Nearly three years ago, a man was struck<\/a> by a tractor-trailer while crossing eight lanes of Houston’s Interstate 610<\/a> on foot. He died two days later. Now, an appeals court has revived a wrongful-death lawsuit stemming from his death.<\/p>\n

On Sept. 15, the 14th Court of Appeals revived a wrongful-death lawsuit brought<\/a> by Mohammed\u00a0Ghanbarikaleh’s family. They allege negligence by Rigoberto Leon Rodriguez, who was driving the tractor-trailer, and Alain Leon Rodriguez, who owned it and did business as Alain Rodriguez Trucking.<\/p>\n

Attorneys for the plaintiffs and defendants did not immediately respond to\u00a0Chron’s requests for comment Wednesday.<\/p>\n

Ghanbarikaleh’s parents sued Rigoberto and Alain after the Dec. 9, 2021, incident, seeking between $200,000 and $1 million in damages. Ghanbarikaleh was crossing the freeway at 2400 North Loop on foot when he was struck by a tractor-trailer driven by Rigoberto, according to the original petition.<\/p>\n

The case was dismissed without a trial after the trial court granted the defendants’ motion for summary judgment, which argued that\u00a0Ghanbarikaleh had died by suicide<\/p>\n

On appeal,\u00a0Ghanbarikaleh’s parents argued that the defendants raised the suicide defense too late and that they needed more time to gather evidence. They also said they had evidence to counter the defendants’ claim that their son died by suicide.<\/p>\n

The appeals court said the defendants failed to include suicide as a defense in their written response to the lawsuit. It overturned the trial judge’s decision to dismiss the case without a trial and sent it back for further proceedings.<\/p>\n
