SOUTHAVEN, Miss. – Elon Musk’s SpacexAI is offering to buy Southaven residents’ homes, so long as they agree not to join a class action lawsuit that’s been filed against the company.
MZX Tech LLC, a subsidiary of SpacexAI, distributed notices to homeowners in the area of the Southaven plant; in the notice, the company offers to purchase their homes “in exchange for, among other things, a release of all claims related to a lawsuit….”
The lawsuit referenced in the notice was filed earlier in 2026 by three people who live in the area and makes five claims against the company:
In the letter, the company said that the residents argue that the company “knew or should have known” that the plant would be excessively noisy to the point of being disturbing to residents and that the company’s attempts to mitigate the noise have been insufficient.
The letter is specific to people who live within a boundary—Nail Road to the south, Highway 51 to the east, Stateline Road West to the north, and about 1 mile west of Horn Lake Road.
FOX13 spoke to neighbors who are within those streets. “If they wanted to send me one, I would sell in a heartbeat,” said Tanya Bardonner.
“MZX denies all of the allegations against it,” the letter reads. “However, because MZX also requires property for its business purposes, MZX, through its real estate broker, is offering to purchase real estate in Southaven in exchange for, among other things, a release of all claims related to the lawsuit.”
For people who do sell their home, the letter states, “After executing the Release Agreement, you will be unable to recover any damages or other relief from the Haley lawsuit, and you will also be unable to ring claims on your own behalf.”
“This is money now for finality. Now, you cannot change your mind and come back later and say that you were injured or harmed,” said attorney Mike Working.
Working is not associated with this case, but he said the conclusion of a lawsuit like this could take years.
“If they believe that their home is being affected and there’s this loud nuisance of, you know, these huge gas turbines that sound like a factory that are devaluing their home, there may be a motivation to just take the money now and leave,” said Working.
The letter does tell residents that they are free to turn the offer down and provides them with links to the lawsuit itself as well as contact information for the lawyers representing the residents who initially filed the suit.
