LUBBOCK, Texas (KCBD) – Neighbors in the Parkway Cherry Point neighborhood say they are upset after an asphalt plant started operating earlier this year. Residents say they do not want any industrial plants near their homes.<\/p>\n
The neighborhood is east of MLK and north of Parkway Drive.<\/p>\n
Resident describes dust and health concerns<\/p>\n
Rose Wilson has lived in her house for nearly 50 years. She said she saw a similar situation three years ago, when another asphalt company moved into the same area.<\/p>\n
\u201cNow they come back in full force. I don\u2019t know if they\u2019re the same people or not. All I know is it\u2019s worse than it ever has been,\u201d Wilson said.<\/p>\n
Wilson said when it gets windy, dust and asphalt cover her neighborhood, which raises health concerns.<\/p>\n
\u201cMy neighbors had their windows fixed because they were at on that corner, so they couldn\u2019t get all that dust. And then she told me the other day when we was talking about it, she said, they did the windows. They keep it out a little bit, but it\u2019s still not enough,\u201d Wilson said.<\/p>\n
Neighborhood association raises permit, zoning concerns<\/p>\n
Adam Pirtle is a staff attorney with Legal Aid of Northwest Texas. He represents the Parkway Neighborhood Association.<\/p>\n
\u201cWith the Neighborhood Association filed public information request with the city to see if there were any temporary use permit documents or specific use permit documents that the city had on file. The city didn\u2019t give us anything back, so that leads us to the conclusion that there was they didn\u2019t have those documents,\u201d Pirtle said.<\/p>\n
Pirtle said that is not his only concern. He said the land is currently zoned for \u201clow-density single-family\u201d development, which he said should block any industrial operations there.<\/p>\n
City investigates after complaint<\/p>\n
The neighborhood association filed a formal complaint in August, prompting the city of Lubbock\u2019s codes inspectors to investigate.<\/p>\n
Director Stuart Walker said his team flagged a violation for the property owner, not a company violation for operating there.<\/p>\n
\u201cPeople do things that are against the code on a daily basis. Put up illegal secondary structures, speed down the interstate. I mean, the city doesn\u2019t know about everything that goes on. I mean, it\u2019s in cases exactly like this. It was brought to our attention. We researched what was going on, found it in violation, and carried out through the procedure,\u201d Walker said.<\/p>\n
Walker said the company, Webber LLC, has until Dec. 7 to move everything out of the property. Walker said city staff believes the plant is no longer in operation and that the company is dismantling the site.<\/p>\n
Zoning change request pending<\/p>\n
City records show the property owner has requested a zoning change from \u201cresidential\u201d to \u201clight industrial,\u201d which would allow the industrial plant to operate.<\/p>\n
A public hearing with the Planning and Zoning Commission is scheduled for Nov. 5. A Lubbock City Council hearing on the change is scheduled for Dec. 1.<\/p>\n
