An appeals court in New York has thrown out a civil fraud penalty that would have cost United States President Donald Trump and his business associates nearly half a billion dollars, calling the fine \u201cexcessive\u201d.<\/p>\n

On Thursday, a five-judge panel in New York\u2019s Appellate Division rendered its decision after weighing Trump\u2019s appeal for nearly 11 months.<\/p>\n

In its ruling, the panel cited the Eighth Amendment of the US Constitution, which prohibits the government from levying unduly harsh penalties on its citizens.<\/p>\n

The case stems from a civil suit brought by New York Attorney General Letitia James, who argued that Trump had inflated his financial records in order to secure advantages with insurance companies, banks and other financial institutions.<\/p>\n

In February 2024, a lower court had ordered Trump to pay $355m in penalties, an amount the appeals court called into question. That amount has since grown to about $515m due to accumulating interest.<\/p>\n

\u201cWhile the injunctive relief ordered by the court is well crafted to curb defendants\u2019 business culture, the court\u2019s disgorgement order, which directs that defendants pay nearly half a billion dollars to the State of New York, is an excessive fine that violates the Eighth Amendment of the United States Constitution,\u201d two of the panel\u2019s judges, Dianne T Renwick and Peter H Moulton, wrote in one opinion.<\/p>\n

Trump quickly applauded the decision on his social media platform, Truth Social.<\/p>\n

\u201cTOTAL VICTORY in the FAKE New York State Attorney General Letitia James Case! I greatly respect the fact that the Court had the Courage to throw out this unlawful and disgraceful Decision that was hurting Business all throughout New York State,\u201d he wrote<\/a>.<\/p>\n

While the court did dismiss the penalty in its entirety, its judges were divided over the merits of the lower court\u2019s ruling, which found that Trump and his co-defendants had misrepresented their wealth in \u201cfraudulent ways\u201d.<\/p>\n

One Republican-appointed judge on the panel, David Friedman, accused James of seeking the \u201cderailment of President Trump\u2019s political career and the destruction of his real estate business\u201d.<\/p>\n

But while the court was unanimous in its decision to toss the penalty, it issued no majority decision and instead offered an array of opinions on the matter.<\/p>\n

The panel also left open the possibility of an appeal. James\u2019s office quickly sent out a statement<\/a> saying it intended to do so.<\/p>\n

\u201cIt should not be lost to history: yet another court has ruled that the president violated the law, and that our case has merit,\u201d the statement said. \u201cWe will seek appeal to the Court of Appeals and continue to protect the rights and interests of New Yorkers.\u201d<\/p>\n

The judge who issued that initial decision<\/a>, Arthur Engoron, a Democrat, explained that \u201cthe frauds found here leap off the page and shock the conscience\u201d.<\/p>\n

In his 92-page decision, Engoron expressed particular frustration over Trump\u2019s refusal to answer questions before the court and his refusal to acknowledge the misrepresentations in his financial documents.<\/p>\n

\u201cTheir complete lack of contrition and remorse borders on pathological. They are accused only of inflating asset values to make more money. The documents prove this over and over again. This is a venial sin, not a mortal sin,\u201d Engoron wrote.<\/p>\n

\u201cDonald Trump is not Bernard Madoff. Yet, defendants are incapable of admitting the error of their ways.\u201d<\/p>\n

Trump and his co-defendants \u2014 who include his sons Eric Trump and Donald Trump Jr, as well as other Trump Organization leaders \u2014 were dealt a combined financial penalty that currently totals about $527m, including interest.<\/p>\n

While Engoron\u2019s ruling left the Trump Organization intact, it did bar Eric Trump and Donald Trump Jr from serving in executive roles for two years.<\/p>\n

Trump, meanwhile, did not have an official role in the organisation at the time. He was in the middle of his 2024 campaign for re-election, and he criticised<\/a> the fraud case as \u201celection interference\u201d, a theme he revisited on Thursday.<\/p>\n

