An El Paso man was charged with cruelty to non-livestock animals after a German Shepherd puppy allegedly fell from the bed of his moving pickup truck and suffered visible injuries, according to a complaint affidavit filed by the El Paso County Sheriff’s Office.

A sheriff’s lieutenant reported seeing the unsecured puppy fall from a black Chevrolet Silverado in the 400 block of South Darrington Road at about 6:58 p.m. Oct. 3.

The lieutenant reported seeing blood and abrasions on the puppy’s face, nose, and right rear leg, as well as difficulty standing and sitting.

Victor Martinez, 64, was identified as the driver. After being read his rights, Martinez allegedly told the deputy he had transported the puppy unsecured because the dog “needed to learn,” the affidavit states.

A passenger, identified in the affidavit as Martinez’s grandson, told deputies the puppy had fallen from the truck earlier that same day and that he had urged Martinez to secure the animal.

An on-call Animal Welfare officer inspected the six-month-old puppy and reported it may have suffered hip injuries or displacement, requiring X-rays and medication, according to the affidavit.

Martinez was arrested on the animal cruelty charge.
