{"id":288488,"date":"2025-11-13T04:57:09","date_gmt":"2025-11-13T04:57:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/288488\/"},"modified":"2025-11-13T04:57:09","modified_gmt":"2025-11-13T04:57:09","slug":"behr-paint-sued-over-use-of-rolling-stones-paint-it-black","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/288488\/","title":{"rendered":"Behr Paint Sued Over Use of Rolling Stones&#8217; &#8216;Paint It Black&#8217;"},"content":{"rendered":"<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t<a href=\"https:\/\/variety.com\/t\/abkco\/\" id=\"auto-tag_abkco\" data-tag=\"abkco\" rel=\"nofollow noopener\" target=\"_blank\">ABKCO<\/a> Records, which owns the rights to the <a href=\"https:\/\/variety.com\/2020\/biz\/news\/rolling-stones-copyright-dump-abkco-unreleased-1969-songs-1203457385\/\" rel=\"nofollow noopener\" target=\"_blank\">master recordings of the Rolling Stones<\/a> up to 1970, has sued Behr Paint, alleging copyright infringement over the use of the group\u2019s 1966 song \u201cPaint It, Black\u201d in one of its online commercials.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe complaint, filed in the U.S. District Court, Central District of California, Southern Division, and obtained by Variety, alleges that \u201cBehr, without ABKCO\u2019s authorization, without compensating ABKCO, and for its sole commercial benefit, reproduced, distributed, publicly performed, transmitted, prepared a derivative work embodying, and otherwise exploited the ABKCO Recording in a commercial advertisement to promote BEHR\u2019s products and business.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tIt adds, \u201cBehr is a sophisticated, multi-billion-dollar corporation that, upon information and belief, routinely licenses recorded music for its commercials, yet it inexplicably chose in this case not to seek a license for \u2018Paint It, Black.\u2019\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tABKCO is seeking unspecified damages as a result.\u00a0The ad appears to have been removed from Behr\u2019s robust Instagram archive, although <a rel=\"nofollow noopener\" href=\"https:\/\/www.instagram.com\/reel\/DA9O6F-Ris2\/\" target=\"_blank\">unofficial versions <\/a>can be found online.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tVariety has contacted Behr representatives for comment. <\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tWilliam Pittenger, General Counsel for ABKCO noted, \u201cThe type of commercial use exploited by Behr undergoes some of the highest level of scrutiny in the world of music licensing and carries some of the most substantial licensing fees. Because of Behr\u2019s decision not to request and obtain the necessary license, this commercial brand association has been forced upon ABKCO and the artists without any consideration or compensation.\u201d<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tThe online ad, posted to Behr\u2019s official Instagram account, shows a house being painted not black but a greyish-green color while the song plays. In one version of the clip found on Instagram, a brief snippet of dialogue from the Martin Scorsese 1989 film \u201cGoodfellas,\u201d which features the song, is heard, suggesting that the recording was taken from the film, potentially resulting in further copyright issues.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\t\u201cPaint It, Black,\u201d written by Mick Jagger and Keith Richards, reached No. 1 on the Billboard Hot 100 in 1966 and is one of the <a href=\"https:\/\/variety.com\/t\/rolling-stones\/\" id=\"auto-tag_rolling-stones\" data-tag=\"rolling-stones\" rel=\"nofollow noopener\" target=\"_blank\">Rolling Stones<\/a>\u2018 biggest hits, although its lyrics \u2014 written from the perspective of a person whose outlook is so dark that he wants to paint everything black \u2014\u00a0are unusual for an ad with an otherwise upbeat tone. \u00a0<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tABKCO, which was founded by the late former Stones and Beatles business manager Allen Klein, has a long history of aggressively protecting the copyrights it owns and oversees. Perhaps the most famous was over the <a href=\"https:\/\/variety.com\/2019\/music\/news\/bittersweet-symphony-richard-ashcroft-rolling-stones-statement-1203225288\/\" rel=\"nofollow noopener\" target=\"_blank\">Verve\u2019s 1997 hit \u201cBittersweet Symphony,\u201d<\/a> which samples a five-second portion of a cover of the Stones\u2019 song \u201cThe Last Time\u201d by the Andrew Loog Oldham Orchestra. The Stones had agreed to license the segment in exchange for 50 percent of the royalties, but ABKCO claimed the clip was longer and violated the agreement. It filed a successful plagiarism case that resulted in the Verve relinquishing all royalties and publishing rights to ABKCO, and the song credit reverted to Jagger and Richards. However, this decision was reversed in 2019 when the two Stones signed over the publishing on \u201cBittersweet Symphony\u201d to Verve frontman Richard Ashcroft, allowing all future royalties to go to him.<\/p>\n<p class=\"paragraph larva \/\/ lrv-u-margin-lr-auto  lrv-a-font-body-m   \">\n\tABKCO is represented by Benjamin S.
