<\/p>\nBEXAR COUNTY, Texas \u2013 A San Antonio man accused of sexually assaulting his 13-year-old neighbor decades ago is now being sued by the woman, who claims he impregnated her and later forced her into marriage.<\/p>\n
The lawsuit, which was filed in Bexar County District Court, seeks more than $1 million in damages from Javier Valadez for what the woman describes as severe trauma and mental health issues stemming from the relationship that began when she was a child.<\/p>\n
When reached for comment, the plaintiff \u2014 who is now more than 50 years old \u2014 told KSAT Investigates that based on the allegations in the complaint, her opinion is that Valadez is \u201ca predator that manipulated a child.\u201d <\/p>\n
She declined a request from KSAT to be interviewed about the legal filing. KSAT is not naming the woman since the acts described in the suit occurred when she was a minor. <\/p>\n

Valadez beat child sex assault charge, likely had criminal case expunged <\/p>\n
In June 1989, Valadez was indicted by a Bexar County grand jury for aggravated sexual assault of a child in an incident the previous summer with a then-13-year-old girl, court records obtained by KSAT Investigates show.<\/p>\n
The case was dismissed months later, in September 1989, after the teen waived prosecution, records show.<\/p>\n
A spokesperson for the Bexar County District Attorney\u2019s Office told KSAT that DA officials are prohibited by law from talking about the case \u2014 an indication Valadez likely took steps to expunge the criminal matter. <\/p>\n
The civil suit, however, has brought new details about the relationship into a courtroom setting.<\/p>\n
The plaintiff claims Valadez, who is nearly nine years older than her, seduced her when she was 13, impregnated her and then forced her into marriage while she was still under 18.<\/p>\n

Bexar County Clerk records show Valadez was granted a marriage license to wed the teen a month after her 17th birthday in May 1992.<\/p>\n
The marriage was legal at the time in Texas, as long as a parent granted permission, but no longer would be.<\/p>\n
Texas Senate Bill 1705, which was passed into law in 2017, significantly restricted marriage involving minors and eliminated the parental consent exception.<\/p>\n
Valadez and the woman divorced in 1999, court records confirm.<\/p>\n
Last month, KSAT Investigates made multiple attempts to speak with Valadez about the suit.<\/p>\n
His partner, Angela Alderete, told KSAT Valadez was home, but questions about the legal filing would need to go through her.<\/p>\n
Alderete did not dispute the timeline listed in the court filing but described the suit as an attempted cash grab by the woman.<\/p>\n
\u201cThe reason she\u2019s doing this is she owes $50,000 in child support,\u201d said Alderete, who added that Valadez wed the teen because he felt sorry for her.<\/p>\n
\u201cShe was with different men all the time because her mother would go off and leave her by herself,\u201d said Alderete of the then-underage teenager.<\/p>\n

The plaintiff\u2019s attorney, Beauregard Fiegel, sent KSAT the following statement: <\/p>\n
\u201cMy client\u2019s lawsuit is not related to the child support case. Her lawsuit is about seeking justice, having her voice heard, getting recompense for the trauma she endured, and having the Defendant face consequences and accountability for his actions. At the age of 23, he begin raping my client who was 12. He continued to assault her from age 12 through 16. At 13, she became pregnant with her child. The child was born a month after my client turned 14. Her mother and his parents pressured and forced her into marriage at age 16. From the age of 12 to present day, neither the Defendant, her parents, the police, CPS, or the family courts have held the Defendant accountable. Maybe the civil courts will now.\u201d<\/p>\n

The statement lists the woman as being 12 years old when the sexual assaults began, a year younger than is stated in the suit.<\/p>\n
Additionally, public records confirm Valadez and the woman are eight years and eight months apart in age \u2014 not 11 years apart in age.<\/p>\n
The plaintiff declined to provide the amount owed in child support but reiterated her attorney\u2019s statement that the suit \u201chas nothing to do with child support.\u201d<\/p>\n
Judge allows Valadez to stay in locked room during recent child custody hearing<\/p>\n
Valadez was in court Aug. 21 for an unrelated child custody hearing, but he was allowed by Judge Cynthia Chapa to stay in a locked meeting room near the courtroom and out of sight of cameras.<\/p>\n
An attorney taking part in the hourslong hearing said in court Valadez was trying to avoid the media.<\/p>\n
Attorneys for Valadez repeatedly left the courtroom to allow him to review paperwork from the hearing and, ultimately, to have him sign it.<\/p>\n
Valadez remained silent as a court bailiff escorted him from the locked room to an elevator after the hearing concluded.<\/p>\n

Valadez was escorted to the elevators by a bailiff on Aug. 21, following a child custody hearing. (KSAT)<\/p>\n
Attorney Megan Meyerson, who represents Valadez in both the civil sex assault and child custody cases, declined to comment to KSAT as she left the hearing.<\/p>\n
\u201cWhat were these hijinks today having him hide in a side room? Wouldn\u2019t show his face for this custody hearing?\u201d KSAT Investigates asked Meyerson. <\/p>\n
\u201cNo comment,\u201d Meyerson told KSAT before getting onto an elevator. <\/p>\n
Valadez cleared in two indecency with a child investigations<\/p>\n
Valadez was arrested in 2023 on a misdemeanor family violence charge, nearly two years after investigators said he struck, grabbed and scratched one of his ex-wives.<\/p>\n
The case was dismissed in December 2023 after prosecutors were unable to locate a neighbor who investigators said witnessed the alleged assault and could testify at trial, records show.<\/p>\n

Valadez was arrested in 2023 on a misdemeanor family violence charge. The case was dismissed months later. (KSAT)<\/p>\n
Valadez has twice been investigated for indecency with a child the past five years but both cases were closed without him being criminally charged.<\/p>\n
A 2021 investigation was opened by San Antonio police and then quickly closed, records show.<\/p>\n
Investigators again looked into accusations against Valadez in early 2024 after the same girl made an outcry to her elementary school teacher.<\/p>\n
A spokeswoman for San Antonio Independent School District confirmed the date of the outcry and said the girl\u2019s teacher reported it to Child Protective Services the same day.<\/p>\n
Prosecutors recently closed the case without charging Valadez.<\/p>\n
A DA\u2019s office spokesperson said prosecutors determined the case could not be proven beyond a reasonable doubt.<\/p>\n
\u201cShe\u2019s living with somebody that harmed her,\u201d the girl\u2019s mother recently told KSAT in an interview.<\/p>\n
A judge, however, wrote in a court order that the woman made a false report to CPS and police. In October 2024, the judge ordered her to pay Valadez more than $12,800 for attorney\u2019s fees and expenses.<\/p>\n
The woman maintains that concerns about her daughter are true and disputes the court order, which requires her to pay child support.<\/p>\n
Valadez has not been convicted of any sex offense or any crime involving a minor, according to records.<\/p>\n
