But parents who pay for childcare are also buying a service on the promise that their children will be safe. A lawsuit filed in Texas alleges that Arka Montessori Academy of Risinger failed in that most basic obligation, following an incident in which staff allegedly encouraged four-year-old children to fight.

Heather and Richard Harris have sued the Fort Worth nursery, alleging that harrowing surveillance footage shows a teacher encouraging her own son to hit and kick the Harris’s child, identified in court papers seen by ICLG News as UH. The claim describes the classroom as a “child fight club” and alleges that the boy was thrown to the floor “like a human ragdoll”.

The parents seek more than $1 million in damages from Arka Risinger Educators, which operates the nursery. Their claim includes negligence, negligence per se and gross negligence.

The alleged incident

According to the complaint, UH was moved into another classroom at the end of the day after his usual teacher had left. A boy then struck him on the back and a fight ensued while the teacher responsible for the room had her back turned. The children had stopped fighting by the time the teacher became aware of the incident. But when another teacher, Chynia Johnson, entered to cover a toilet break, the confrontation allegedly resumed. Johnson’s son was the other child involved.

The lawsuit alleges that, rather than separate the children, the teacher grabbed UH by the arm, shook him and screamed in his face. It further claims that she encouraged her son to hit and kick UH, before grabbing the boy again, pulling his leg from beneath him while holding his wrist and causing him to fall onto a hardwood floor.

Watch the surveillance footage here (no sound).

When UH’s mother arrived to collect him, she found him crying “hysterically and uncontrollably”, according to the filing. The nursery initially said only that the children had fought, the claim states, prompting Mrs Harris to demand that she see the classroom footage.

“Nothing prepared me for seeing my child aggressively handled and attacked by another child at a teacher’s orders,” Mrs Harris said in a statement. “My heart just shattered into pieces because I couldn’t be there to protect my son from being harmed, all while he was being cared for by a daycare that I trusted.”

The complaint says the child suffered bruises, scratches and post-traumatic headaches, and has since experienced anxiety and fear around daycare.

State findings

The lawsuit says that the Texas Health and Human Services Commission’s Child-Care Licensing Division investigated the incident and cited the nursery for improper disciplinary methods and prohibited punishments, including grabbing, pulling and yelling. It also cited a caregiver for failing to intervene to protect a child.

The claim further alleges that the facility had received 16 safety-related citations since it opened in 2024. These included incidents in which children were allegedly left outside or alone in classrooms, alongside deficiencies concerning first-aid and CPR training.

The Harrises contend that the nursery knew of the teacher’s alleged pattern of shouting at and handling children aggressively, but retained her. Those allegations have not been tested in court.

Russell Button of The Button Law Firm, which represents the family, said: “The video and the state’s own findings show a daycare center that failed this little boy on the most basic level, and the warning signs were there long before he was hurt.” He added that the aim of the action was to obtain answers for the parents and protect other children.

The legal claim

The parents say Arka Montessori was negligent in its hiring, training and supervision of staff, and in failing to provide a safe environment for children in its care. They also advance a negligence-per-se claim, relying on alleged breaches of Texas childcare standards, and accuse the operator of gross negligence.

Under Texas law, gross negligence requires more than a mistake or lapse in care. The Harrises must show that the nursery faced an extreme risk of harm, knew of it and proceeded with conscious indifference to children’s safety. They are seeking compensatory damages, as well as exemplary damages intended to punish especially serious conduct.

A Texas Montessori nursery faces a $1 million claim after parents alleged that staff encouraged a fight involving…

[6
151262,103934,27,29,151263,28,89418
post-436529","post","type-post","status-publish","format-standard","has-post-thumbnail","category-texas","tag-arka-montessori-academy-of-risinger","tag-gross-negligence","tag-texas","tag-texas-headlines","tag-texas-health-and-human-services-commissions-child-care-licensing-division","tag-texas-news","tag-the-button-law-firm
["GET
