GREEN BAY (WLUK) — A Brown County court hearing Friday tied to a restraining order filed against former radio host Otis Day and a Marion woman lasted about three hours, with Day being the only witness to testify.

Natalie Jansen, a competing morning radio host at WIXX, filed the restraining order against the pair earlier this year. Jansen was not called to the stand during the hearing, which did not conclude and is scheduled to resume July 17.

Her attorney, Mark McGinnis, said, “You’re going to hear Ms. Jansen testify about the change in her life that this had, the impact. But more important than that, because they’re going to say, ‘Oh, she’s just an oversensitive person and she shouldn’t have taken it so seriously.’ You’re going to hear, her radio station was concerned enough that they took action.”

Day, whose legal name is Richard Dey, answered questions from Jansen’s attorney as both sides continue to examine allegations connected to Jansen’s online harassment claims. At times, the exchanges between Day and McGinnis were heated. There was not enough time Friday for Day’s attorney to question him.

During testimony, Day admitted he initially lied to investigators about knowing or communicating with Emily Chagnon. When questioned, he said he never told Chagnon to stop the harassment, but added, “I’m a wimp. I don’t know. I wish I would have. I mean, I really do.”

Chagnon’s Facebook group is at the center of the online bullying allegations. Day denied personally harassing anyone or coaching or encouraging Chagnon to criticize Jansen.

Day testified he initially enjoyed following the online criticism of his former employer, Midwest Communications. He believed the criticism, allegedly posted by Chagnon — which included mentions and pictures of Jansen’s child — was out of line, but he admitted he did nothing to stop it.

A sergeant who began testifying during a hearing last month was not available Friday, but will be asked to finish testifying at the next hearing scheduled for July 17.

A temporary restraining order is currently in place, but at the request of Day’s attorney, the judge loosened the order for two days this weekend. That allows Day an opportunity to work at Celebrate De Pere without fear of violating the order if Jansen is at the event, too.

Day has been at the center of public attention since FOX 11 reported he was no longer with 95.9 KISS-FM while facing the restraining order proceedings filed by Jansen.
