Brandon Creighton, R-Conroe, authored Senate Bill 26, which would invest more than $4 million in teacher pay increases.<\/p>\n<p>Jay Janner\/American-Statesman<\/p>\n<p>A national professors&#8217; union and its Texas chapter are suing the Texas Tech University System\u2019s chancellor and regents for restricting professors&#8217; ability to teach about LGBTQ identity, gender and race, according to a lawsuit filed Wednesday in federal court.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/cdn-channels-pixel.ex.co\/events\/0012000001fxZm9AAE?integrationType=DEFAULT&amp;template=design%2Farticle%2Fplatypus_two_column.tpl\" alt=\"\" class=\"x1px y1px vh abs\" aria-hidden=\"true\" width=\"1\" height=\"1\"\/><\/p>\n<p>Brandon Creighton, chancellor of the Texas Tech University System and a former Republican state senator, announced last academic year that the five universities he oversees\u00a0<a href=\"https:\/\/www.statesman.com\/news\/education\/article\/texas-tech-system-joins-texas-a-m-restricting-21216791.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">could not teach courses that advocate for race or gender<\/a> \u201cprejudice\u201d or mention\u00a0that\u00a0<a href=\"https:\/\/www.statesman.com\/news\/education\/article\/texas-tech-system-joins-texas-a-m-restricting-21216791.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">more than two genders exist.<\/a><\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>In April, he canceled all academic programs \u201ccentered on\u201d sexual orientation and said professors \u201cgenerally\u201d <a href=\"https:\/\/www.statesman.com\/news\/article\/texas-tech-system-leader-cancels-academic-22204198.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">cannot teach courses that include LGBTQ<\/a> themes.<\/p>\n<p><a href=\"https:\/\/drive.google.com\/file\/d\/18xp23rSpE6xt8kUHU0KMeH_nZYyMWp7Z\/view\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Wednesday\u2019s lawsuit, filed by the American Association of University Professors and its Texas chapter<\/a>, alleges that the decisions violate the First and 14th amendments and censor course discussion.<\/p>\n<p>\u201cThis case presents an extraordinary system of censorship in higher education, in which professors in the Texas Tech University System are prohibited from teaching the most basic scholarship, while at the same time not fully comprehending the contours of prohibitions that place them under threat of losing their employment and livelihood,\u201d lawyers for the professors&#8217; union wrote in the filing. \u201cTo make matters worse, professors cannot reasonably make sense of what is and is\u00a0not prohibited, further chilling their classroom speech.\u201d<\/p>\n<p>Creighton said in a statement that the university system is confident its policies are \u201clawful and compliant.\u201d<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>\u201cOur commitment to academic integrity and the First Amendment rights of our students and faculty will not be distracted by lawsuits as we continue our mission to deliver rigorous academic programs, relevant coursework, and groundbreaking research,\u201d Creighton said.<\/p>\n<p>What do the policies restrict?<\/p>\n<p>Creighton, who championed legislation restricting faculty input and diversity, equity and inclusion practices at universities during his time in the Texas Legislature, has said the restrictions ensure the Texas Tech University System provides \u201crigorous\u201d and valuable degrees.<\/p>\n<p>There is no law restricting what can be taught in Texas higher education. In 2023,\u00a0Creighton authored Senate Bill 16, which would have restricted teaching that compels students to adopt beliefs that one race or sex is superior.\u00a0The bill did not pass.\u00a0<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>A higher education reform bill\u00a0he authored, <a href=\"https:\/\/www.statesman.com\/story\/news\/education\/2025\/06\/03\/texas-legislature-sweeping-higher-education-reform-will-affect-faculty-senates-regents-authority\/84005591007\/\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Senate Bill 37<\/a>, succeeded in giving regents more power over curriculum and defanging faculty governance in 2025, but it did not include specific restrictions on race and gender.\u00a0Initial drafts <a href=\"https:\/\/www.statesman.com\/story\/news\/education\/2025\/05\/24\/sb-37-limiting-faculty-senates-core-curriculum-poised-to-x-house-creighton-ombudsman-texas-higher-ed\/83840342007\/\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">included those limitations<\/a>.