AUSTIN \u2014 The political battle over Texas’ booming data center industry escalated dramatically Monday, with opponents packing the State Capitol and pleading with Governor Greg Abbott to slam the brakes on an industry they say is threatening the state’s water supply, electric grid, and taxpayers.<\/p>\n
Chanting “Special session now!” demonstrators urged the governor to impose an immediate moratorium on new data centers and convene lawmakers to address what they called a growing statewide crisis.<\/p>\n
“We are not asking any longer. We are down on our knees and we are begging,” organizer Linda Pauley told the crowd. “We are asking you to have an emergency legislative session or at least pass a moratorium.”<\/p>\n
The protest comes as Texas experiences an unprecedented explosion in data center construction, fueled by artificial intelligence and cloud computing. According to energy research firm Cleanview, 129 data centers are already operating across the state, while another 250 projects are in the pipeline.<\/p>\n
Opponents argue the industry’s rapid expansion is outpacing oversight and could leave Texans paying the price through increased electricity demand, heavier water consumption, higher utility bills, and mounting pressure on the state’s already-stressed power grid.<\/p>\n
“Why will Governor Abbott not call a special session?” Pauley asked. “Why will he not pass a moratorium to just put this on hold?”<\/p>\n
The governor’s office defended Abbott’s approach, saying safeguards are already being put in place to protect Texas families.<\/p>\n
In a statement, the governor’s office said:<\/p>\n
“Governor Abbott has been clear that data centers cannot come before Texas families. That is why he directed the PUC and ERCOT to require data centers to pay for their own infrastructure, bring their own power, reuse their own water, and lower residential electric bills.”<\/p>\n
The Capitol demonstration was deliberately timed to coincide with a closely watched Texas Senate Finance Committee hearing examining whether the state’s lucrative sales tax exemption for data centers still serves taxpayers.<\/p>\n
Committee Chair Joan Huffman signaled lawmakers are taking a fresh look at the incentive.<\/p>\n
“It’s time, and it’s appropriate, and it’s necessary for the Legislature to reexamine whether this exemption still delivers a return that justifies its rapidly mounting foregone tax revenue,” Huffman said. “No tax exemption should operate on autopilot.”<\/p>\n
Lawmakers also questioned whether Texas would remain one of the nation’s hottest destinations for data center development without the tax break.<\/p>\n
Brad Reynolds, chief revenue estimator for the Texas Comptroller’s Office, suggested the answer is yes.<\/p>\n
“Texas is now the second-largest co-location multi-tenant data center market in the country, the Dallas-Fort Worth metro area, and that all happened without any sales tax exemption,” Reynolds told lawmakers.<\/p>\n
The Senate Finance Committee is now weighing whether to preserve, scale back, or eliminate the tax incentive before lawmakers return for the regular legislative session in January.<\/p>\n
