The group alleges agencies are violating the Hatch Act by using \u201cexplicitly partisan messaging\u201d blaming Democrats for the shutdown.<\/p>\n<p>\u201cThe Trump administration is violating the Hatch Act with reckless abandon, using taxpayer dollars to plaster partisan screeds on every government homepage that they can get their hands on,\u201d Craig Holman, a government ethics expert with Public Citizen, said in a statement.<\/p>\n<p>The messaging in question began at the Department of Housing and Urban Development earlier this week. HUD <a href=\"https:\/\/federalnewsnetwork.com\/government-shutdown\/2025\/09\/hud-website-blames-looming-shutdown-on-radical-left\/\" target=\"_blank\" rel=\"noopener nofollow\">posted a message on its website Tuesday<\/a> stating that the \u201cRadical Left are going to shut down the government.\u201d<\/p>\n<p>]]><\/p>\n<p>HUD\u2019s website now states, \u201cThe Radical Left in Congress shut down the government.\u201d<\/p>\n<p>The Small Business Administration followed suit on Wednesday with a \u201cspecial message\u201d at the top of the SBA website stating that \u201cSenate Democrats\u201d voted to block a \u201cclean\u201d stopgap funding bill.<\/p>\n<p>Other agencies have since posted similar messages on their websites.<\/p>\n<p>Public Citizen\u2019s OSC <a href=\"https:\/\/www.citizen.org\/news\/seven-more-complaints-filed-for-trump-administration-hatch-act-violation\/\" target=\"_blank\" rel=\"noopener nofollow\">complaints<\/a> are against HUD, SBA, the Centers for Disease Control and Prevention, the Justice Department, the Food and Drug Administration, the Department of Health and Human Services, the Office of Management and Budget, the Agriculture Department and the White House.<\/p>\n<p>Multiple agencies have also sent internal messages to their workforces <a href=\"https:\/\/federalnewsnetwork.com\/government-shutdown\/2025\/09\/mass-email-tells-federal-employees-not-to-blame-trump-for-government-shutdown\/\" target=\"_blank\" rel=\"noopener nofollow\">blaming the shutdown on Democrats.<\/a> And furloughed staff at the Education Department say their out-of-office messages were updated without their doing <a href=\"https:\/\/federalnewsnetwork.com\/government-shutdown\/2025\/10\/those-were-not-my-words-out-of-office-message-automatically-updated-for-furloughed-education-dept-employees\/\" target=\"_blank\" rel=\"noopener nofollow\">to blame the shutdown on Senate Democrats.<\/a><\/p>\n<p>House Committee on Oversight and Government Reform Ranking Member Robert Garcia (D-Ca.) has also <a href=\"https:\/\/oversightdemocrats.house.gov\/sites\/evo-subsites\/democrats-oversight.house.gov\/files\/evo-media-document\/2025-10-02-garcia-to-osc-re-hatch-act-shutdown-agency-messages.pdf\" target=\"_blank\" rel=\"noopener nofollow\">called<\/a> on acting Special Counsel Jamieson Greer to have OSC investigate the messaging for violating the Hatch Act.<\/p>\n<p>The 1939 <a href=\"https:\/\/osc.gov\/Services\/pages\/hatchact.aspx\" target=\"_blank\" rel=\"noopener nofollow\">law<\/a> \u201climits certain political activities of federal employees, as well as some state, D.C., and local government employees who work in connection with federally funded programs.\u201d<\/p>\n<p>]]><\/p>\n<p>But HUD Secretary Scott Turner brushed aside those concerns in an interview with NewsNation on Wednesday night, telling host Chris Cuomo he\u2019s not worried \u201cat all\u201d about violating the Hatch Act.<\/p>\n<p>\u201cAnd this is not about propaganda, Chris, this is just about letting the American people know what\u2019s going on. But we really need to be talking about how this government shutdown impacts the American people,\u201d Turner said.<\/p>\n<p>OSC is an independent agency responsible for safeguarding the federal merit system, including investigating and prosecuting potential Hatch Act violations. Earlier this year, the Trump administration <a href=\"https:\/\/federalnewsnetwork.com\/people\/2025\/03\/fired-head-of-federal-watchdog-agency-says-hes-ending-his-legal-battle-over-his-removal-by-trump\/\" target=\"_blank\" rel=\"noopener nofollow\">ousted Hampton Dellinger,<\/a> the Senate-confirmed Special Counsel, prior to the end of his five-year term. OSC has been led by an acting leader ever since.<\/p>\n<p>Antideficiency allegations<\/p>\n<p>Meanwhile, the Democracy Defenders Fund took a different approach to the messaging. In an Oct. 2 <a href=\"https:\/\/fb1cd5ab-5a51-475c-87d1-10904a61146d.usrfiles.com\/ugd\/fb1cd5_50ce247360804e86b30d8b2c2ccd82c5.pdf\" target=\"_blank\" rel=\"noopener nofollow\">letter<\/a> to the Government Accountability Office, the nonprofit urged GAO to investigate whether the messaging violates the Antideficiency Act.<\/p>\n<p>The group\u2019s letter calls the messaging \u201cpublicity and propaganda.\u201d<\/p>\n<p>\u201cAs a result, any employee who has participated in publishing or directing the publication of these partisan political messages may have violated the Anti-Deficiency Act, which prevents the use of government resources for any reason in excess of a given appropriation,\u201d the Democracy Defenders Fund wrote to GAO.<\/p>\n<p>GAO <a href=\"https:\/\/www.gao.gov\/legal\/appropriations-law\/search\" target=\"_blank\" rel=\"noopener nofollow\">evaluates<\/a> compliance with appropriations law, including ruling on potential violations of the Antideficiency Act.
