HARRIS COUNTY, Texas — A murder suspect accused of killing his pregnant wife in Harris County, Texas remains in Italy after a court there temporarily paused his extradition to the United States over concerns about potential sentencing, according to his attorney.<\/p>\n
Lee Gilley is charged with murder in the 2024 death of his wife, Christa Bauer.<\/p>\n
Bauer was found dead inside a home after Gilley called 911 and said he found his wife unresponsive in bed and tried to perform CPR.<\/p>\n
The woman was taken to the hospital, where she was pronounced dead, but doctors determined the trauma to her face and body she suffered was inconsistent with CPR. Christa reportedly had bruising and apparent trauma to her face.<\/p>\n
According to the documents, both the doctor and medical examiner declared the injuries were consistent with strangulation. Prosecutors said Gilley’s wife was eight weeks pregnant at the time of her murder.<\/p>\n
It was also revealed that there were two children inside the home at the time.<\/p>\n
Prosecutors allege Gilley fled to Italy in May weeks before his scheduled June trial after cutting off his court-ordered ankle monitor and using forged travel documents while out on a $1 million bond.<\/p>\n
Defense attorney Dick DeGuerin said the Italian courts are seeking a formal assurance that Gilley would not face the death penalty if extradited to Texas.<\/p>\n
“When we spoke, the district attorney’s office said it would not seek the death penalty, but it has not filed that formally,” DeGuerin said. “That’s what the Italian courts are looking for.”<\/p>\n
DeGuerin said Italy temporarily blocked the extradition request because the country’s legal system does not allow the death penalty or life without parole. He said Italian authorities want confirmation that Gilley could receive a sentence less than life without parole if convicted.<\/p>\n
The attorney described the situation as unprecedented in his decades of practicing law.<\/p>\n
“I’ve had cases where people have jumped bond, but nothing like this,” DeGuerin said.<\/p>\n
DeGuerin said communication with Gilley has been limited since his arrest in Italy. He also said the delay has complicated preparations for trial.<\/p>\n
“It’s frustrating. I’m a trial lawyer. I’m ready to go to trial, but this certainly complicates the trial,” he said.<\/p>\n
Gilley has pleaded not guilty. DeGuerin said his client maintains his innocence and contends Bauer died from a pre-existing medical condition. The attorney declined to provide additional details, citing a gag order in the case.<\/p>\n
According to DeGuerin, U.S. officials have until Aug. 31 to submit the requested documentation to Italian authorities. The next extradition hearing is scheduled for Sept. 7.
