RNC"},"content":{"rendered":"<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">The Supreme Court announced on Monday that it will hear <a href=\"https:\/\/www.scotusblog.com\/cases\/case-files\/watson-v-republican-national-committee\/\" rel=\"nofollow noopener\" target=\"_blank\">Watson v. Republican National Committee<\/a>, a case claiming that, for many decades, states have been counting ballots that should have been tossed out entirely.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">The premise of the GOP\u2019s argument in Watson is that an <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/2\/7\" rel=\"nofollow noopener\" target=\"_blank\">1872 law<\/a> providing that federal elections shall take place on \u201cthe Tuesday next after the 1st Monday in November, in every even numbered year\u201d requires late-arriving ballots to be tossed \u2014 and somehow no one noticed this restriction for more than 150 years. The GOP sued Mississippi, which is one of several states that count ballots that are mailed before Election Day, but that do not arrive until afterward.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">In recent elections, Democrats have been more likely to mail their ballots than Republicans, and President Donald Trump has <a href=\"https:\/\/www.vox.com\/2020\/8\/11\/21358960\/trump-mail-voting-sabotage-explained\" rel=\"nofollow noopener\" target=\"_blank\">tried to restrict mail voting<\/a> in an apparent effort to make it harder for Democrats to vote.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">Indeed, it is <a href=\"https:\/\/www.vox.com\/2024-elections\/380481\/republican-wetzel-fifth-circuit-supreme-court-ballots-mail\" rel=\"nofollow noopener\" target=\"_blank\">tough to find a legal argument<\/a> in Oldham\u2019s opinion claiming that the 1872 law requires late-arriving ballots to be tossed out. That opinion concludes that \u201creceipt of the last ballot\u2026constitutes consummation of the election, and it must occur on Election Day,\u201d but it cites no legal authority that supports this conclusion.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">In any event, Oldham\u2019s 5th Circuit is several steps to the Supreme Court\u2019s right in much the same way that the House Freedom Caucus is to the right of former Senate Republican Leader Mitch McConnell. Both tend to vote for outcomes that the Republican Party prefers, but the Supreme Court typically <a href=\"https:\/\/www.vox.com\/policy-and-politics\/2022\/12\/27\/23496264\/supreme-court-fifth-circuit-trump-court-immigration-housing-sexual-harrassment\" rel=\"nofollow noopener\" target=\"_blank\">hands down a few decisions each year<\/a> tossing out 5th Circuit decisions that were particularly poorly reasoned.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">So, while the Court\u2019s decision to take up the Watson case is a little troubling \u2014 if the justices sign onto the Republican National Committee\u2019s verkakte legal theory, it would be a worrisome sign that the Court may try to rig future elections \u2014 that outcome is probably unlikely. Oldham\u2019s, and the GOP\u2019s, legal arguments are so weak that they are unlikely to receive more than three votes, even on this Supreme Court.<\/p>\n","protected":false},"excerpt":{"rendered":"The Supreme Court announced on Monday that it will hear Watson v.