This was a Case of Election Interference by the City and State trying to show, illegally, that I did things that were wrong when, in fact, everything I did was absolutely CORRECT and, even, PERFECT,\u201d Trump wrote on Truth Social.<\/p>\n

Trump has repeatedly denied wrongdoing in the myriad legal cases he faced between his two terms as president, including the civil fraud suit.<\/p>\n

In 2023, for instance, a jury found Trump liable for sexual abuse and defamation in a case involving writer E Jean Carroll, who alleged the Republican leader raped her in a New York City department store, Bergdorf Goodman.<\/p>\n

The jury in that case awarded around $5m<\/a> to Carroll. A second defamation civil suit filed by Carroll resulted in an even bigger sum for damages: $83.3m<\/a>. Trump continues to appeal both decisions.<\/p>\n

During that period, Trump also faced four criminal indictments<\/a>, two on the state level and two on the federal level.<\/p>\n

The federal cases were dropped<\/a> in advance of Trump\u2019s second inauguration, but one of the state-level cases, also in New York, resulted in Trump<\/a> becoming the first US president to become a convicted felon. He was found guilty<\/a> in May 2024 on 34 counts of falsifying business records.<\/p>\n

He continues to appeal that case as well, and his legal team has pushed to move the case from the state court system to the federal level, where Trump would enjoy immunity as president.<\/p>\n

In recent weeks, the Trump administration has also ramped up pressure against James, the attorney general who brought the civil fraud case at the heart of Thursday\u2019s decision.<\/p>\n

On August 8, Trump\u2019s Justice Department reportedly issued a subpoena<\/a> against James, to force the Democrat to release records related to the civil fraud case and her investigation into the National Rifle Association (NRA).<\/p>\n

That subpoena comes on the heels of James\u2019s success in a civil suit against the NRA that alleged the advocacy group misspent millions of dollars in charitable funds. Last December, a jury imposed fines on two NRA\u2019s leaders as a result and required the organisation to reform its operations.<\/p>\n

Trump, however, has denounced James\u2019s lawsuits as politically motivated and even called her racist.<\/p>\n

His message continued by alleging that James switched tracks and ran for re-election in the attorney general position instead, where she could \u201chappily continue to \u2018GET TRUMP\u2019.\u201d<\/p>\n

On Thursday, he renewed his attacks on James, saying she was \u201ca Corrupt and Incompetent Attorney General who only brought this Case in order to hurt me politically. She is a Trump Deranged Lunatic!\u201d<\/p>\n

James, a former public defender and member of the New York City council, began her tenure as state attorney general in 2019, and she was re-elected to the post in 2022. She is the first woman and first Black person to hold her post in New York.<\/p>\n

Her first term as attorney general coincided with Trump\u2019s first term as president, and she quickly began to investigate the Trump Organization upon taking office.<\/p>\n

Trump, meanwhile, has pointed to statements she made on the campaign trail \u2014 calling him an \u201cembarrassment\u201d and \u201cillegitimate\u201d \u2014 as evidence of her alleged bias against him.<\/p>\n

James, however, has argued that she sought equal justice under the law.<\/p>\n

\u201cNo matter how rich, powerful or politically connected you are, everyone must play by the same rules. We have a responsibility to protect the integrity of the marketplace, and for years, Donald Trump engaged in deceptive business practices and tremendous fraud,\u201d she said in February 2024, after Judge Engoron\u2019s decision.<\/p>\n

Currently, the Justice Department under Trump is believed to be pursuing two investigations into James: one examining her lawsuits as attorney general and a second for alleged mortgage fraud.<\/p>\n

His administration has also levelled accusations of mortgage fraud against Democratic Senator Adam Schiff, who helped lead impeachment proceedings against Trump, and Federal Reserve Governor Lisa Cook<\/a>.<\/p>\n

A representative for James, Abbe Lowell, has called the Trump administration\u2019s probes an act of \u201cimproper political retribution\u201d and said the accusations lack \u201cany credible foundation\u201d.<\/p>\n
