{"id":216356,"date":"2025-10-11T08:32:15","date_gmt":"2025-10-11T08:32:15","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/216356\/"},"modified":"2025-10-11T08:32:15","modified_gmt":"2025-10-11T08:32:15","slug":"troops-stay-away-from-federal-courthouse-downtown-as-some-cases-against-protesters-fall-apart","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/216356\/","title":{"rendered":"Troops Stay Away From Federal Courthouse Downtown As Some Cases Against Protesters Fall Apart"},"content":{"rendered":"<p>DOWNTOWN \u2014 Federal prosecutors walked back more charges Friday against demonstrators arrested while protesting the Trump administration\u2019s immigration enforcement blitz as court challenges continue to mount.<\/p>\n<p>That includes a two-week restraining order signed Thursday by U.S. District Judge April Perry temporarily blocking a federal mobilization of the National Guard. Officials previously intended to station troops on the plaza near the Dirksen Federal Courthouse, 219 S. Dearborn St., on Friday during immigration-related hearings. But no troops could be seen near the courthouse following Perry\u2019s order.<\/p>\n<p>No more than six protesters were outside the courthouse Friday as judges inside openly questioned the evidence prosecutors had to pursue criminal charges against protesters who had been arrested in recent weeks.<\/p>\n<p>Charges were dropped against a high school cafeteria worker and reduced against a Air Force veteran, both of whom were accused of impeding federal agents as they pushed back protests near the ICE processing facility in west suburban Broadview.<\/p>\n<p>Four of 15 cases have now been dropped involving protesters accused of attacking or impeding federal agents, which have often come out of sworn affidavits from other agents. That\u2019s while key court decisions this week <a href=\"https:\/\/blockclubchicago.org\/2025\/10\/08\/100s-could-be-freed-from-ice-custody-after-ruling-that-warrantless-arrests-violated-consent-decree\/\" data-wpel-link=\"internal\" rel=\"nofollow noopener\" target=\"_blank\">limited ICE\u2019s ability to make warrantless arrests<\/a>, <a href=\"https:\/\/blockclubchicago.org\/2025\/10\/09\/judge-rules-feds-cant-pepper-spray-tear-gas-journalists-after-block-club-chicago-and-others-sue\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" data-wpel-link=\"internal\">fire chemical agents at peaceful protesters and journalists<\/a> or make arrests of journalists not suspected of committing crimes.<\/p>\n<p>\u201cViolent arrests of people exercising their First Amendment rights is part of Trump\u2019s weaponization of the legal system,\u201d said Madeline Townsend, an attorney with the National Lawyers Guild Chicago, which has been observing protesters in Broadview, in a statement Friday. \u201cThese are political prosecutions to gin up the narrative that the federal government wants and are disconnected from reality. \u2026 Trump\u2019s DHS is simply not credible.\u201d<\/p>\n<p><img loading=\"lazy\" data-recalc-dims=\"1\" decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2025\/10\/1Q2A8202-1024x683.jpg\" alt=\"Fences surround the Dirksen Federal Building, 219 S. Johnson\/Block Club Chicago<\/p>\n<p>4th Broadview Protester Sees Charges Dropped<\/p>\n<p>Paul Ivery, a cafeteria worker at Oak Park and River Forest High School, walked out of the courthouse Friday after prosecutors dropped charges accusing him of threatening a federal agent before a physical struggle outside the Broadview facility.<\/p>\n<p>Ivery, who has an intellectual disability, had gone to Broadview to protest how ICE had treated local police officers, said Scott Sakiyama, acting as a spokesperson for Ivery on Friday.<\/p>\n<p>Ivery\u2019s arrest was the start of a \u201cjarring\u201d ordeal during which he spent four days in jail, Sakiyama said.<\/p>\n<p>He wasn\u2019t sure if Ivery planned to go to another protest. <\/p>\n<p>\u201cBroadview is a very scary place right now,\u201d Sakiyama said. \u201cPaul is happy to be home, very happy to have this done, and he\u2019s encouraging people to continue to peacefully protest.