Austin, Texas \u2014 Austin Police Chief Lisa Davis says APD is still waiting for key evidence from federal authorities as the department investigates the shooting of a Venezuelan man by a federal immigration officer in Austin.<\/p>\n
An Immigration and Customs Enforcement officer shot Wilber Garc\u00e9s P\u00e9rez, 28, on Sept. 20 during a traffic stop in North Austin. According to the criminal complaint, ICE officers stopped Garc\u00e9s P\u00e9rez because an immigration judge had issued a final order of removal against him. Body camera footage shows Garc\u00e9s P\u00e9rez driving off despite direction from officers to park his car and exit his vehicle. An officer fired at Garc\u00e9s P\u00e9rez following a pursuit.<\/p>\n
APD began its own investigation immediately but has not received requested materials from federal partners.<\/p>\n
“We have made several attempts or several calls to our federal partners. We’ve not received anything at this point,” Davis said.<\/p>\n
CBS Austin has contacted the Department of Homeland Security for clarification on whether or not it plans to share the evidence with local investigators.<\/p>\n
Federal investigators are leading a criminal case against 28-year-old Wilber Garces Perez for assaulting and evading a federal officer, and are also conducting their own investigation into the shooting.<\/p>\n
Davis said the Travis County District Attorney is making a formal request for the evidence on behalf of both the police department and his office.<\/p>\n
She explained that Austin police have shared their own evidence with federal investigators.<\/p>\n
“We have shared what we have with them. I don’t know if they even had to ask,” Davis said.<\/p>\n
In the wake of the shooting, an internal memo reported by CBS News revealed ICE agents are now prohibited from high-speed chases and must complete stricter training before conducting traffic stops.<\/p>\n
“I think any steps where you have additional training is valuable in any public safety realm. And I’m not too familiar with the changes. But again, what I can say, if it’s additional training, that’s good for public safety,” Davis said.<\/p>\n
Davis said that the Austin Police Department’s investigation will continue. “<\/p>\n
I also want the City of Austin to know, and certainly the citizens of Austin to know that our investigation continues, and we will be able to deliver a good investigation to the DA,” she said.<\/p>\n
