BELLEVUE, Neb. (WOWT) – A grand jury found no reason to indict officers involved in an incident with a man reportedly found naked in a stranger’s backyard pool last summer.
According to police reports, the homeowner called police after finding a drunken man in their pool, telling 911 dispatchers that he then tried to enter the home.
Police said they found the suspect, later identified as Justin Lieffers, 43, of Bellevue, and that he tried to flee from officers. He was caught, but resisted arrest and had to be subdued, according to officer reports.
After being handcuffed, Lieffers became unresponsive and stopped breathing, according to BPD. Officers performed lifesaving measures until EMTs arrived at the scene.
He was then taken to Nebraska Medical Center, where he was pronounced dead.
Nebraska law dictates that a grand jury review all in-custody deaths and determine whether any charges are warranted. They are also allowed to recommend changes to policy or procedure, but did not do so in this case, according to Wednesday’s news release from Sarpy County officials.
“The grand jury in this case received all evidence gathered by the multi-jurisdiction Sarpy County Force Investigation Team, led by a Sarpy County Sheriff’s Captain,“ the release states.
