A Texas prosecutor said he was considering felony assault charges for an Immigration and Customs Enforcement (ICE)<\/a> officer who ran over a man<\/a> following an attempted traffic stop and broke his leg in multiple places.<\/p>\n

Sean Teare, district attorney for Harris county, said video of the incident in west Houston<\/a> on Saturday morning, in which the officer\u2019s unmarked SUV is seen veering into the man as he runs away across an empty parking lot, could support a charge of aggravated assault with a deadly weapon.<\/p>\n

A conviction carries a possible prison sentence of up to 20 years.<\/p>\n

\u201cIt\u2019s pretty obvious that this was an intentional striking and running over of the person by the vehicle,\u201d Teare told NBC News<\/a>, adding that his view was shared by \u201cmany other investigators\u201d who had seen the footage.<\/p>\n

The injured man, Miguel Parra-Hernandez, remained under ICE supervision at a hospital in Houston on Wednesday with serious hip and leg injuries that his representatives said would require a series of future surgeries.<\/p>\n

ICE has conceded the 48-year-old was not the target of the traffic stop, but said he was in the country illegally.<\/p>\n

The video showed the officer pursuing Parra-Hernandez in his vehicle in apparent contravention of new guidelines for traffic stops implemented this month after a series of violent and fatal confrontations<\/a> involving federal immigration officers over the summer.<\/p>\n

Teare is investigating the incident with the Harris county sheriff\u2019s office, which said an ICE agent moved the pickup truck Parra-Hernandez and another unidentified person were riding in, then left the scene in the ICE vehicle before sheriff\u2019s deputies arrived.<\/p>\n

The district attorney told NBC that ICE was refusing to cooperate, and had denied his investigators\u2019 request for access to information from the vehicle\u2019s data recorder.<\/p>\n

\u201cOur office began drafting a search warrant that we were in the process of drafting when the ICE agent in question, the one that had been driving, we believed, at the time of the collision, jumped back into the car and drove it away from the scene,\u201d Teare said.<\/p>\n

\u201cIn my 20-year career, I\u2019ve never heard of anything like that. [You] put it on a flatbed trailer and you take it to forensically download it.\u201d<\/p>\n

He said he believed two other persons from \u201can entirely different operation\u201d were in custody in the back of the ICE vehicle when the driver began to pursue Parra-Hernandez, and that his office was working to ensure they remained in the country to provide evidence as material witnesses.<\/p>\n

\u201cI\u2019ve worked with law enforcement for 20 years. There is not a single agency in the US that would teach that once you put people in custody in your car, you then begin to pursue other people,\u201d Teare said.<\/p>\n

\u201cEvery single person out there [was] in danger again.\u201d<\/p>\n

His team, he added, had gathered evidence that \u201cgoes above\u201d the surveillance video aired by multiple local media outlets, and set up a portal for videos or photographs of the incident that does not require witnesses to provide citizenship or immigration information.<\/p>\n

ICE did not respond to a request from the Guardian for comment. Over the weekend, an agency spokesperson said the target of the early-morning operation was another man, Jose Mendoza-Cervantes, an undocumented immigrant with multiple prior arrests and a final order of removal signed by a judge.<\/p>\n

At a press conference on Monday, Kim Bruno, Parra-Hernandez\u2019s lawyer, and Cesar Espinosa, executive director of the immigrant advocacy group Fiel Houston, told reporters that he had never met Mendoza-Cervantes<\/a>.<\/p>\n

Bruno said her client fled because he did not know who was in the dark-colored vehicle that was not using lights or a siren. He has no criminal record, and was on his way to work when ICE agents appeared, she said.<\/p>\n

NBC cited an ICE spokesperson who said allegations Parra-Hernandez was intentionally struck were \u201creckless and false\u201d and \u201cdisgusting smears \u2026 peddled by the media\u201d.<\/p>\n
