A bill to monitor data center electricity use was also culled.<\/p>\n<p>We\u2019re keeping a close eye on your elected officials in the California Legislature. <a href=\"https:\/\/newsletters.calmatters.org\/my-legislator\" rel=\"nofollow noopener\" target=\"_blank\">Sign up for beta access to My Legislator<\/a>, your weekly report on what your representatives said, voted on, introduced and more.<\/p>\n<p>A crackdown on predictive software that sets prices and can rip you off<a href=\"https:\/\/calmatters.org\/economy\/technology\/2025\/03\/artificial-intelligence-price-discrimination\/\" rel=\"nofollow noopener\" target=\"_blank\"> seemed to be brewing in the California Legislature earlier this year<\/a>, but today lawmakers eased up, voting to kill bills that would have kept software from <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260sb52\" rel=\"nofollow noopener\" target=\"_blank\">setting the price of apartment rentals<\/a> and <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260sb384\" rel=\"nofollow noopener\" target=\"_blank\">other goods and services<\/a>. Another bill, which <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260ab446\" rel=\"nofollow noopener\" target=\"_blank\">sought to bar the use of personal information to set prices<\/a>, was reined in to apply only to grocery stores.<\/p>\n<p>Lawmakers also killed a bill that aimed to protect electric utility customers from bearing higher costs associated with <a href=\"https:\/\/calmatters.org\/economy\/technology\/2025\/02\/data-center-crackdown-to-protect-california-electricity-rates\/\" rel=\"nofollow noopener\" target=\"_blank\">data center proliferation, which has been driven in part by energy-hungry artificial intelligence systems like ChatGPT<\/a>. The measure <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260ab222\" rel=\"nofollow noopener\" target=\"_blank\">would have required data centers to publicly disclose how much energy they use<\/a>.<\/p>\n<p>The author of the legislation, Democratic San Ramon Assemblymember Rebecca Bauer-Kahan, wrote in a statement she was disappointed to see the bill stall and that, without it becoming law, state regulators would be unable to \u201caccurately forecast demand in this rapidly growing sector, leaving California ratepayers to unfairly shoulder the costs.\u00a0<\/p>\n<p>Legislators also delayed to next year decisions on bills that would require independent <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260ab1405\" rel=\"nofollow noopener\" target=\"_blank\">AI auditors to register with the state<\/a> and mandate <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260sb833\" rel=\"nofollow noopener\" target=\"_blank\">human oversight of AI used at places deemed critical infrastructure<\/a>, like dams and wastewater systems.\u00a0<\/p>\n<p>The <a href=\"https:\/\/calmatters.org\/politics\/2025\/08\/high-speed-rail-fails-suspense-file\/\" rel=\"nofollow noopener\" target=\"_blank\">legislative cullings came with the completion of the secretive suspense file process<\/a> in the appropriations committees in both houses of the California Legislature, <a href=\"https:\/\/calmatters.org\/politics\/2025\/04\/california-lawmakers-killed-bills\/\" rel=\"nofollow noopener\" target=\"_blank\">during which the fiscal impact of bills is considered<\/a> before many are summarily killed without explanation. As part of that process, <a href=\"https:\/\/calmatters.org\/politics\/2025\/08\/high-speed-rail-fails-suspense-file\/\" rel=\"nofollow noopener\" target=\"_blank\">the fate of hundreds of bills were determined today<\/a>, including more than 30 related to how tech and AI can impact kids, workers, <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260ab489\" rel=\"nofollow noopener\" target=\"_blank\">patients<\/a> and society.<\/p>\n<p>A fair deal of tech regulation survived the suspense file, including a bill that would <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260ab325\" rel=\"nofollow noopener\" target=\"_blank\">outlaw pricing software algorithm use<\/a> in any contract, which will now advance to the Senate floor for a final vote. Some data center regulation also made it through the appropriations process, including an effort in the state Senate to limit the ability of utility companies to <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260sb57\" rel=\"nofollow noopener\" target=\"_blank\">pass on growing data center demand costs to ratepayers<\/a> and a bill that <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260ab93\" rel=\"nofollow noopener\" target=\"_blank\">requires data centers to report how much water they use<\/a>.\u00a0<\/p>\n<p>The Senate Appropriations Committee also voted to approve <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260sb53\" rel=\"nofollow noopener\" target=\"_blank\">a bill<\/a> that would require developers of advanced artificial intelligence models to assess the potential of catastrophic risk in their technology and give the public and employees an easy way to report to state authorities the existence of AI with the capacity to cause death, bodily injury, or damage to property.