However, the release incorrectly characterizes the administrative determination made by County staff. The Planning and Community Development Director did not determine that the proposed Buc-ee’s use does not fit the Land Development Code’s definition of a ‘Convenience Store.’ Rather, after reviewing the applicant’s materials, the applicable Land Development Code, historical approvals, and comparative analysis, the Director was unable to determine whether the proposed use meets that definition or is sufficiently similar to an allowed use in the C-1 zoning district. Because that question could not be resolved administratively, it is now before the Board of County Commissioners on appeal.

The County cannot comment on the Town’s position or the merits of the pending appeal outside the public process. At the public hearing, the Board will decide the issue based solely on the applicable Land Development Code, the record, and the evidence presented—not on public statements or opinions expressed outside the hearing. Additional information about the hearing will be provided as it becomes available.”

MONUMENT, Colo.
