{"id":262004,"date":"2025-10-31T02:53:07","date_gmt":"2025-10-31T02:53:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/262004\/"},"modified":"2025-10-31T02:53:07","modified_gmt":"2025-10-31T02:53:07","slug":"dauphin-island-foxes-can-be-trapped-killed-judge-rules","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/262004\/","title":{"rendered":"Dauphin Island foxes can be trapped, killed, judge rules"},"content":{"rendered":"<p class=\"article__paragraph article__paragraph--left\" id=\"4SJUG7H75VBDNLIWC5R6BXB7EI\">Mobile County Circuit Court Judge Michael Youngpeter sided with the town of Dauphin Island and the state department of conservation Thursday, saying that he does not have standing to stop the town from carrying out a plan to trap and kill some foxes on the West End of Dauphin Island. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"3O2ZXCEA3JD3NO6YIYDKKR77VA\">But the two fox enthusiasts who sued Dauphin Island are free to try their luck in federal court, he said. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"HZ4CCDVULNB6RHCI5O3SMVBQPI\">\u201cIf you\u2019re saying there\u2019s a better way to handle it [predator control], that\u2019s a science question and you need to take it to my friends next door in federal court,\u201d Youngpeter told Mary Beth Mantiply, who represents the plaintiffs. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"HFVSACTHZ5EKVOXDMJL2U6IT6A\"><a href=\"https:\/\/www.al.com\/news\/mobile\/2025\/10\/fate-of-beloved-dauphin-island-fox-roxy-in-hands-of-judge.html\" target=\"_blank\" rel=\"nofollow noopener\">Duane Wood and Spencer Harrison sued the town of Dauphin Island<\/a> in September, seeking to stop the <a href=\"https:\/\/www.al.com\/news\/mobile\/2025\/09\/roxy-beloved-dauphin-island-fox-likely-to-be-removed-to-protect-sea-turtles-and-birds.html\" target=\"_blank\" rel=\"nofollow noopener\">town from contracting with the federal government to remove foxes<\/a> from the West End of Dauphin Island, which is a dedicated nature preserve. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"4WYW4NZKJNGFVKN5H73GPB3TL4\">The town owns the property, <a href=\"https:\/\/www.al.com\/life\/2025\/04\/something-special-dauphin-islands-west-end-is-a-natural-haven-but-not-for-dogs.html\" target=\"_blank\" rel=\"nofollow noopener\">which was purchased using funds from the Deepwater Horizon Oil Spill settlements.<\/a> In order to protect snowy plovers, loggerhead sea turtles and other endangered species as required by the Deepwater Horizon settlement plan, the town said foxes and other predators need to be removed from the property. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"FW7AVNSB3RFIVOFW2NFOWI3DRY\">Wood and Harrison argued that it was inhumane to trap and kill the foxes. Harrison has become famous on social media for his photos of the foxes, including <a href=\"https:\/\/www.al.com\/news\/2024\/01\/protect-roxy-effort-underway-to-save-dauphin-island-red-foxes-from-relocation.html\" target=\"_blank\" rel=\"nofollow noopener\">one he named \u201cRoxy,\u201d<\/a> whom he said he\u2019s befriended. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"PBFMSZPNOVEZJNS76HPT6QGKK4\">\u201cI began taking pictures of her, and bringing dog biscuits to her,\u201d Harrison said. \u201cShe would sit down next to me, after she ate her chicken, she would just sit down and chill out.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"DG6HHAI4GJC2FCMX6REOP7B3TU\">But the state, which joined the case alongside the town, argued that the court had no standing to determine whether it was right to remove the foxes. Managing the predators on the West End is part of a much larger plan to maintain the habitat for endangered species, they said, which stems from the federal government\u2019s intent to use the oil spill funds to restore coastal habitat in the Gulf. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"M3JLK72OOBHW5HG7PWDFKT62RQ\">\u201cAll of this conservation issue is based on a federal issue,\u201d Nash Campbell, who represents the town of Dauphin Island, told reporters after the hearing. \u201cI think they should have done this through an appellate procedure long ago.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"SP7ZWN75GVEBRDKDZ5GGY4IT6M\">In a packed courtroom, the two sides presented evidence, including photos from social media of foxes being fed chicken legs and eggs, to back up their claims. At times, the proceedings even became emotional and heated. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"2BZ6QZY7ZREMBLWFQ4PH4OX7LE\">\u201cIt\u2019s not just foxes,\u201d Mantiply told reporters after the hearing. \u201cIt\u2019s foxes, and racoons, and bobcats, and a lot of people understand the importance of the predator-prey balance.\u201d <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"5RFQMBMRB5AFBMHT6TFYWCX3MI\">Some Dauphin Island residents resonate with Harrison and also care about the foxes. A petition started last month to prevent <a href=\"https:\/\/www.change.org\/p\/stop-the-killing-of-fox-families-on-dauphin-island?recruiter=1297779871&amp;recruited_by_id=6a0a05b0-b8b0-11ed-9f96-6ba7dbed7711&amp;utm_source=share_petition&amp;utm_campaign=psf_promote_or_share&amp;utm_term=psf&amp;utm_medium=copylink&amp;utm_content=cl_sharecopy_490751529_en-US%3A3\" target=\"_blank\" rel=\"nofollow noopener\">the fox removal has more than 2,500 signatures.<\/a> <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"2TOMDPL4YFBWJEAJPCPK4EBZZM\">But in the end, Youngpeter decided he didn\u2019t have the power to prevent the fox removal. The wildlife management plan for the West End, which was created over the course of several years, is in the jurisdiction of the federal government, he said. Because no foxes had actually been removed, he had no jurisdiction.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"Y4D6FDFCPVCNXDCOCIT65EAL2A\">Youngpeter will not enter his official written ruling until Monday, he told the courtroom. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"NXWJ77MOB5EJ3NC3PD4O5AC7GQ\">Leif Stephens, who directs the Alabama division of the Animal and Plant Health Inspection Service (the agency that would carry out the removal), told the court Thursday that not all foxes will be targeted. Only those that have learned to target bird and turtle nests will be targeted for removal. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"23Y3PBSK6REBNMRN6CAVLK546Q\">It\u2019s not feasible to relocate the foxes, he said, because of disease and potential aggression from other foxes. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"3AFJDRYFZBCOLFZD5EZZ752C5U\">\u201cThere is no intention to wipe out any kind of species,\u201d Stephens told the courtroom. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"Q6RFQSJ7KZHLJDFFNXHBHIWEKY\">Dauphin Island Mayor Jeff Collier previously told AL.com that other methods of deterring the foxes from targeting the nests haven\u2019t worked. There are foxes on other parts of the island, he said, and those will not be targeted. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"LW4O7QWGCNFG7H3K4L2DT5U4SE\">Mantiply told reporters she would confer with Wood and Harrison to decide if they would take the case to federal court. <\/p>\n<p>If you purchase a product or register for an account through a link on our site, we may receive compensation.
