{"id":206361,"date":"2025-10-07T06:08:10","date_gmt":"2025-10-07T06:08:10","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/206361\/"},"modified":"2025-10-07T06:08:10","modified_gmt":"2025-10-07T06:08:10","slug":"portland-accuses-federal-officers-of-violating-demonstrators-constitutional-rights","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/206361\/","title":{"rendered":"Portland accuses federal officers of violating demonstrators\u2019 constitutional rights"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2025\/10\/1759817290_463_XJXDHCDHPJCALPYUGBYIRBX5E4.JPEG\" alt=\"FILE: Enforcement officers at the U.S. Immigration and Customs Enforcement facility, Portland, Ore., Oct. 4, 2025.\" class=\"width_full\" style=\"aspect-ratio:4032 \/ 3024;width:100%\"\/><\/p>\n<p>FILE: Enforcement officers at the U.S. Immigration and Customs Enforcement facility, Portland, Ore., Oct. 4, 2025.<\/p>\n<p class=\"article-body__image-by color_dgray f_s_xxs m-none\">Eden McCall \/ OPB<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">Portland\u2019s top attorney lambasted the U.S. Department of Justice\u2019s Civil Rights Division Monday, in a letter accusing the department of turning a blind eye to federal officers\u2019 heavy-handed response to protests. <\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">\u201cWe appear to be witnessing the federal government engaging in unconstitutional uses of force in violation of the Fourth Amendment against otherwise peaceful demonstrators exercising their First Amendment rights,\u201d wrote City Attorney Robert Taylor. <\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">\u201cMany Portlanders and other Americans may have reason to be concerned that the Civil Rights Division will choose allegiance to a president who is \u2018untethered to the facts\u2019 instead of the rule of law and the Constitution,\u201d he continued.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">Taylor\u2019s letter is a response to a <a href=\"https:\/\/www.opb.org\/article\/2025\/10\/03\/trump-portland-oregon-ice-immigration-police-protest\/\" target=\"_blank\" rel=\"nofollow noopener\">DOJ investigation announced<\/a> Friday into the Portland Police Bureau and the city for its treatment of right-wing media figures at recent protests outside the city\u2019s U.S. Immigration and Customs Enforcement facility. In the letter announcing that investigation, U.S. civil rights attorneys accused the city of policing \u201cin a manner that may be based on viewpoint discrimination.\u201d Taylor used the same phrasing in his response. <\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">\u201cIt appears the federal government is engaging in prohibited viewpoint discrimination by targeting demonstrators based on the content of their speech, while favoring those with whom the federal government agrees,\u201d he wrote. <\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">As an example, Taylor noted that federal officials appear to be granting social media \u201cinfluencers\u201d who favor the Trump administration access to the ICE facility, while using force against others who use social media to document the actions of the federal officers against protesters. <\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">On Saturday, federal officers guarding the ICE building fired tear gas, pepper balls and flash-bangs toward crowds of protesters gathered outside the South Portland facility <a href=\"https:\/\/www.opb.org\/article\/2025\/10\/05\/federal-tactics-on-protesters-escalates-hours-after-judge-rules-against-trump\/\" target=\"_blank\" rel=\"nofollow noopener\">without any clear signs of provocation<\/a>. A spokesperson for the U.S. Department of Homeland Security said that left-wing protesters had \u201cswarmed\u201d the building, and that the response was needed to clear the building\u2019s driveway for government vehicles. <\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">OPB reporters did not observe any protesters on the ICE property. Some people were hit with pepper balls if they stepped off the public sidewalk into the building\u2019s driveway. OPB observed several right-wing videographers filming the actions from the roof and from behind the throng of officers. DHS spokesperson Tricia McLaughlin said federal officers arrested 17 people Saturday for charges ranging from trespassing to assaulting law enforcement. <\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">Along with its treatment of some right-wing videographers, the DOJ is also investigating the city\u2019s decision to enforce land use laws that could threaten ICE\u2019s ability to operate out of the South Portland building. On Friday, DOJ attorneys said they\u2019ll investigate whether these incidents warrant penalties for the city in its <a href=\"https:\/\/www.opb.org\/article\/2022\/07\/27\/us-justice-department-portland-police-use-of-force-settlement\/\" target=\"_blank\" rel=\"nofollow noopener\">drawn-out settlement agreement <\/a>between Portland police and the DOJ for how the city\u2019s officers treat people with mental illnesses. <\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">Taylor wrote that this would be \u201centirely inappropriate,\u201d and a move driven simply to \u201cscore political points.\u201d Instead, he wrote that the federal government is abusing that same agreement through its recent treatment of protesters. <\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">The argument has echoes of accusations made in 2021, after Portland reported more than 6,000 documented instances of Portland police using force against racial justice protesters in 2020. At the time, Assistant U.S. Attorney Jonas Geissler raised concerns that the force was potentially unconstitutional and may require DOJ intervention to address. Geissler was one of the two U.S. attorneys who announced the DOJ\u2019s investigation into Portland last week. <\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">Taylor\u2019s letter comes less than 24 hours after a federal judge temporarily blocked National Guard deployments from any state to Portland for at least two weeks. The Trump administration swiftly <a href=\"https:\/\/www.opb.org\/article\/2025\/10\/06\/appeals-judges-portland-troop-deployment\/\" target=\"_blank\" rel=\"nofollow noopener\">appealed this ruling<\/a>. <\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">The U.S. DOJ did not immediately respond to OPB\u2019s request for comment on Taylor\u2019s letter.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">Taylor ended his letter with a clear ask.<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">\u201cPlease do not fail Portland and please do not fail America,\u201d he wrote. \u201cPlease show that the Civil Rights Division cares about the rule of law and the constitutional protections guaranteed to everyone, including those with whom the federal administration appears to disagree politically.\u201d<\/p>\n<p class=\"article-body__text article-body--padding color_dgray m-none\">This story may be updated.<\/p>\n","protected":false},"excerpt":{"rendered":"FILE: Enforcement officers at the U.S. Immigration and Customs Enforcement facility, Portland, Ore., Oct. 4, 2025.
