COLORADO SPRINGS, Colo. (KKTV) – Tuesday afternoon, officials with El Paso County announced that Buc-ee\u2019s had filed an appeal<\/a> in regards to its proposed development in the area. <\/p>\n

In late June,<\/a> the Planning and Community Development Director was unable to determine whether Buc-ee\u2019s should be classified as a \u2018Convenience Store\u2019 under the county\u2019s Land Development Code. <\/p>\n

The county said the director was not able to decide if the proposed use is similar enough to the allowed uses under the C-1 zoning district. <\/p>\n

On Tuesday, Buc-ee\u2019s EPCO, LLC filed the appeal regarding the Planning and Community Development Director\u2019s decision. <\/p>\n

The county said this appeal will be heard during a public meeting. The date of that meeting has not yet been determined. <\/p>\n

The county said the Board of County Commissioners will consider the appeal and will make the ultimate decision on the meaning and application of the C-1 zoning, including its type, nature and uses. <\/p>\n

The county confirmed that the Board of County Commissioners will only be deciding if the proposed Buc-ee\u2019s use is allowed within C-1 zoning or similar enough to be allowed. <\/p>\n

The board is not deciding whether to approve or deny the development itself. <\/p>\n

In late April, Buc-ee\u2019s EPCO, LLC bought land near I-25 and County Line Road for more than $10 million, according to records from El Paso County. The land is in the same area that Buc-ee\u2019s had been eyeing for more than a year, following an annexation effort<\/a> and a property line change<\/a>.<\/p>\n
