{"id":91805,"date":"2025-12-17T20:26:16","date_gmt":"2025-12-17T20:26:16","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-tx\/91805\/"},"modified":"2025-12-17T20:26:16","modified_gmt":"2025-12-17T20:26:16","slug":"why-is-texas-outsourcing-its-government-tocanada","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-tx\/91805\/","title":{"rendered":"Why is Texas Outsourcing its Government to\u2026Canada?"},"content":{"rendered":"\n<p style=\"font-weight:400\">Anyone who\u2019s met a Texan knows how proud they are of their state. Some of them even prefer the term \u201cthe Free State of Texas.\u201d That\u2019s why it\u2019s so puzzling that Texas lawmakers would turn to foreign governments\u2014including Australia and Canada\u2014rather than the United States, when it comes to regulating food safety.<\/p>\n<p style=\"font-weight:400\">They did so in an obscure provision of a long and complicated law known as <a href=\"https:\/\/legiscan.com\/TX\/text\/SB25\/id\/3247967\" rel=\"nofollow noopener\" target=\"_blank\">SB 25<\/a>, which went into effect in September. Section 9 of that law is now being challenged in a federal lawsuit by the American Beverage Association. It requires soda makers and other companies to post warning labels on their products stating that they contain \u201can ingredient that is not recommended for human consumption by the appropriate authority in Australia, Canada, the European Union, or the United Kingdom\u201d\u2014even though the chemicals in question are deemed safe by the United States Food and Drug Administration.<\/p>\n<p style=\"font-weight:400\">That doesn\u2019t just interfere with federal food safety regulation (a no-no, given that federal law takes precedence over state law), but, as we explain in <a href=\"https:\/\/www.goldwaterinstitute.org\/wp-content\/uploads\/2025\/12\/9-1-GI-ACBrief.pdf\" rel=\"nofollow noopener\" target=\"_blank\">a brief<\/a> we filed yesterday in support of the Beverage Association, it also violates the First Amendment, which forbids the government from forcing people or businesses to say things they don\u2019t want to say. And although under a Supreme Court decision called <a href=\"https:\/\/en.wikipedia.org\/wiki\/Zauderer_v._Office_of_Disciplinary_Counsel_of_Supreme_Court_of_Ohio\" rel=\"nofollow noopener\" target=\"_blank\">Zauderer<\/a>, companies can be required to post warning labels in order to ensure that consumers aren\u2019t confused or misled, the Supreme Court has made clear that the Zauderer rule doesn\u2019t mean government can exploit warning labels to simply manipulate people\u2019s behavior.<\/p>\n<p style=\"font-weight:400\">States have tried to abuse the warning-label rule before\u2014especially California. Just a few years ago, San Francisco lawmakers passed a rule forcing soda companies to add a warning to their advertisements that drinking sugary cola can be bad for your health. But the same requirement was not imposed on companies selling sugary fruit drinks, even though these can be just as bad for your health. The Ninth Circuit <a href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/ca9\/16-16072\/16-16072-2017-09-19.html\" rel=\"nofollow noopener\" target=\"_blank\">struck down <\/a>that requirement on the grounds that the federal government is responsible for regulating such things, and cities can\u2019t interfere. But as the late Judge Sandra Ikuta noted, the requirement was also invalid because it forced soda companies to say something that just isn\u2019t true. \u201cThe message that drinking sugar-sweetened beverages \u2018contributes to\u2019 diabetes,\u201d she wrote, \u201cis devoid of scientific support\u2026.\u00a0 Insisting that compelled speech be purely factual may seem persnickety, but there are significant constitutional implications whenever the government seeks to control our speech. There are also societal consequences to inaccurate government-mandated messages.\u201d<\/p>\n<p style=\"font-weight:400\">The Beverage Association points out that, as with the San Francisco case, Texas\u2019s Section 9 interferes with federal power and violates the free speech rights of companies. It\u2019s certainly strange that Lone Star State legislators would prefer to obey the rulings of Canadian or European Union regulators than to heed American officials when it comes to food safety.