<\/p>\n<p>Regardless, university systems have increasingly adopted policies to restrict what professors can teach after a Texas A&amp;M University professor was <a href=\"https:\/\/www.statesman.com\/news\/education\/article\/texas-a-m-fires-professor-abbott-21039973.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">fired at Gov. Greg Abbott\u2019s urging <\/a>for teaching about gender identity.\u00a0<\/p>\n<p>The <a href=\"https:\/\/www.statesman.com\/news\/education\/article\/texas-a-m-president-welsh-resigns-conservative-21055980.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">viral fallout ultimately resulted in the president of Texas A&amp;M stepping down<\/a>, and the A&amp;M System restricting\u00a0courses that \u201cadvocate\u201d for gender identity or race. Before\u00a0Creighton was appointed, the Texas Tech University System banned teaching that there were more than two genders, and the University of Texas System also announced<a href=\"https:\/\/www.statesman.com\/news\/education\/article\/ut-system-audits-gender-courses-gop-targets-21075365.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\"> an audit of courses concerning gender identity<\/a>.<\/p>\n<p>The professors&#8217; union lawsuit specifically targets two decisions from Creighton that go further. In one of his first acts as chancellor, Creighton\u00a0banned advocacy or promotion of race or sex-based \u201cprejudice.\u201d<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>In April, when he announced the cancellation of programs that teach sexual orientation, or gender identity, Creighton instituted a \u201cstrict prohibition on (sexual orientation or gender identity) content in all core and lower-level undergraduate courses,\u201d and on \u201cinstruction that advocates for concepts of inherent racial or sexual superiority, inherent bias, or collective guilt.\u201d That<a href=\"https:\/\/www.texastech.edu\/downloads\/26-4-9-Memorandum-Chancellor-Creighton.pdf\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\"> order did not apply to <\/a>teaching about historical events tied to LGBTQ and civil rights.<\/p>\n<p>The legal filing states Creighton\u2019s orders are too vague, \u201cchilling\u201d any speech that has to do with\u00a0LGBTQ identity, gender or race. The Texas Tech System provided guidance on its restrictions, but the suit maintains that the orders suppressed professors&#8217; academic freedom.<\/p>\n<p>TJ Geiger, the vice president of the Texas Tech University AAUP chapter, said that the policies have led to confusion across campus, leading to self-censorship and \u201cinconsistent\u201d directives to professors on what they can teach. The limits ultimately hurt students, who \u201care not getting a full, accurate, and complete education\u201d if professors are censoring their teaching, he said.<\/p>\n<p>\u201cIt\u2019s just been a really tumultuous time leading to what I\u2019ve characterized as intellectual and professional triage,\u201d Geiger said. \u201cOur otherwise good work and effort that would have gone into teaching and research has been directed toward trying to figure out where the lines are in terms of what we\u2019re supposed to say or not say.\u201d<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>What is the lawsuit seeking?<\/p>\n<p>The 84-page court filing asks a judge in the U.S. District Court for the Western District of Texas to prevent Creighton\u2019s directives from being enforced.<\/p>\n<p>Antonio Ingram, senior counsel at the Legal Defense Fund, a legal organization focused on racial justice that is representing the professors&#8217; union, said the restrictions have prevented professors at Texas Tech University\u2019s medical school from teaching about health disparities based on race, and left law professors unsure about how to teach about legal victories for racial equality.<\/p>\n<p>A spokesperson for Creighton did not immediately respond to the claims.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>\u201cThese are targeting Black communities, Black professors,\u201d Ingram said. \u201cWe want the federal court in El Paso to declare the memorandums unconstitutional based on First Amendment violations, based on vagueness, and based on its racial discrimination.\u201d<\/p>\n<p class=\"MM_onlineOnly\" title=\"CCI Online Only\">This is a breaking story that will be updated.<\/p>\n","protected":false},"excerpt":{"rendered":"Sen.
