<\/p>\nNearly three weeks after an Immigration and Customs Enforcement agent ran over a man in northwest Harris County, newly obtained court documents provide a detailed account of the moments leading up to the collision and reveal how investigators\u2019 efforts to examine the federal agent\u2019s SUV were delayed.<\/p>\n
KPRC 2 News obtained a search warrant and the sworn affidavit connected to the Oct. 10 incident involving 48-year-old Miguel Parra-Hernandez near Highway 6 and Clay Road.<\/p>\n
The documents identify the ICE agent involved, describe his account of the collision and outline what an investigator with the Harris County District Attorney\u2019s Office observed while reviewing surveillance footage.<\/p>\n
The investigator reported seeing the agent accelerate toward Parra-Hernandez, make a clear turn to the left and line up his Jeep directly toward the man before striking him.<\/p>\n
The description differs from ICE\u2019s previous public statement, which said Parra-Hernandez ran in front of the vehicle.<\/p>\n
The records also reveal a separate issue in the investigation. Although authorities obtained a warrant to search the Jeep Grand Cherokee, an Oct. 23 court filing confirms local investigators had not been given access to the SUV.<\/p>\n
No criminal charges against the ICE agent have been announced. <\/p>\n
KPRC 2 is withholding his name because he has not been charged.<\/p>\n
The sworn affidavit provides details about why federal agents were in the area and how the encounter developed before Parra-Hernandez was struck.<\/p>\n
According to the document, the ICE agent told a Harris County sheriff\u2019s deputy he was looking for a man identified as Jose Mendoza.<\/p>\n
The agent said he had been following a Chevrolet Silverado pickup truck. During the encounter, the Silverado traveled the wrong way onto Clay Road before eventually stopping.<\/p>\n
The people inside the pickup ran away.<\/p>\n
According to the agent\u2019s account, he drove his Jeep Grand Cherokee over a median, crossed the street and headed toward the fleeing men.<\/p>\n
The agent acknowledged striking Parra-Hernandez with the front driver\u2019s side of his SUV.<\/p>\n
He also told the deputy the Jeep rolled over Parra-Hernandez.<\/p>\n
The affidavit documents what the agent reported to law enforcement. Investigators separately reviewed surveillance footage to determine how the collision occurred.<\/p>\n
One of the most significant portions of the affidavit describes an investigator\u2019s review of surveillance video from the shopping center.<\/p>\n
According to the sworn statement, the investigator observed the Jeep accelerating toward Parra-Hernandez as he ran through the parking lot.<\/p>\n
The investigator described the SUV making a clear turn to the left and lining up directly toward Parra-Hernandez.<\/p>\n
The affidavit also states Parra-Hernandez was running away, with his back to the Jeep, when the vehicle struck him.<\/p>\n
Those observations are significant because ICE previously offered a different description of the collision.<\/p>\n
The federal agency said Parra-Hernandez ran in front of the vehicle.<\/p>\n
The affidavit, by contrast, describes the SUV changing direction toward a man who was running away.<\/p>\n
The two accounts raise questions about the vehicle\u2019s path, the driver\u2019s actions and the circumstances immediately preceding the collision.<\/p>\n
The investigator\u2019s observations are part of a criminal investigation. They do not constitute a finding of guilt.<\/p>\n
Harris County District Attorney Sean Teare previously told KPRC 2 News his office had obtained surveillance footage and was working to collect additional video from nearby businesses.<\/p>\n
Teare, who previously led the district attorney\u2019s vehicular crimes division, said his assessment of the available footage was that Parra-Hernandez had been intentionally struck.<\/p>\n
\u201cI\u2019ve personally handled hundreds of auto-pedestrian crashes,\u201d Teare said during an Oct. 14 interview with KPRC 2.<\/p>\n
He said his assessment was shared by other investigators who reviewed the footage.<\/p>\n
Teare also disputed ICE\u2019s description of Parra-Hernandez running in front of the vehicle.<\/p>\n
His statements represent the district attorney\u2019s assessment during an ongoing investigation. A charging decision has not been announced.<\/p>\n
The investigation extends beyond the surveillance footage.<\/p>\n
Authorities also sought to examine the 2025 Jeep Grand Cherokee driven by the ICE agent.<\/p>\n
The search warrant authorized investigators to look for evidence associated with the collision, including electronic crash data.<\/p>\n
Such information is important because vehicle systems sometimes record information associated with a collision, including vehicle speed, braking and other operating conditions.<\/p>\n
Investigators wanted to examine the SUV to determine what evidence was available and whether the vehicle\u2019s electronic systems contained relevant information.<\/p>\n
Teare previously explained why investigators sought to secure the Jeep before federal agents drove away.<\/p>\n
\u201cThe Sheriff\u2019s Department had a wrecker ready to take it,\u201d Teare said during the Oct. 14 interview.<\/p>\n
