Rights observers and war powers scholars have said the attacks appear illegal under US and international law and likened them to extrajudicial killings.<\/p>\n<p>Recommended Stories list of 3 itemsend of list<\/p>\n<p>The memo is the clearest picture yet of how the administration is seeking to justify such attacks and what its approach could portend.<\/p>\n<p>\u201cAlthough friendly foreign nations have made significant efforts to combat these organizations, suffering significant losses of life, these groups are now transnational and conduct ongoing attacks throughout the Western Hemisphere as organized cartels,\u201d the memo said, as reported by the AP.<\/p>\n<p>\u201cTherefore, the President determined these cartels are non-state armed groups, designated them as terrorist organizations, and determined that their actions constitute an armed attack against the United States,\u201d it added.<\/p>\n<p>The argument is an extension of the Trump administration\u2019s reframing of cartels as \u201cnarco-terrorists\u201d who seek to destabilise the US by pushing illegal drugs across its borders and not profit-driven criminal entities.<\/p>\n<p>The memo did not specify the groups in question although the Trump administration has <a href=\"https:\/\/www.aljazeera.com\/news\/2025\/2\/19\/us-declares-drug-cartels-criminal-gangs-global-terrorist-organisations\" rel=\"nofollow noopener\" target=\"_blank\">labelled<\/a> several Latin American cartels \u201cforeign terrorist organizations\u201d and has particularly focused on Venezuela\u2019s Tren de Aragua.<\/p>\n<p>Under the US Constitution, only Congress has the right to authorise the use of military force or declare war; however, presidents may take unilateral actions in some cases, particularly in matters of the country\u2019s immediate self-defence.<\/p>\n<p>There is currently no authorisation of use of military force from Congress (<a href=\"https:\/\/www.aljazeera.com\/news\/2023\/2\/10\/why-is-us-repeal-of-iraq-war-authorisation-still-relevent\" rel=\"nofollow noopener\" target=\"_blank\">AUMF<\/a>) that would even remotely apply to the strikes in the Caribbean.<\/p>\n<p>Because of that, members of Congress have come under increased pressure to assert the legislative branch\u2019s <a href=\"https:\/\/www.aljazeera.com\/news\/2025\/6\/19\/what-is-the-war-powers-act-and-can-it-stop-trump-from-attacking-iran\" rel=\"nofollow noopener\" target=\"_blank\">war powers authorities<\/a> to rein in Trump.
