Rodriguez was found lying near a driveway wearing only blue boxer shorts and white socks and was already showing early decomposition.

An autopsy the following day found Rodriguez had been shot in the upper left chest and had head and facial lacerations and several broken ribs, according to the affidavit. The medical examiner ruled the death a homicide caused by a gunshot wound to the torso.

Investigators identified Rodriguez through fingerprints and later interviewed his family, the affidavit states. His mother told investigators she last spoke to him Sept. 4, while his sister said she last saw him Sept. 3, when he gave her $500 and another $300 for their mother. When asked where the money came from, Rodriguez allegedly replied, “Don’t ask.”

The affidavit says investigators received information from confidential informants that Rodriguez was killed by his friend, Nicolas Campos, after allegedly stealing $7,000 from a woman while she was incarcerated Sept. 3-4. Campos and the woman were linked to an address in the 200 block of Cortez Avenue, which the affidavit says had previously been associated with both of them during a narcotics investigation.

An associate of Rodriguez told investigators Rodriguez rented a white Honda with Texas plate XNV4836 on Sept. 4 and that it was the vehicle in which she last saw him, the affidavit states. Another witness told investigators he was with Rodriguez in that rental vehicle from late Sept. 4 into early Sept. 5. The witness said Rodriguez dropped him at a game room near U.S. Highway 90 and Brady Boulevard, then left, saying he needed to do something. Rodriguez did not return, according to the affidavit.

Investigators later located the rental vehicle at the 200 block of Remount Drive and received consent to search it from its registered owner, the affidavit states. Vehicle-location data allegedly placed the Honda at the 2000 block of Rivas Street at about 1:12 a.m. Sept. 5.

Security video from a nearby residence reportedly showed a small SUV, believed to be the rental vehicle, arriving at the 2000 block of Rivas Street; a man believed to be Rodriguez walking toward the rear of the property; and several men later emerging from that area, according to the affidavit. Investigators say Rodriguez was then seen running away wearing a T-shirt and underwear while two armed men chased him. One caught him, escorted him to a large white SUV, and forced him into its rear cargo area, the affidavit states. The white SUV then left, followed by Rodriguez’s rental vehicle.

During a Sept. 17 search of 2103 Rivas St., the property owner identified Garza as a tenant who had lived there for more than a year, according to the affidavit. Garza agreed to speak with investigators and was taken to the sheriff’s office for an interview. Although told he was not in custody, he was read Miranda warnings in Spanish and described the events, the affidavit states.

Garza allegedly told investigators that around 1 a.m. Sept. 5, he was drinking beer at a neighbor’s home near Northwest 25th Street when a white SUV pulled into his driveway. He said two unknown men asked where Rodriguez was, took Garza’s cellphone, displayed guns, and directed him to call Rodriguez and lure him to the home. Garza said he called Rodriguez, who agreed to come to sell him methamphetamine.

Garza allegedly told investigators there were three unknown men and one unknown woman involved, according to the affidavit.

Garza said Rodriguez arrived about 1:10 a.m. in the white Honda, and the three men approached him and repeatedly punched and kicked him, the affidavit states. Rodriguez briefly escaped and ran down Northwest 25th Street, but one of the men caught him and brought him back, Garza allegedly told investigators.

Garza said Rodriguez was forced into the rear of the white SUV, while the woman got into Rodriguez’s Honda. Both vehicles then left, with the Honda following the SUV, according to the affidavit.

Garza told investigators he left in his work truck because he was scared. He allegedly said he did not report the assault or abduction because he was afraid and did not think Rodriguez would be killed. He said he later saw a news report that Rodriguez had been murdered and became concerned that he could face trouble for failing to report what happened, the affidavit states.

Based on Garza’s account and other investigative evidence, the affidavit alleges Garza failed to immediately report a felony under circumstances in which a reasonable person would believe serious bodily injury or death could result.

Garza remains in custody of the Bexar County Jail on a $10,000 bond, according to jail records.

SAN ANTONIO – A man is accused of failing to report a felony after investigators say he witnessed…

[8
82,84,83
post-441647","post","type-post","status-publish","format-standard","has-post-thumbnail","category-san-antonio","tag-san-antonio","tag-san-antonio-headlines","tag-san-antonio-news
["GET
