Mike Dunleavy\u2019s administration in its battle with the federal government over management authority of subsistence fishing on a Southwest Alaska river. <\/p>\n<p class=\"c-paragraph\">A three-judge panel for the 9th Circuit Court of Appeals on Wednesday ruled that U.S. District Court Judge Sharon Gleason last year <a href=\"https:\/\/www.adn.com\/alaska-news\/rural-alaska\/2024\/03\/29\/judge-rules-in-favor-of-biden-administration-in-fight-with-alaska-over-rural-priority-for-subsistence-fishing-on-the-kuskokwim-river\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.adn.com\/alaska-news\/rural-alaska\/2024\/03\/29\/judge-rules-in-favor-of-biden-administration-in-fight-with-alaska-over-rural-priority-for-subsistence-fishing-on-the-kuskokwim-river\/\">correctly<\/a> ordered the state to stop interfering in the federal government\u2019s management of the rural subsistence priority on the Kuskokwim River, according to the 40-page <a href=\"https:\/\/www.documentcloud.org\/documents\/26069151-20250820-93-opinion\/?q=inconsistent&amp;mode=document#document\/p29\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.documentcloud.org\/documents\/26069151-20250820-93-opinion\/?q=inconsistent&amp;mode=document#document\/p29\">decision<\/a>. <\/p>\n<p class=\"c-paragraph\">Alaska Attorney General Treg Taylor on Thursday issued a statement indicating that the state would appeal the case to the U.S. Supreme Court. <\/p>\n<p class=\"c-paragraph\">The Alaska Federation of Natives, which had <a href=\"https:\/\/www.adn.com\/alaska-news\/2023\/10\/14\/alaska-federation-of-natives-joins-feds-in-case-against-state-over-subsistence-rights\/\" target=\"_blank\" rel=\"nofollow noopener\">joined<\/a> the case alongside the federal government and other Native groups and leaders, said the decision was a victory for rural subsistence rights. <\/p>\n<p class=\"c-paragraph\">A shortage of salmon on the river led to the <a href=\"https:\/\/www.adn.com\/alaska-news\/2023\/10\/14\/alaska-federation-of-natives-joins-feds-in-case-against-state-over-subsistence-rights\/\" target=\"_blank\" rel=\"nofollow noopener\">dispute<\/a> between the state and federal government over management of subsistence fishing as the river passes through the Yukon Delta National Wildlife Refuge, a 180-mile lower stretch of the waterway, past Bethel to the village of Aniak. <\/p>\n<p class=\"c-paragraph\">The federal government <a href=\"https:\/\/law.alaska.gov\/press\/releases\/2023\/090123-Kuskokwim.html\" target=\"_blank\" rel=\"nofollow noopener\">brought the case<\/a> in 2022, seeking to stop Alaska from interfering in its efforts to manage fishing in that area. Federal managers had <a href=\"https:\/\/www.adn.com\/alaska-news\/rural-alaska\/2021\/06\/25\/state-announces-kuskokwim-river-fishing-opening-that-feds-say-isnt-legitimate-prompting-confusion\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.adn.com\/alaska-news\/rural-alaska\/2021\/06\/25\/state-announces-kuskokwim-river-fishing-opening-that-feds-say-isnt-legitimate-prompting-confusion\/\">issued<\/a> emergency orders limiting gillnet fishing to only rural subsistence users for two years, but the state issued conflicting orders to allow fishing for all subsistence users, not just rural ones, the decision says. <\/p>\n<p class=\"c-paragraph\">The dispute was the latest flare-up between Alaska and the federal government over the rural subsistence priority. The two sides operate their own management regimes, sometimes for the same fish and wildlife populations as they migrate over state and federal lands, leading to what\u2019s called dual management. <\/p>\n<p class=\"c-paragraph\">The opinion was written by Judge Consuelo M. Callahan, an appointee of President George W. Bush, who was joined by Roopali H. Desai and Ana de Alba, appointees for former President Joe Biden. <\/p>\n<p class=\"c-paragraph\">[<a href=\"https:\/\/www.adn.com\/alaska-news\/2025\/08\/10\/aleut-regional-corporation-rejoins-alaska-federation-of-natives-after-receiving-apology\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.adn.com\/alaska-news\/2025\/08\/10\/aleut-regional-corporation-rejoins-alaska-federation-of-natives-after-receiving-apology\/\">Aleut regional corporation rejoins Alaska Federation of Natives after receiving apology<\/a>]<\/p>\n<p class=\"c-paragraph\">The decision seeks to strike a balance between major court rulings that raise questions over the reach of state and federal management on Alaska rivers. <\/p>\n<p class=\"c-paragraph\">The state <a href=\"https:\/\/law.alaska.gov\/press\/releases\/2023\/090123-Kuskokwim.