{"id":63428,"date":"2025-11-24T22:11:07","date_gmt":"2025-11-24T22:11:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/63428\/"},"modified":"2025-11-24T22:11:07","modified_gmt":"2025-11-24T22:11:07","slug":"texas-ag-ken-paxton-sues-a-second-state-agency-over-rules-he-says-discriminate-on-religious-grounds","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/63428\/","title":{"rendered":"Texas AG Ken Paxton sues a second state agency over rules he says discriminate on religious grounds"},"content":{"rendered":"<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Attorney General <a href=\"https:\/\/directory.texastribune.org\/ken-paxton\/\" rel=\"nofollow noopener\" target=\"_blank\">Ken Paxton<\/a> is suing the Texas Department of Housing and Community Development, his second lawsuit in as many weeks that targets a state agency for practices he says discriminate against religious groups. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Organizations that receive state funds to help homeless people or support housing programs through the department are not permitted to engage in religious activities within those programs. Paxton argues this rule is unconstitutional and forces religious organizations to alter or abandon core elements of their faith.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">\u201cState agencies have no authority to force Christians and other religious organizations to censor their beliefs just to serve their communities,\u201d Paxton said in a <a href=\"https:\/\/www.texasattorneygeneral.gov\/news\/releases\/attorney-general-ken-paxton-sues-state-housing-agency-discriminating-against-christian-groups-and\" rel=\"nofollow noopener\" target=\"_blank\">news release.<\/a> \u201cConstitutionally protected religious liberty must be upheld in Texas and across the country. These TDHCA\u2019s provisions within certain programs, which deter funding from going towards churches and religious organizations, must be struck down.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The housing department did not respond to a request for comment on the lawsuit.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Most of the affordable housing projects in Texas go through the <a href=\"https:\/\/www.tdhca.texas.gov\/about\" rel=\"nofollow noopener\" target=\"_blank\">Texas Department of Housing and Community Development<\/a>. The agency also doles out state and federal funding to combat homelessness.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Some of the state agency\u2019s programs include: the Emergency Solutions Grants Program; the Homeless Housing and Services Program; the Ending Homelessness Fund; the HOME American Rescue Plan; and the Housing Stability Services Program.<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Paxton highlighted these and the Bootstrap Loan Program in his <a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/press\/Paxton%20v%20TDHCA%20Petition.pdf?utm_content=&amp;utm_medium=email&amp;utm_name=&amp;utm_source=govdelivery&amp;utm_term=\" rel=\"nofollow noopener\" target=\"_blank\">lawsuit<\/a> because the rules say none of the money can \u201cbe used for sectarian or explicitly religious activities such as worship, religious instruction or proselytization.\u201d<\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">The lawsuit does not provide examples of where religious organizations were barred from receiving these dollars, nor does it name someone who was harmed by this rule. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Last week, Paxton filed a <a href=\"https:\/\/www.texastribune.org\/2025\/11\/14\/texas-attorney-general-paxton-lawsuit-higher-education-coordinating-board\/\" rel=\"nofollow noopener\" target=\"_blank\">lawsuit<\/a> against Texas Higher Education Coordinating Board to put an end to three university work-study programs that he says unconstitutionally discriminate against religious students. <\/p>\n<p class=\"dist__Box-sc-1fnzlkn-0 dist__TextBase-sc-1fnzlkn-3 bYFsJw cuqaEv article-text\">Paxton \u2014 who is <a href=\"https:\/\/www.texastribune.org\/2025\/10\/15\/texas-senate-campaign-fundraising-gop-primary-cornyn-paxton-hunt\/\" rel=\"nofollow noopener\" target=\"_blank\">running to unseat <\/a>U.S. Sen. <a href=\"https:\/\/directory.texastribune.org\/john-cornyn\/\" rel=\"nofollow noopener\" target=\"_blank\">John Cornyn<\/a> \u2014 said he is going to strike down any Texas provisions that \u201cundermine religious liberty\u201d and affect funding opportunities based on religious views.<\/p>\n","protected":false},"excerpt":{"rendered":"Attorney General Ken Paxton is suing the Texas Department of Housing and Community Development, his second lawsuit in&hellip;\n","protected":false},"author":2,"featured_media":63429,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[6],"tags":[132,3309,1967,287,27,29,293,28,6748],"class_list":{"0":"post-63428","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-texas","8":"tag-austin","9":"tag-john-cornyn","10":"tag-ken-paxton","11":"tag-politics","12":"tag-texas","13":"tag-texas-headlines","14":"tag-texas-legislature","15":"tag-texas-news","16":"tag-well-b-homepage"},"_links":{"self":[{"href":"https:\/\/www.newsbeep.com\/us-tx\/wp-json\/wp\/v2\/posts\/63428","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.newsbeep.com\/us-tx\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.newsbeep.com\/us-tx\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-tx\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-tx\/wp-json\/wp\/v2\/comments?post=63428"}],"version-history":[{"count":0,"href":"https:\/\/www.newsbeep.com\/us-tx\/wp-json\/wp\/v2\/posts\/63428\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-tx\/wp-json\/wp\/v2\/media\/63429"}],"wp:attachment":[{"href":"https:\/\/www.newsbeep.com\/us-tx\/wp-json\/wp\/v2\/media?parent=63428"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-tx\/wp-json\/wp\/v2\/categories?post=63428"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.newsbeep.com\/us-tx\/wp-json\/wp\/v2\/tags?post=63428"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
