LUBBOCK, Texas (KCBD) – A Lubbock man has filed a lawsuit against Jason Corley and a fertilizer company, claiming Corley was driving in a distracted and negligent manner and crashed into the man\u2019s vehicle, injuring him.<\/p>\n
Bryan Hernandez filed the suit in the 72nd State District Court against Corley and Magline, Inc, a company based in Plainview. Corley told KCBD he believes the lawsuit is frivolous and believes the truth will come out in court.<\/p>\n
Corley has served as Lubbock County Commissioner for Precinct 2 since 2019. Last week, County Judge Curtis Parrish removed Corley from office, accusing Corley of automatically ceding his seat by becoming a candidate for the U.S. House of Representatives. Corley called Parrish\u2019s move a \u201ccorrupt power play\u201d and filed suit seeking re-instatement. A hearing is scheduled Friday, Dec. 19 in the matter.<\/p>\n
Hernandez\u2019 suit claims in October, Corley was driving a vehicle owned by Magline on east FM 1585 in Lubbock County when he slammed into Hernandez\u2019 vehicle.<\/p>\n
The suit alleges Corley did not maintain \u201ca proper lookout for Plaintiff\u2019s safety\u201d, was speeding, did not brake in time and \u201cfailed to take proper evasive action\u201d.<\/p>\n
Since it is campaign season and, noting the actions above on the commissioners court, KCBD contacted Hernandez\u2019 attorney regarding the timing of the filing. Attorney Kevin Kornegay said Hernandez was seriously injured and, despite his injuries, the insurance company \u201chas refused to be fair and help our client\u201d.<\/p>\n
\u201cWhen an insurance company refuses to do the right thing, the only option left is to file suit and ask a jury to help by providing justice, and by sending a message to keep our community safe. That is what we have done here,\u201d Kornegay wrote in a statement.<\/p>\n
Hernandez\u2019 suit seeks between $250,000 and $1 million.<\/p>\n