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/law.alaska.gov\/press\/releases\/2023\/090123-Kuskokwim.html\">argues<\/a> in the case that the river is not \u201cpublic land\u201d and cannot be federally managed under the 1980 Alaska National Interest Lands Conservation Act. <\/p>\n<p class=\"c-paragraph\">The state contends that the courts should not follow the precedent established in the so-called Katie John cases that ended in 2014 and <a href=\"https:\/\/www.adn.com\/alaska-news\/article\/alaskas-bid-overturn-latest-ruling-katie-john-case-rejected-supreme-court\/2014\/03\/31\/\" target=\"_blank\" rel=\"nofollow noopener\">upheld<\/a> the federal subsistence priority on waters associated with federal lands. <\/p>\n<p class=\"c-paragraph\">Instead, the state argues that the 2019 U.S. Supreme Court decision in the Sturgeon II case should apply, when the top court <a href=\"https:\/\/www.adn.com\/outdoors-adventure\/2019\/03\/26\/supreme-court-backs-alaska-moose-hunter-over-park-service-in-broad-ruling-on-jurisdiction\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.adn.com\/outdoors-adventure\/2019\/03\/26\/supreme-court-backs-alaska-moose-hunter-over-park-service-in-broad-ruling-on-jurisdiction\/\">found<\/a> that Alaska\u2019s Nation River is not \u201cpublic land\u201d under the Alaska land conservation act. <\/p>\n<p class=\"c-paragraph\">The state\u2019s position in the case alarmed Alaska Native leaders who <a href=\"https:\/\/www.adn.com\/alaska-news\/2023\/10\/14\/alaska-federation-of-natives-joins-feds-in-case-against-state-over-subsistence-rights\/\" target=\"_blank\" rel=\"nofollow noopener\">argued<\/a> that it was an assault on a vital protection in rural Alaska, where many residents, usually Alaska Natives, must hunt and fish to fill their pantries. <\/p>\n<p class=\"c-paragraph\">The 9th Circuit panel acknowledges that \u201ctension\u201d exists between the Katie John and Sturgeon decisions, Callahan wrote. <\/p>\n<p class=\"c-paragraph\">But the decisions can be \u201creasonably harmonized,\u201d Callahan wrote. <\/p>\n<p class=\"c-paragraph\">Callahan said the Supreme Court had said in 2019 that the Katie John decisions were \u201cnot at issue\u201d in the Sturgeon case, which left the rural subsistence fishing priority intact on navigable waters in federal areas.<\/p>\n<p class=\"c-paragraph\">The state of Alaska at the time had argued that the Katie John precedents should not be disturbed, leading to the Supreme Court\u2019s statement, Callahan wrote. <\/p>\n<p class=\"c-paragraph\">But the state \u201cnow claims that the Katie John Trilogy was wrongly decided and has been overruled by Sturgeon II,\u201d he wrote. <\/p>\n<p class=\"c-paragraph\">\u201cAlaska\u2019s primary argument is that the Katie John Trilogy is clearly irreconcilable with Sturgeon II,\u201d he wrote. <\/p>\n<p class=\"c-paragraph\">But the panel \u201crejected\u201d the state\u2019s arguments and said the cases are not \u201cclearly irreconcilable,\u201d Callahan wrote.<\/p>\n<p class=\"c-paragraph\">The term \u201cpublic lands\u201d can have two different meanings within different titles in the 1980s Alaska land conservation act, the decision said. Title VIII, creating the subsistence priority in rural Alaska, applies a broad interpretation of the term, Callahan wrote. <\/p>\n<p class=\"c-paragraph\">Title VIII calls for an understanding of \u201cpublic lands\u201d that includes navigable waters where subsistence fishing has traditionally taken place. <\/p>\n<p class=\"c-paragraph\">Congress created a rural subsistence priority for fish on \u201cnavigable waters\u201d on federal lands under the Alaska land conservation act, and the Katie John decision upheld the priority, Callahan wrote. Congress also signaled its approval for that interpretation in appropriations acts, Callahan wrote. <\/p>\n<p class=\"c-paragraph\">Alaska Attorney General Taylor said in a statement that the appeals court recognized \u201cthat prior case law is inconsistent with the recent Supreme Court case.\u201d <\/p>\n<p class=\"c-paragraph\">But the appeals court \u201cwas unwilling to do the hard work of actually overturning its own case law and properly reconciling the meaning of \u2018public lands\u2019 in ANILCA,\u201d Taylor said. <\/p>\n<p class=\"c-paragraph\">\u201cThis continues the unworkable dual management approach to our fisheries to the detriment of sustainable management of our fisheries for all rural subsistence users,\u201d Taylor wrote. <\/p>\n<p class=\"c-paragraph\">\u201cThe fish don\u2019t adhere to borders, and our fisheries management shouldn\u2019t either,\u201d Taylor wrote. \u201cI am disappointed but not surprised.
