allowing that portion of the case to move forward.<\/p>\n

The city has previously approved settlements related to the Jefferson case, including a $3.5 million settlement benefiting Jefferson\u2019s nephew, Zion Carr, who was inside the home when she was killed.<\/p>\n

Tuesday\u2019s vote specifically addressed attorney fees connected to Dean\u2019s legal defense in the estate\u2019s ongoing federal lawsuit.
