{"id":424137,"date":"2026-09-02T17:09:36","date_gmt":"2026-09-02T17:09:36","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/424137\/"},"modified":"2026-09-02T17:09:36","modified_gmt":"2026-09-02T17:09:36","slug":"lubbock-businessman-convicted-of-fraud-requests-new-trial","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/424137\/","title":{"rendered":"Lubbock businessman convicted of fraud requests new trial"},"content":{"rendered":"<p class=\"wp-block-paragraph\">Joshua Allen claimed an \u201cerror infects the trial\u201d that convicted him and Michael Cox of securities fraud and conspiracy.<\/p>\n<p class=\"wp-block-paragraph\">The two Lubbock businessmen were convicted on August 18 in San Antonio. They are currently held in federal custody until their sentencing date in December. Both face a statutory maximum of 70 years.<\/p>\n<p class=\"wp-block-paragraph\">Hundreds of investors, many of them in Lubbock, lost millions of dollars in Lubbock-based Ferrum Capital \u2013 the company Allen and Cox co-founded.<\/p>\n<p class=\"wp-block-paragraph\">Allen\u2019s attorney, Anthony Box, wrote in court records Tuesday, \u201cIt is undisputed that the [financial] instruments in this case \u2013 the Ferrum Capital instrument \u2013 were promissory notes. To find a defendant guilty of securities fraud, a jury must determine if the instrument at issue is in fact a security.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Box claimed the jury was given bad instructions based on the wrong legal standard of what is (or is not) a security.<\/p>\n<p>What are securities?<\/p>\n<p class=\"wp-block-paragraph\">The Texas State Securities Board provides a definition online.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThe term \u2018security\u2019 is defined broadly to include a wide array of investments such as stocks, bonds, notes \u2026 and investment contracts,\u201d <a href=\"https:\/\/www.ssb.texas.gov\/securities-professionals\/regulation-securities\/what-security\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">the TSSB website said<\/a>.  <\/p>\n<p class=\"wp-block-paragraph\">Not every note or loan is a security, Box argued. The Supreme Court of the United States set up a test that considers whether the note looks more like an investment versus a commercial loan. It also considers what the investing public might expect.<\/p>\n<p class=\"wp-block-paragraph\">Box argued the test given to jurors was designed for a different type of investment, not promissory notes like those sold through Ferrum.<\/p>\n<p class=\"wp-block-paragraph\">The error is so bad, Box argued, that it \u201cinfects\u201d all four counts against him \u2013 not just securities fraud.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThis error entitles \u2026 Allen to a new trial rather than merely an overruling of the conviction on Count 4 [securities fraud],\u201d Box wrote.<\/p>\n<p class=\"wp-block-paragraph\">Federal prosecutors have not yet filed a response in court records. The question will be decided by U.S. District Court Judge Fred Biery.<\/p>\n<p>Allen and Cox \u2018restrained\u2019<\/p>\n<p class=\"wp-block-paragraph\">In another big development since the trial wrapped up, Biery restrained Joshua Allen and Michael Cox from selling, moving or concealing their assets last week.<\/p>\n<p class=\"wp-block-paragraph\">Assistant U.S. Attorney Kristy Callahan in a request to Biery wrote, \u201c[Cox] cannot and should not be trusted to manage his assets before his victims can be compensated.\u201d<\/p>\n<p class=\"wp-block-paragraph\">She wrote the same thing about Allen too.<\/p>\n<p class=\"wp-block-paragraph\">\u201cIt does not appear that the United States \u2026 has complete and accurate information about all of [Cox\u2019s] business dealings,\u201d Callahan said in her filing.<\/p>\n<p class=\"wp-block-paragraph\">She claimed Cox was allowed to keep a home and three retirement accounts in his 2024 personal bankruptcy.<\/p>\n<p class=\"wp-block-paragraph\">\u201cThese assets can be dissipated,\u201d Callahan wrote.<\/p>\n<p class=\"wp-block-paragraph\">But she\u2019d like an opportunity to forfeit them to the government to pay back victims.<\/p>\n<p class=\"wp-block-paragraph\">Callahan added that Allen\u2019s financial status was \u201copaque.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Prosecutors put a lien on Allen\u2019s 5,185-square-foot home in June, which for the coming tax year has a taxable value of just less than $1.2 million, according to the Lubbock Central Appraisal District. And there was already a temporary restraining order on Allen\u2019s business interests even before he went on trial.<\/p>\n<p class=\"wp-block-paragraph\">Callahan listed more than 40 companies in which Allen either holds a financial interest or owns.<\/p>\n<p class=\"wp-block-paragraph\">\u201c[Allen] should be restrained from making decisions that could impede the ability to recover restitution,\u201d Callahan told the judge.<\/p>\n<p class=\"wp-block-paragraph\">An FBI investigation started with Ferrum\u2019s affiliate Brooklynn Willy in San Antonio \u2013 and that remained the geographic center of the case even thought Ferrum was based in Lubbock. Willy pleaded guilty this year and will also be sentenced in December.<\/p>\n<p>No longer presumed innocent<\/p>\n<p class=\"wp-block-paragraph\">\u201cPost-conviction defendants \u2018no longer are bathed with the presumption of innocence,\u2019 and the court has the power to restrain assets between the time of conviction and the time of sentencing,\u201d Callahan said.<\/p>\n<p class=\"wp-block-paragraph\">The value victims lost has been listed differently in various court records.<\/p>\n<p class=\"wp-block-paragraph\">The indictment against Allen and Cox claimed, \u201cHundreds of victims invested approximately $67 million into Ferrum Capital.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Justin Simmons, United States Attorney for the Western District of Texas, said, \u201cConservatively, $50 million was lost across 500 victims.\u201d<\/p>\n<p class=\"wp-block-paragraph\">Simmons spoke the day after a jury found Allen and Cox guilty.<\/p>\n<p class=\"wp-block-paragraph\">\u201cWhat kind of money they\u2019ll actually have to pay \u2026 is unknown, but we will pursue that as long as it takes,\u201d Simmons said.<\/p>\n<p class=\"wp-block-paragraph\">Court records do not yet list a timetable for recovering money on behalf of the Ferrum victims.