<\/p>\n<p>Just the right amount of news<\/p>\n<p>Just the right amount of news<\/p>\n<p>Get California\u2019s most essential headlines without feeling overwhelmed.<\/p>\n<p>Get California\u2019s most essential headlines without feeling overwhelmed.<\/p>\n<p><img loading=\"lazy\" data-recalc-dims=\"1\" decoding=\"async\" width=\"600\" height=\"600\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2025\/08\/1756519688_767_Asset-4.png\" alt=\"\" class=\"wp-image-308618\"  \/><\/p>\n<p>A trio of bills that seek to stop employers from using AI to <a href=\"https:\/\/calmatters.org\/economy\/technology\/2025\/08\/california-ai-employment-legislation\/\" rel=\"nofollow noopener\" target=\"_blank\">surveil workers or make decisions related to hiring, pay, or disciplinary actions<\/a> also made it through the appropriations process, though <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260sb7\" rel=\"nofollow noopener\" target=\"_blank\">one bill<\/a> was amended to eliminate an appeals process for workers when they think AI made a mistake.<\/p>\n<p>Amid growing evidence that <a href=\"https:\/\/calmatters.org\/economy\/technology\/2025\/04\/kids-should-avoid-ai-companion-bots-under-force-of-law-assessment-says\/\" rel=\"nofollow noopener\" target=\"_blank\">companion bots that mimic intimate human relationships<\/a> can exacerbate mental health problems, California lawmakers will vote on several bills in the next two weeks that seek to protect children from AI or harmful encounters online. Appropriations committees approved bills that <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260ab222\" rel=\"nofollow noopener\" target=\"_blank\">prohibit the design of companion bots and other systems for kids<\/a> and put in place a protocol for companion bots to follow <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260sb243\" rel=\"nofollow noopener\" target=\"_blank\">when the subject of suicide comes up<\/a>. <\/p>\n<p>Those developments <a href=\"https:\/\/www.nytimes.com\/2025\/08\/26\/technology\/chatgpt-openai-suicide.html\" rel=\"nofollow noopener\" target=\"_blank\">came days after the New York Times reported<\/a> that Adam Raine, a 16-year-old California boy, died by suicide. In a <a href=\"https:\/\/cdn.sanity.io\/files\/3tzzh18d\/production\/5802c13979a6056f86690687a629e771a07932ab.pdf\" rel=\"nofollow noopener\" target=\"_blank\">lawsuit<\/a> filed in a California Superior Court on Tuesday, his parents accused OpenAI\u2019s ChatGPT of acting as his suicide coach. Megan Garcia, mother of a Florida teen who took his life after forming an intimate relationship with a chatbot made by California-based <a href=\"http:\/\/character.ai\" rel=\"nofollow noopener\" target=\"_blank\">Character.ai<\/a>, <a href=\"https:\/\/calmatters.org\/economy\/technology\/2025\/04\/kids-should-avoid-ai-companion-bots-under-force-of-law-assessment-says\/\" rel=\"nofollow noopener\" target=\"_blank\">endorsed the suicide protocol bill earlier this year<\/a>. <\/p>\n<p>Prior to news of the death of Adam Raine, following <a href=\"https:\/\/www.reuters.com\/investigates\/special-report\/meta-ai-chatbot-guidelines\/\" rel=\"nofollow noopener\" target=\"_blank\">reports<\/a> of Meta\u2019s AI chatbots speaking to children  in harmful and inappropriate ways, the Attorney General of California and 43 other U.S. states sent a <a href=\"https:\/\/oag.ca.gov\/system\/files\/attachments\/press-docs\/AI%20Chatbot_FINAL%20%2844%29.pdf\" rel=\"nofollow noopener\" target=\"_blank\">letter<\/a> to top AI companies to warn them that they \u201cuse every facet of our authority to protect children from exploitation by predatory artificial intelligence products.\u201d<\/p>\n<p>Lawmakers also approved bills that seek to prevent <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260ab772\" rel=\"nofollow noopener\" target=\"_blank\">off-campus cyberbullying<\/a>, <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260ab621\" rel=\"nofollow noopener\" target=\"_blank\">deepfake pornography of minors<\/a>, and that require a <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260ab56\" rel=\"nofollow noopener\" target=\"_blank\">warning label for social media<\/a>, heeding a call for <a href=\"https:\/\/www.nytimes.com\/2024\/06\/17\/opinion\/social-media-health-warning.html\" rel=\"nofollow noopener\" target=\"_blank\">such labels by the previous Surgeon General of the United States, Vivek Murthy<\/a>. The labeling legislation was significantly watered down, with amendments reducing the size of the label, eliminating the ability of private citizens to sue over violations, and delaying the implementation of the rules.<\/p>\n<p>Also advanced today was a bill that seeks to better hold developers accountable for AI technology, preventing them from <a href=\"https:\/\/calmatters.digitaldemocracy.org\/bills\/ca_202520260ab316\" rel=\"nofollow noopener\" target=\"_blank\">blaming the AI itself for harming people as a defense in court<\/a>.<\/p>\n<p>The California Legislature has until Sept. 12 to decide whether these and many other bills should become law.