He explained that crash data and other forensic evidence risk being lost when a vehicle is driven again following a collision.<\/p>\n
According to Teare, investigators informed the ICE agents of their intention to examine the vehicle.<\/p>\n
The agents did not consent to the download of the vehicle\u2019s data, he said.<\/p>\n
Investigators then began preparing a search warrant.<\/p>\n
But before the vehicle was secured, the agent drove away in the Jeep.<\/p>\n
The sworn affidavit provides additional information about what happened after the Jeep left the shopping center.<\/p>\n
According to the document, federal agents drove the vehicle back to an ICE office before local investigators had an opportunity to examine the SUV.<\/p>\n
A Harris County Sheriff\u2019s Office captain subsequently contacted the ICE field director about the vehicle.<\/p>\n
The affidavit states the captain was told the Jeep would remain at the federal office behind a secured, locked gate.<\/p>\n
The vehicle\u2019s removal became a major point of disagreement between federal authorities and the Harris County District Attorney\u2019s Office.<\/p>\n
During his interview with KPRC 2, Teare said he had never encountered a comparable situation in his 20 years of law enforcement experience.<\/p>\n
He also expressed concern that driving the Jeep after the collision might have affected electronic evidence investigators hoped to recover.<\/p>\n
Asked whether the information might have been lost, Teare said he believed that was likely.<\/p>\n
The court documents do not establish whether any specific electronic data was permanently erased.<\/p>\n
Teare has publicly criticized ICE\u2019s handling of the Jeep.<\/p>\n
\u201cICE was never cooperating,\u201d he said during an earlier KPRC 2 interview.<\/p>\n
Teare said the agency answered some questions, but its cooperation ended when federal agents removed a critical piece of evidence over the objections of other law enforcement agencies.<\/p>\n
He also said local authorities had identified the driver and other ICE agents involved in the incident.<\/p>\n
At the time, Teare declined to release identifying information about the agent while prosecutors evaluated the evidence and considered whether charges were appropriate.<\/p>\n
The district attorney\u2019s concerns about access to the Jeep are now reflected in the court records obtained by KPRC 2.<\/p>\n
The search warrant was forwarded to the Department of Homeland Security.<\/p>\n
According to the court documents, DHS acknowledged receiving the warrant and indicated that the matter would be referred to its legal team.<\/p>\n
But a return filed with the court on Oct. 23 indicates the search had not taken place.<\/p>\n
The document states:<\/p>\n
\u201cAccess to 2025 Jeep Grand Cherokee has not been provided \u2014 no search of vehicle.\u201d<\/p>\n
The filing establishes that investigators had not been given access to the SUV as of Oct. 23, despite obtaining judicial authorization for the search.<\/p>\n
KPRC 2 News is seeking an updated response from federal authorities about whether access has since been provided, whether the Jeep has been examined and whether any electronic crash data has been preserved.<\/p>\n
The collision left Parra-Hernandez with multiple fractures to his right leg and an ankle injury, according to information previously shared with KPRC 2.<\/p>\n
His family reported that he required medical treatment and surgery following the incident.<\/p>\n
During an Oct. 13 news conference, relatives and advocates also raised concerns about his continued detention by ICE while receiving treatment.<\/p>\n
His brother, Rodolfo Parra, described the family\u2019s distress over the injuries and the circumstances surrounding his brother\u2019s detention.<\/p>\n
The family and advocates also challenged the suggestion that Parra-Hernandez was connected to the person federal agents were seeking.<\/p>\n
During the news conference, an advocate said Parra-Hernandez did not recognize the individual ICE had identified as the target of its operation.<\/p>\n
The advocate said Parra-Hernandez had been picking up workers that morning.<\/p>\n
Those statements reflect the family\u2019s and advocates\u2019 accounts. The search warrant establishes the name of the person the agent said he was pursuing, but does not establish that Parra-Hernandez was that person.<\/p>\n
The search warrant identifies possible offenses under investigation, including aggravated assault with a deadly weapon, aggravated assault causing serious bodily injury and reckless driving.<\/p>\n
The offenses listed in a search warrant identify potential violations investigators are examining. Their inclusion does not mean prosecutors have determined that a crime occurred.<\/p>\n
No criminal charges have been announced against the ICE agent.<\/p>\n
The district attorney\u2019s office has previously said investigators were gathering surveillance footage, witness accounts and physical evidence before making a charging decision.<\/p>\n
The unanswered questions now include whether investigators have obtained the Jeep, whether relevant vehicle data remains available and whether the evidence supports criminal charges.<\/p>\n
KPRC 2 News continues to seek answers from ICE, the Department of Homeland Security and the Harris County District Attorney\u2019s Office about the status of the investigation.<\/p>\n
