{"id":355564,"date":"2026-06-30T10:23:09","date_gmt":"2026-06-30T10:23:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/355564\/"},"modified":"2026-06-30T10:23:09","modified_gmt":"2026-06-30T10:23:09","slug":"are-thc-drinks-still-legal-to-purchase-in-texas","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/355564\/","title":{"rendered":"Are THC drinks still legal to purchase in Texas?"},"content":{"rendered":"<p><img alt=\"Texas' laws around hemp are constantly changing amid legislators' attempted legislative crackdowns, legal challenges and court orders.\u00a0(Photo by\u00a0Monika Skolimowska\/picture alliance via Getty Images)\" loading=\"eager\" fetchpriority=\"high\"   style=\"aspect-ratio:16 \/ 9\" class=\"x100 y100 opc bgpc ofcv bgscv block bg-gray200 mnh0px fill\"\/><\/p>\n<p>Texas&#8217; laws around hemp are constantly changing amid legislators&#8217; attempted legislative crackdowns, legal challenges and court orders.\u00a0(Photo by\u00a0Monika Skolimowska\/picture alliance via Getty Images)<\/p>\n<p>picture alliance\/dpa\/picture alliance via Getty ITexas courts have allowed state health officials to enforce new hemp regulations, leaving the legal status of some THC products unresolved.Retailers in Texas can sell hemp-derived products like CBD oils and THC-infused drinks if they contain no more than 0.3 percent delta-9 THC by dry weight.Major retailers have begun selling THC-infused beverages in stores across Texas as lawsuits over hemp regulations continue.<\/p>\n<p>For most of the 2020s, Texas lawmakers and hemp manufacturers have battled over the legality of <a href=\"https:\/\/www.statesman.com\/news\/article\/is-it-legal-bring-weed-into-texas-from-state-22185405.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">THC products in the state.\u00a0<\/a><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/cdn-channels-pixel.ex.co\/events\/0012000001fxZm9AAE?integrationType=DEFAULT&amp;template=design%2Farticle%2Fplatypus_two_column.tpl\" alt=\"\" class=\"x1px y1px vh abs\" aria-hidden=\"true\" width=\"1\" height=\"1\"\/><\/p>\n<p>On June 10, the Texas Fifteenth Court of Appeals denied the hemp industry&#8217;s emergency request to maintain a temporary injunction.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>The injunction, issued May 1, had prevented the Texas Department of State Health Services (DSHS) from enforcing key portions of the state&#8217;s new consumable hemp regulations while the industry&#8217;s lawsuit proceeds.<\/p>\n<p>The Texas Agriculture Code defines &#8220;hemp&#8221; as &#8220;the plant Cannabis sativa L. and any part of that plant, including the seeds of the plant and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of less than 0.3% on a dry weight basis.&#8221;<\/p>\n<p>What products stores are legally allowed to sell remains in limbo.\u00a0<\/p>\n<p><a href=\"https:\/\/www.statesman.com\/news\/article\/marijuana-reclassification-trump-what-it-means-22220453.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Federal marijuana policy<\/a> is shifting, but those changes do not override Texas&#8217; hemp regulations, which remain in effect.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>Texas retailers can legally sell many hemp-derived products\u2014including\u00a0CBD oils, gummies, beverages and topicals\u2014but the legal status of smokable hemp and some intoxicating cannabinoids, particularly delta-8 THC, remains unsettled as lawsuits over the state&#8217;s new hemp regulations continue.<\/p>\n<p>As of late June, large retailers sell drinkable THC products in store. But is this legally viable?\u00a0<\/p>\n<p>Here&#8217;s what to know about these confusing laws around hemp.\u00a0<\/p>\n<p>Are THC-infused drinks legal in Texas?<\/p>\n<p>The same barometer essentially applies to THC-infused drinks. As outlined by the<a href=\"https:\/\/www.statesman.com\/news\/politics\/article\/texas-thc-laws-gummies-drinks-hemp-22206332.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\"> DSHS guidelines<\/a>, these beverages remain legal, for now, contingent on a product&#8217;s content.\u00a0<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>Texas permits certain THC-infused drinks if they contain no more than 0.3 percent delta-9 hemp-derived THC by dry weight, the distinction between hemp and marijuana. Again, a product is determined to be illegal or not based on its chemical composition, which relies on lab testing and accurate labeling.\u00a0<\/p>\n<p>What is the THC legal battle in Texas?\u00a0<\/p>\n<p>Texas hemp manufacturers and retailers argue that state health regulators exceeded their legal authority by adopting rules that effectively ban many hemp products that lawmakers never prohibited.<\/p>\n<p>At the heart of the lawsuit is whether Texas regulators can tighten hemp restrictions through agency rulemaking or whether those policy changes must come from the Legislature.
