The complaint outlines that Andrea Kroksnes suffered from lasting medical problems and economic loss due to a wall-mounted panel that fell and struck her, causing an acute concussion.<\/p>\n<p>Case documents reveal that Kroksnes is pursuing monetary damages exceeding $150,000 as well as covered legal costs, interest, and further relief as determined by the court.<\/p>\n<p>According to the complaint, Kroksnes visited the museum in Queens on October 29, 2022, to see Palestinian artist Jumana Manna\u2019s mid-career survey <a href=\"https:\/\/www.momaps1.org\/en\/programs\/128-jumana-manna\" rel=\"nofollow noopener\" target=\"_blank\">Break, Take, Erase, Tally<\/a>. While seated in the museum\u2019s screening room, a \u201clarge, heavy wall-mounted panel\u201d affixed to the wall directly behind the sofa was dislodged and fell onto her. Kroksnes\u2019s legal team at the New York law firm Kreindler &amp; Kreindler LLP told Hyperallergic that she was struck by an acoustics panel and not an artwork or part of an installation.<\/p>\n<p>MoMA PS1 did not respond to Hyperallergic\u2019s requests for comment.<\/p>\n<p><img loading=\"lazy\" data-recalc-dims=\"1\" decoding=\"async\" width=\"1200\" height=\"900\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2025\/11\/jumana-manna-ps1-hakim-1200x900.jpg\" alt=\"\" class=\"wp-image-1055470\"  \/>Installation view of Jumana Manna\u2019s Break, Take, Erase, Tally at MoMA PS1 in 2022 (photo Hakim Bishara\/Hyperallergic)<\/p>\n<p>The complaint alleges that Kroksnes sustained an acute concussion \u201cas a direct and proximate result of the panel\u2019s detachment and impact,\u201d and later developed chronic post-concussion syndrome, \u201cresulting in ongoing physical, cognitive, and emotional damages.\u201d<\/p>\n<p>Kroksnes and her attorneys have accused MoMA PS1 of failing to properly secure the panel to the wall and to monitor the premises for safety risks or defective conditions, stating that the museum should have known that the piece of equipment was located in an area that \u201cvisitors would rest, lean, or make contact with.\u201d<\/p>\n<p>\u201cMs. Kroksnes suffered a debilitating concussion as a result of this preventable accident,\u201d Erin Applebaum, partner at Kreindler &amp; Kreindler, said on behalf of her client in an email to Hyperallergic. \u201cWe have been in touch with the museum since it occurred, but we were forced to file suit because of the impending statute of limitations. We remain hopeful that this matter can be resolved swiftly and amicably.\u201d <\/p>\n<p>The suit outlines that Kroksnes\u2019s concussion resulted in \u201cextreme pain,\u201d that she was \u201cseverely\u201d and \u201cpermanently injured\u201d due to the panel\u2019s detachment, and that she has \u201csuffered economic loss\u201d on account of previous and current medical expenses that will continue to incur in the future.
