{"id":91337,"date":"2025-12-17T12:47:20","date_gmt":"2025-12-17T12:47:20","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/91337\/"},"modified":"2025-12-17T12:47:20","modified_gmt":"2025-12-17T12:47:20","slug":"meurer-fires-back-in-filing-claims-corley-has-no-right-to-seek-writ-of-quo-warranto-and-case-cannot-be-heard","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/91337\/","title":{"rendered":"Meurer fires back in filing \u2013 claims Corley has no right to seek \u2018writ of quo warranto\u2019 and case cannot be heard"},"content":{"rendered":"<p>Mark Meurer, the newly sworn county commissioner for Precinct 2, on Tuesday asked a judge to throw out Jason Corley\u2019s effort to get his seat back.<\/p>\n<p>On December 8, County Judge Curtis Parrish declared Corley resigned his seat moments before a County Commissioners meeting. Parrish then administered the oath of office to Meurer.<\/p>\n<p>Parrish claims Corley resigned<\/p>\n<p>Parrish said Corley lost his seat in mid-November by making himself a candidate \u201cin fact\u201d for the Congressional seat soon to be vacated by Jodey Arrington. Most Texas office holders automatically resign if they announce for another office with more than one year and 30 days left in their terms.<\/p>\n<p>Corley announced an exploratory committee for District 19 via email. The email included \u201cCorley for Congress\u201d logos and a \u201cCorley for Congress\u201d email. Corley claimed those elements were left over from his 2016 campaign. Parrish claimed they count as an announcement. Corley claims Parrish misunderstood and misapplied the law.<\/p>\n<p><a href=\"https:\/\/lubbocklights.com\/category\/news\/precinct-2-legal-battle\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Click here to see<\/a> our previous stories.<\/p>\n<p>Corley said he was escorted out of the courthouse by sheriff\u2019s deputies. Corley filed a lawsuit that same day to get his seat back. A visiting judge, Patrick Pirtle, took the case and scheduled a December 19 hearing.<\/p>\n<p>The specific type of lawsuit matters. It\u2019s called a quo warranto. In Meurer\u2019s filing, his central argument is Corley has no right to file this kind of lawsuit in the first place.<\/p>\n<p>\u201cOnly the Texas Attorney General or the county or district attorney \u2026 can seek a writ of quo warranto. Therefore, all of Corley\u2019s pleaded causes of action against Meurer fail,\u201d Meurer\u2019s attorney, Kristen Vander-Plas Lafreniere, wrote.<\/p>\n<p>Meurer did not respond to an invitation to comment and his attorney said she would allow the legal filing to speak for itself.<\/p>\n<p><a href=\"https:\/\/lubbocklights.com\/wp-content\/uploads\/2025\/12\/corley_vs_meurer_plea_jurisdiciton.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Click here to read a copy of the filing.<\/a> <\/p>\n<p>It\u2019s not optional according to Meurer\u2019s legal document. If Corley has no right to file the request then the judge has no power to even consider it.<\/p>\n<p>\u201cThis court lacks jurisdiction to entertain Mr. Corley\u2019s claims. \u2026 each of Mr. Corley\u2019s claims \u2026 must be dismissed with prejudice,\u201d Meurer\u2019s request said.<\/p>\n<p>\u201cWhere, as here, no amount of repleading will bring a plaintiff\u2019s claims within the jurisdiction of the Court, a dismissal with prejudice is required. \u2026 Individual citizens simply lack standing to challenge the authority of individuals to hold office,\u201d Meurer\u2019s request said.<\/p>\n<p>Corley, represented by attorney Ben Garcia, disagreed.<\/p>\n<p>\u201cWe do in fact have the right,\u201d Corley said to LubbockLights.com late Tuesday by phone.<\/p>\n<p>\u201cThe district attorney may file one [a quo warranto]. It also says, I believe, the AG may as well. It doesn\u2019t say that they\u2019re the only ones,\u201d he said of state law.<\/p>\n<p>A 2025 <a href=\"https:\/\/www.texasattorneygeneral.gov\/sites\/default\/files\/images\/press\/Quo%20Warranto%20SCOTX%20Filed.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">petition to the Texas Supreme Court<\/a> by Attorney General Ken Paxton (related to the walkout of Democrats during the most recent legislative session) said, \u201cA quo warranto proceeding can only be brought by the attorney general, a county attorney, or a district attorney.\u201d<\/p>\n<p>If Pirtle agrees with Meurer, that might not be the end of the matter.<\/p>\n<p>Pirtle issued an order Monday allowing Lubbock County District Attorney Sunshine Stanek to remove her office from the case. Taking her place will be Potter County Attorney Scott Brumley.<\/p>\n<p>State law allows Brumley to take up the matter \u201cat the request of an individual.\u201d<\/p>\n<p>As of Tuesday evening, Brumley had not filed anything in the case.
