{"id":452129,"date":"2026-09-30T13:32:08","date_gmt":"2026-09-30T13:32:08","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/452129\/"},"modified":"2026-09-30T13:32:08","modified_gmt":"2026-09-30T13:32:08","slug":"man-shot-by-ice-agent-to-appear-in-austin-federal-court-on-assault-charge","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/452129\/","title":{"rendered":"Man shot by ICE agent to appear in Austin federal court on assault charge"},"content":{"rendered":"<p>AUSTIN, Texas (KEYE)  \u2014 A man <a href=\"https:\/\/cbsaustin.com\/news\/local\/one-person-injured-in-north-austin-shooting\" target=\"_blank\" rel=\"nofollow noopener\">shot by an ICE agent in North Austin<\/a> is expected in federal court in downtown Austin today as he faces <a href=\"https:\/\/cbsaustin.com\/news\/local\/man-shot-by-ice-in-north-austin-charged-with-assaulting-federal-officer\" target=\"_blank\" rel=\"nofollow noopener\">a new criminal case<\/a> that has also delayed his immigration proceedings.<\/p>\n<p>Wilber Garc\u00e9s P\u00e9rez is charged federally with assaulting, resisting, interfering and impeding a federal officer. He also had a hearing in San Antonio to challenge his detention and removal from the country, but that hearing has been postponed.<\/p>\n<p><a href=\"https:\/\/cbsaustin.com\/news\/local\/man-shot-by-ice-in-north-austin-charged-with-assaulting-federal-officer\" target=\"_blank\" rel=\"nofollow noopener\">PREVIOUS COVERAGE | Man shot by ICE in North Austin charged with assaulting federal officer<\/a><\/p>\n<p>His attorney, Kate Lincoln-Goldfinch, said rapid changes in his custody status left her legal team trying to locate him Tuesday and determine which federal case would proceed first. She said that when she logged on for a scheduled call with him yesterday morning, he was not there.<\/p>\n<p>\u201cThat began a scramble with the legal team to try to figure out what happened to our client. Was he in the hospital? Had he been deported? Was he sent to a third country? We didn\u2019t know until we heard that he had been taken to the federal courthouse in Austin and charged criminally,\u201d Lincoln-Goldfinch said.<\/p>\n<p>\u201cI want to be really clear. This is an example of the government playing games with the life of a human being who matters very much to us and to his family,\u201d she said.<\/p>\n<p>According to the criminal complaint, ICE stopped Garc\u00e9s P\u00e9rez on Sept. 20. Prosecutors allege he drove away and his side mirror hit an officer. After a pursuit, prosecutors say he tried to hit another officer and was shot.
