{"id":236213,"date":"2025-10-19T11:43:21","date_gmt":"2025-10-19T11:43:21","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/236213\/"},"modified":"2025-10-19T11:43:21","modified_gmt":"2025-10-19T11:43:21","slug":"ohio-to-fast-track-energy-at-former-coal-mines-and","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/236213\/","title":{"rendered":"Ohio to fast-track energy at former coal mines and\u2026"},"content":{"rendered":"<p dir=\"ltr\">A big concern is making sure the board will allow wind and solar developments on mine lands and brownfields throughout Ohio, regardless of which county they\u2019re in. Roughly <a href=\"https:\/\/www.ohiocitizen.org\/utility_scale_solar\" rel=\"nofollow noopener\" target=\"_blank\">one-third<\/a> of Ohio\u2019s 88 counties <a href=\"https:\/\/scholarship.law.columbia.edu\/cgi\/viewcontent.cgi?article=1252&amp;context=sabin_climate_change\" rel=\"nofollow noopener\" target=\"_blank\">ban wind, solar, or both<\/a> in all or a\u00a0significant part of their jurisdiction. This authority was granted to them by a\u00a02021 law, Senate Bill\u00a052.<\/p>\n<p dir=\"ltr\">However, the language and legislative history of HB 15 make clear that it \u200b\u201cwas meant to be <a href=\"https:\/\/www.canarymedia.com\/articles\/solar\/ohio-law-power-generation-hb-15\" rel=\"nofollow noopener\" target=\"_blank\">technology-neutral<\/a>,\u201d said Rebecca Mellino, a\u00a0climate and energy policy associate for The Nature Conservancy.<\/p>\n<p dir=\"ltr\">HB 15 even states that its terms for permitting energy projects in priority investment areas apply \u200b\u201c<a href=\"https:\/\/codes.ohio.gov\/ohio-revised-code\/section-4906.03#:~:text=(E)%20Notwithstanding%20sections%204906.06%20to,1551.33%20of%20the%20Revised%20Code.\" rel=\"nofollow noopener\" target=\"_blank\">notwithstanding<\/a>\u201d some other parts of Ohio\u00a0law.<\/p>\n<p dir=\"ltr\">\u201cThat clause is meant to bypass some of the typical Ohio Power Siting Board procedures \u2014 including the procedures for siting in restricted areas\u201d under SB 52, wrote Bill Stanley, Ohio director for The Nature Conservancy, in <a href=\"https:\/\/dis.puc.state.oh.us\/DocumentRecord.aspx?DocID=75004eff-e92b-4bd8-b3f3-c0d7682113c7\" rel=\"nofollow noopener\" target=\"_blank\">comments<\/a> filed with the\u00a0board.<\/p>\n<p dir=\"ltr\">But the exemption provided by the \u200b\u201cnotwithstanding\u201d clause is narrow, Mellino added, because local government authorities must ask for a\u00a0priority investment area designation. That means, for example, that in a\u00a0county with a\u00a0solar and wind ban in place, officials would need to choose to request that a\u00a0former coal mine or brownfield become a\u00a0priority investment area.<\/p>\n<p dir=\"ltr\">The Nature Conservancy has asked the Power Siting Board to add language making it crystal-clear that renewable-energy projects can be built on any land marked a\u00a0priority investment area \u2014 even if a\u00a0solar and wind ban otherwise exists in a\u00a0county.<\/p>\n<p dir=\"ltr\">Industry groups are pushing for additional clarifications to make sure the Power Siting Board meets the permitting deadlines set by the new law, both for expedited and standard projects.<\/p>\n<p dir=\"ltr\">For example, Open Road Renewables, which builds large-scale solar and battery storage, said in <a href=\"https:\/\/dis.puc.state.oh.us\/ViewImage.aspx?CMID=A1001001A25I18B41022H01580\" rel=\"nofollow noopener\" target=\"_blank\">comments<\/a> that, in order to align with HB 15, the board\u2019s rules should require energy developers to notify the public of an application when it is filed, rather than after it is deemed complete.<\/p>\n<p dir=\"ltr\">Separate <a href=\"https:\/\/dis.puc.state.oh.us\/DocumentRecord.aspx?DocID=e015ba06-24a1-4366-9da2-32a593545b87\" rel=\"nofollow noopener\" target=\"_blank\">comments<\/a> from the American Clean Power Association, MAREC Action, and the Utility Scale Solar Energy Coalition of Ohio ask for tweaks to provisions regarding notices on public hearings and for clarifications on application fees. The board should also promptly issue certificates for projects that are automatically approved, say <a href=\"https:\/\/dis.puc.state.oh.us\/DocumentRecord.aspx?DocID=4ce68688-14ef-49f2-ba68-347d2e299a12\" rel=\"nofollow noopener\" target=\"_blank\">comments<\/a> by Robert Brundrett, president of the Ohio Oil and Gas Association.<\/p>\n<p dir=\"ltr\">The Department of Development hopes to finish draft standards and invite public comments on them soon, Waldvogel said. Meanwhile, the department has received its first request to designate a\u00a0priority investment area. The ask comes from Jefferson County\u2019s board of commissioners, which did not specify the type of energy that may be built in the\u00a0area.<\/p>\n<p dir=\"ltr\">The Ohio Power Siting Board, for its part, is expected to finalize its rules within the next couple of months.
