FRESNO, Calif. (KFSN) — An ICE agent is in custody at a local hospital after police say he was shot after assaulting an elderly man and his daughter at a home in central Fresno.

The incident happened before 3:30 am Friday at a home on Dudley and Broadway.

The Fresno Police Department says a woman found 32-year-old David Gonzalez sleeping on her front lawn.

The woman alerted her 72-year-old father, who then went outside to tell Gonzalez to leave.

Once Gonzalez was woken up, police say he appeared drunk and assaulted the 72-year-old.

Police say the daughter tried to intervene to protect her father, and Gonzalez physically attacked her.

Fearing for their safety, officers say the 72-year-old man pulled out a gun and shot Gonzalez.

The woman’s boyfriend, who is a police officer and was off-duty, came to the home and put Gonzalez in handcuffs.

He was taken to the hospital for treatment and is listed in serious condition.

“They were nice, nice people. They’ve been here at that house well over 20 years. We’ve been here about 21 years. They’ve been here before we were,” neighbor Kimberly Lindsay describing the victims.

Gonzalez is now in Fresno Police custody for felony assault. Officers say he is a federal agent from Texas who is assigned to Immigration and Customs Enforcement.

The man who shot Gonzalez is not facing charges and police say he legally owned the gun used in the shooting.

Action News was there when detectives recovered a handgun from the porch of the home, bagging it and taking it away for processing.

Police are still investigating why he was in the neighborhood where he was ultimately shot. The incident comes amid recent reports on an increased presence by ICE in Fresno and other parts of the Central Valley.

Fresno City Councilmember Mike Karbassi released a statement on the incident, saying in part, “Enough is enough. We’ve endured days of fear-stricken enforcement that has now tilted into full-bore violence. I am calling on ICE to suspend its ongoing operations in the Central Valley.”

Conflicting reports on Fresno Police and ICE confrontation

Action News is aware of conflicting reports of an alleged interaction between Fresno Police and ICE after the shooting.

Fresno City Councilmember Miguel Arias and another local elected official, who asked to remain anonymous, claim ICE requested Fresno Police release Gonzalez into their custody from the hospital.

“It’s unprecedented behavior. It’s completely out of norm,” Arias said. “It’s in violation of state, local, and federal jurisdictional rules and it’s quite concerning to us.”

Fresno Police firmly denied those claims.

In a statement to Action News, Chief Mindy Casto said “No such request was made. His supervisors are aware that he will stay in our custody.”

The Fresno Police Department also later sent out a news release explaining there was no confrontation between the department and ICE. It says ICE officials have been in contact with Fresno Police to begin their personnel investigation, and the suspect remains in Fresno Police Custody.
