Man arrested after using AI to threaten elementary school, arrest affidavit says<\/a><\/p>\nHe specifically mentioned Serna Elementary School, writing, \u201cI\u2019m just gonna walk in there and start shooting up kids,\u201d and, \u201cI truly do mean my threats.\u201d<\/p>\n
The FBI flagged this, and Carrasco was arrested. But his attorney, Don Flanary of Flanary Law Firm says the case might not be as straightforward as you would think.<\/p>\n
\u201cIt\u2019s kinda dead on arrival,\u201d said Flanary.<\/p>\n
Flanary tells us that because the AI program is an object, Carrasco wasn\u2019t talking to anyone. Essentially, it was like talking to yourself in the shower.<\/p>\n
\u201cYou look at the surrounding circumstances, but in this case, because it never goes anywhere, then how could you ever infer that he was intending to communicate it?\u201d said Flanary.<\/p>\n
And even if he knew cops were listening, Flanary asks how do you prove he wasn\u2019t just trying to get their attention?<\/p>\n
\u201cI wouldn\u2019t do that, but you know what I\u2019m saying,\u201d said Flanary.<\/p>\n
With no other evidence presented yet, attorneys like Joe Hoelscher of HGC Law Firm and Gerald Goldstein of Goldstein & Orr also think the case is flimsy.<\/p>\n
\u201cPeople troll chatbots all the time. That doesn\u2019t mean that we fabricate a warrant,\u201d said Joe Hoelscher.<\/p>\n
Goldstein goes further, saying it\u2019s difficult for the law to keep up with new technology that feels like it\u2019s advancing almost every month.<\/p>\n
\u201cThe Texas Legislature only has to meet every other year,\u201d said Gerald Goldstein.<\/p>\n
Even though the attorneys we spoke to think the case may not hold up in court, three NEISD officers were suspended and two sergeants were let go.
