An Austin woman is suing Torchy’s Tacos after she nearly swallowed what appeared to be a cow tooth.

The Oct. 13 lawsuit says customer Nohemi Castillo found the tooth in her food after ordering takeout from the fast-food chain on June 9. She is now seeking $250,000 in damages and is suing the company for negligence, breach of implied warranties, deceptive trade practices and alleged violations of the Food Safety Modernization Act.

The lawsuit alleges that Torchy’s Tacos was aware of various defects and problems in its food products, and that the tacos Castillo received were “not reasonably prepared, inspected, or delivered prior to consumption by the Plaintiff.”

“Apparently, these Tacos are sometimes unsafe unbeknownst to my client,” the lawsuit said. “Had Plaintiff client been fully and truthfully informed about the nature and extent of the food defects, she would never have bought the Taco or at the very least would have examined it prior to biting into it.

In a statement, Torchy’s Tacos said it was working with its supplier to avoid the incident from happening again.

“We take all concerns about our food seriously,” the company said. “We source the highest quality food available, which means our barbacoa comes from natural beef cheek that we source from a supplier. This can occasionally happen when processing the meat, though it is quite rare. Food safety is a top priority, and we maintain robust food handling, preparation and quality control procedures. We have partnered with our supplier to reinforce their internal procedures to prevent this from happening in the future.”

An Austin woman is suing Torchy’s Tacos after she nearly swallowed what appeared to be a cow tooth.