\u201d<\/p>\n<p>Earlier this week, the case against a couple arrested at a Broadview protest was dropped after a grand jury refused to indict, a move their veteran defense attroney called a \u201conce-in-a-lifetime for me,\u201d telling Block Club that prosecutors had \u201c<a href=\"https:\/\/blockclubchicago.org\/2025\/10\/08\/feds-had-less-evidence-than-a-ham-sandwich-in-dismissed-armed-protester-case-lawyer-says\/\" data-wpel-link=\"internal\" rel=\"nofollow noopener\" target=\"_blank\">less evidence than a ham sandwich<\/a>\u201d against his client.<\/p>\n<p>Before her decision blocking a deployment of the National Guard, Perry expressed doubt over Homeland Security\u2019s \u201ccredibility and assessment\u201d in Chicago \u2014 citing the dropped charges against protesters.<\/p>\n<p><img loading=\"lazy\" data-recalc-dims=\"1\" decoding=\"async\" width=\"1024\" height=\"735\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2025\/10\/bcc-broadview-ice-20251010-15-1024x735.jpg\" alt=\"Illinois State Police troopers and Cook County Sheriff deputies shove protesters during a protest outside the Immigration and Customs Enforcement (ICE) processing facility in Broadview on Friday, Oct. 10, 2025. (Talia Sprague\/Block Club Chicago) Credit: Talia Sprague\/Block Club Chicago<\/p>\n<p>Other Protester Prosecutions Continue<\/p>\n<p>Federal prosecutors also downgraded felony charges to a misdemeanor against <a href=\"https:\/\/blockclubchicago.org\/2025\/10\/02\/veterans-speak-out-against-ices-mob-tactics-in-broadview-our-democracy-is-being-crushed\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" data-wpel-link=\"internal\">Dana Briggs, a 70-year-old Air Force veteran<\/a> accused of punching a Border Patrol agent in the arm near the Broadview facility.<\/p>\n<p>Briggs\u2019 attorney asked to push up the date for a jury trial. Magistrate Judge Gabriel A. Fuentes, who has presided over a number of initial hearings for Broadview protesters, asked prosecutors to pass on video evidence related to the charges against Briggs and another protester by the end of the day.<\/p>\n<p>\u201cIt\u2019s in the government possession. You represent the government, don\u2019t you?\u201d Fuentes said. \u201cI have a criminal defendant who wants a trial and wants it soon, and he\u2019s going to get it.\u201d<\/p>\n<p>The case against Cole Sheridan \u2014 accused of physically resisting orders to move back and <a href=\"https:\/\/www.oakpark.com\/2025\/10\/09\/oak-park-native-border-patrol-bovino-court\/\" target=\"_blank\" rel=\"noreferrer noopener external nofollow\" data-wpel-link=\"external\">shoving Border Patrol Commander Greg Bovino<\/a> in Broadview\u00a0\u2014 was allowed to continue only after Magistrate Judge Heather K. McShain said prosecutors \u201cmet its very low burden\u201d for probable cause.<\/p>\n<p>\u201cWithout video of the actual physical exchange \u2026 there is only the evidence of the hearsay statement of Bovino,\u201d McShain said.<\/p>\n<p>The attorney for a <a href=\"https:\/\/www.justice.gov\/usao-ndil\/pr\/alleged-member-chicago-street-gang-charged-soliciting-murder-senior-law-enforcement\" target=\"_blank\" rel=\"noreferrer noopener external nofollow\" data-wpel-link=\"external\">man accused of placing a $10,000 bounty on Bovino<\/a> did not contest his detention ahead of his next hearing. Federal officials have also accused the man, Juan Espinoza Martinez, of being a member of the Latin Kings street gang. <\/p>\n<p>In a statement Friday, Jonathan Bedi, who is representing Martinez, denied that his client had any gang affiliation and said he was \u201cinnocent of these charges.\u201d<\/p>\n<p>\u201cJuan is a longtime Chicago resident and the father of three kids. Juan has resided in the United States for 30 years, and throughout his time in Chicago, he has had no prior criminal history or gang affiliation,\u201d Bedi said. \u201cAs a dedicated union member, Juan has consistently worked to provide for his family while contributing positively to the community. He even coaches his kids\u2019 sports teams.\u201d<\/p>\n<p>On Thursday, a federal grand jury meanwhile returned an indictment against <a href=\"https:\/\/blockclubchicago.org\/2025\/10\/05\/federal-agents-shoot-woman-in-brighton-park-causing-tense-scene-with-protesters\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\" data-wpel-link=\"internal\">Marimar Martinez, 30, who was shot by federal agents Saturday<\/a> after following them with her car in Brighton Park.
