{"id":406441,"date":"2026-08-14T12:50:33","date_gmt":"2026-08-14T12:50:33","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/406441\/"},"modified":"2026-08-14T12:50:33","modified_gmt":"2026-08-14T12:50:33","slug":"as-more-witnesses-describe-frustrations-with-ferrum-capital-losses-judge-says-trial-now-expected-to-go-to-jury-next-week","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/406441\/","title":{"rendered":"As more witnesses describe frustrations with Ferrum Capital losses, judge says trial now expected to go to jury next week"},"content":{"rendered":"<p class=\"wp-block-paragraph\">The biggest news out of the Ferrum Capital trial Thursday was the jury may get the case Wednesday or Thursday of next week as the prosecution plans to wrap up around noon Friday.<\/p>\n<p class=\"wp-block-paragraph\">But before that, at 8:15 a.m., Judge Fred Biery expects defendants Joshua Allen and Michael Cox to tell him if they want to invoke their Fifth Amendment rights to not testify \u2013 or if they plan to take the stand in their defense.<\/p>\n<p class=\"wp-block-paragraph\">The case was originally planned for three weeks.<\/p>\n<p class=\"wp-block-paragraph\">Also on Thursday, another list of people who invested in Lubbock-based Ferrum Capital and lost money took the stand.<\/p>\n<p class=\"wp-block-paragraph\">As also happened Wednesday, Joseph Blackwell, assistant United States attorney, asked them if they were told:<\/p>\n<p>Their money would be used to pay previous investors.<\/p>\n<p>About fees and commissions.<\/p>\n<p>About a 2020 class-action lawsuit against the Collins Asset Group (CAG), which bought distressed debt with money from Ferrum investors.<\/p>\n<p class=\"wp-block-paragraph\">All of them said they did not know \u2013 and if they did, they wouldn\u2019t have invested.<\/p>\n<p class=\"wp-block-paragraph\">Defense attorneys cross examined witnesses about if they read parts of documents outlining risk, pointed out CAG made no admission of guilt in the 2020 lawsuit, among other questions.<\/p>\n<p class=\"wp-block-paragraph\">Prosecutors showed documents from a company called Provident, then a page showing money going to a Ferrum entity and finally a signature page approving the transfer.<\/p>\n<p class=\"wp-block-paragraph\">Susan Hunter and John Halbrooks, both of Lubbock and Gary Crim of Castroville, all told prosecutors that was not their signatures on the last page, saying they did not agree to transfer their money the way prosecutors had just described.<\/p>\n<p class=\"wp-block-paragraph\">Crim, who came into court with a walker, said Allen had doubled his money with an initial investment.<\/p>\n<p class=\"wp-block-paragraph\">Anthony Box, Allen\u2019s lead counsel, questioned Crim about him being asked about documents he said he didn\u2019t remember and asked if his memory was foggy.<\/p>\n<p class=\"wp-block-paragraph\">\u201cI don\u2019t remember my account numbers but not sure you would either,\u201d Crim said.<\/p>\n<p class=\"wp-block-paragraph\">He talked about trying to get his money and not being able to get hold of anyone in Ferrum\u2019s Lubbock offices.<\/p>\n<p class=\"wp-block-paragraph\">Richard Munzy, of Bulvedere, who also invested with his wife Barbara, had a series of texts with Cox to find out about his money that were shown in court.<\/p>\n<p class=\"wp-block-paragraph\">\u201cHello Mike, I was wanting to get a status \u2026 on my account,\u201d Munzy texted.<\/p>\n<p class=\"wp-block-paragraph\">\u201cHi Richard, apologize for the delay. Busy tax day yesterday,\u201d Cox texted.<\/p>\n<p class=\"wp-block-paragraph\">\u201cInterested in status of account. Is it still closing?\u201d Munzy asked about Ferrum IV.<\/p>\n<p class=\"wp-block-paragraph\">Later, he texted he was getting concerned, asking Cox if there was a problem, saying he was concerned Cox wasn\u2019t responding.<\/p>\n<p class=\"wp-block-paragraph\">\u201cI don\u2019t have any details. I was burned by CAG so \u2026 get worried rather quickly,\u201d Munzy added.<\/p>\n<p class=\"wp-block-paragraph\">Cox responded, apologizing for the delay, saying he\u2019d talk with Allen on Monday morning and give him an update.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIs today a good day?\u201d Munzy texted another day.<\/p>\n<p class=\"wp-block-paragraph\">\u201cHas Joshua not reached out?\u201d Cox texted, giving Munzy Allen\u2019s cell phone number. \u201cYou are more than welcome to reach out to him. He works directly with Ferrum IV.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Munzy said he didn\u2019t believe he ever talked to Allen, but they swapped some texts:<\/p>\n<p>Allen texted he was in a continuing education conference one week.<\/p>\n<p>Another time he said he was covered all morning but they were trying to call all the different Ferrum IV notes.<\/p>\n<p>Another time he was in a conference.<\/p>\n<p>He said they were waiting for the obligor to send a financial statement.<\/p>\n<p>Then he texted, \u201csorry, I had a nephew get married at a destination wedding and still waiting.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Munzy texted Cox again asking if these things take this long. Cox said he asked Allen for an update. That was on Sept. 18.
