HOUSTON, Texas (KTRK) — A unanimous Houston City Council voted to begin enforcing a state law requiring candidates for public office to report who contributes to their campaigns.<\/p>\n
The measure passed Wednesday and was led by At-Large Councilman Julian Ramirez. It creates a process to identify candidates who submit campaign finance reports late or fail to file them.<\/p>\n
Under the proposal, Houston City Secretary Troy Lemon will be required to post the names of candidates who file their campaign finance reports more than one day late. The secretary must also file a sworn complaint with the Texas Ethics Commission when a candidate misses a reporting deadline.<\/p>\n
The Texas Ethics Commission would then determine whether civil penalties should be assessed.<\/p>\n
“These laws are important because they let the public know who finances our political campaigns and help the public know who follows the rules,” Ramirez said.<\/p>\n
The council voted 15-0 to approve the proposal.<\/p>\n
Ramirez said the policy is intended to increase transparency and ensure campaign finance reporting requirements are enforced.<\/p>\n
During the discussion, District J Councilman Edward Pollard raised concerns about creating a process in which elected officials could be responsible for policing one another.<\/p>\n
“My only issue is we’re creating some framework where we’re policing each other,” Pollard said.<\/p>\n
Ramirez said the enforcement process would be handled by the city secretary, rather than opposing candidates or other elected officials.<\/p>\n
“Opposing candidates don’t have to call anyone out. This will be in the hands of the City Secretary,” Ramirez said.<\/p>\n
Ramirez said officials previously had concerns about enforcing campaign finance rules against fellow elected officials. After reviewing the proposal, he said the council chose to place enforcement responsibility with the city secretary, who is not an elected official.<\/p>\n
Roger Borgelt, an attorney with Borgelt Law who is not affiliated with the matter, said enforcement is important to ensure campaign finance laws have meaningful consequences.<\/p>\n
“Most home rule cities in Texas sort of like controlling their own process rather than bringing the state in. Most times, you don’t want the state brought into your local issue,” Borgelt said.<\/p>\n
Borgelt said the proposal is a practical step that could cost less than establishing a separate ethics commission, but described it as a potential interim solution.<\/p>\n
“It’s a good idea to do something. It’s less expensive than setting up an ethics commission, but it seems like a stopgap sort of thing to me,” Borgelt said.<\/p>\n
Under state law, the Texas Ethics Commission can assess civil penalties of up to $500 for each violation.<\/p>\n
The new enforcement process is intended to ensure Houston candidates comply with campaign finance reporting requirements and that the public can access information about campaign contributions.<\/p>\n
