His advice is this: \u201cCome forward and say, \u2018Look, we can come up with $20 million or whatever it is that they can dig up. \u2026 They need to dig up every dime they can and voluntarily surrender to the court as restitution. If they got offshore bank accounts, if they got a stash somewhere, selling their houses, I don\u2019t know \u2013 but they need to do anything they can to convince that judge that they\u2019re sorry and they want to make amends.\u201d<\/p>\n
LubbockLights.com asked Aguilar how much of her $450,000 she might get back.<\/p>\n
\u201cI have no idea. Nobody\u2019s given me any figures on anything,\u201d Aguilar said.<\/p>\n

And I didn\u2019t leave until it ended because this is what I wanted to see happen,\u201d Aguilar said.<\/p>\n Often non-violent federal offenders are allowed to remain free until their sentencing dates. But Biery ordered Allen and Cox to be taken into custody.<\/p>\n \u201cI can tell you when the U.S. Marshals walked up there, I was like, \u2018This is exactly how I wanted this to play out,\u2019\u201d Aguilar said.<\/p>\n \u201cThis happened to a lot of people. Absolutely. People that needed liver transplants, people that had disabled children that they need to take care of,\u201d Aguilar said.<\/p>\n \u201cI have a situation where when I\u2019m dead and gone, there\u2019s going to be money needed in my family. It\u2019s not going to be there,\u201d she said.<\/p>\n Pursuing money for the victims<\/p>\n The morning after a jury convicted Allen and Cox, federal officials vowed to do all they could to get restitution for the victims.<\/p>\n Pulman said, \u201cI don\u2019t know on the criminal side how restitution is given to the victims. That would not be a question that I could answer. We\u2019re still pursuing many of the parties that are higher up on the Ponzi scheme hierarchy than Cox and Allen.\u201d<\/p>\n King said, \u201cIt\u2019s not one source paying everybody back. It\u2019s potentially several different mechanisms to get the money and get it back in the hands of the victims.\u201d<\/p>\n Separate from the federal case, Ferrum was put under a court-ordered receiver, John Patrick Lowe of San Antonio.<\/p>\n Lowe is also working to get money back for victims.<\/p>\n Price said that\u2019s important. Much of the Ferrum money went to Austin-based Collins Asset Group (CAG). CAG filed for bankruptcy in 2025.<\/p>\n One company with which CAG did business \u2013 New York-based Metropolitan Partners Group Administration LLC \u2013 sued Ferrum this year. Metropolitan claims Ferrum was overpaid for its loans to CAG.<\/p>\n Metropolitan wants $10 million or more. But that\u2019s not all.<\/p>\n Separately in the CAG bankruptcy, Metropolitan claims it owns $31 million currently under dispute in the CAG bankruptcy. The bankruptcy trustee (Ron Satija) is pursuing the disputed money.<\/p>\n And the bankruptcy judge ruled \u2013 for now \u2013 putting a hold on the $31 million in June.<\/p>\n That does not mean the trustee gets the money and it certainly does not mean Ferrum victims get the money. It does mean the money is not going anywhere until the courts can figure out the dispute.<\/p>\n Even if the trustee can hold on to the disputed money, it could eventually be distributed to multiple creditors \u2013 not just the Ferrum receiver.<\/p>\n King said, \u201cThere would still be a shortfall.\u201d<\/p>\n As for Ferrum victims, King said, \u201cIt\u2019s highly, highly likely that they\u2019re going to end up with fractions of what they put in.\u201d<\/p>\n But King promised the lawyers are not done looking for money and not done litigating.<\/p>\n Here\u2019s where it stands for now<\/p>\n Lowe filed a quarterly report in July showing more than $2.7 million in the bank.<\/p>\n But Lowe\u2019s attorney, Royal Lea, said that\u2019s now up to $2.9 million as of Wednesday.<\/p>\n Lowe filed a lawsuit against 65 people who were \u201cnet winners\u201d from the \u201cFerrum Ponzi scheme.\u201d He\u2019s seeking to get back ill-gotten profits paid to some at the expense of others.<\/p>\n Up until recently he was willing to settle out of court for 50 percent of the profit some folks made early on with Ferrum.<\/p>\n \u201cTo date, 40 of the defendants in the Net Winner Lawsuit have accepted the Receiver\u2019s 50 percent offer and have paid the Receiver a total of $1,301,017.40 in settlements,\u201d the quarterly report said.<\/p>\n Lea said there\u2019s one more very important detail for Ferrum victims.<\/p>\n \u201cThe deadline for investors to submit their claims in the receivership is coming up,\u201d Lea said.
