I got three packs and felt good about it. But a few days ago, when I saw the news that <a href=\"https:\/\/www.ajc.com\/business\/2025\/07\/delta-uses-ai-to-set-airfares-some-senators-are-worried\/\" rel=\"nofollow noopener\" target=\"_blank\">Delta Air Lines was using AI to personalize its flight prices<\/a>, I got mad. I started to suspect that something sinister was behind my great deal on drawers at Amazon. Was that sale just for me? Where else have I been paying personalized prices?<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">Delta CEO Glen Hauenstein actually announced <a href=\"https:\/\/s2.q4cdn.com\/181345880\/files\/doc_downloads\/2024\/11\/CORRECTED-TRANSCRIPT_-Delta-Air-Lines-Inc-DAL-US-Investor-Day-20-November-2024-8_30-AM-ET.pdf\" rel=\"nofollow noopener\" target=\"_blank\">last year<\/a> that the airline was using AI to do \u201ca full reengineering of how we price and how we will be pricing in the future\u201d at its annual Investor Day event. He promised, somewhat ominously, that airfares would be determined \u201con that flight, on that time, to you, the individual.\u201d Last week, Hauenstein ignited a furor telling investors that Delta was currently using the technology on 3 percent of flight prices and <a href=\"https:\/\/fortune.com\/2025\/07\/16\/delta-moves-toward-eliminating-set-prices-in-favor-of-ai-that-determines-how-much-you-personally-will-pay-for-a-ticket\/\" rel=\"nofollow noopener\" target=\"_blank\">planned to boost that to 20 percent<\/a> by the end of this year.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">Welcome to the era of hyper-personalized pricing. Companies are increasingly deploying AI-powered technology that is capable of identifying <a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2025\/01\/ftc-surveillance-pricing-study-indicates-wide-range-personal-data-used-set-individualized-consumer\" rel=\"nofollow noopener\" target=\"_blank\">thousands of different real-time signals<\/a> \u2014 everything from your location and loyalty status to your device and search history \u2014 to sell the same product to two different people for two different prices. This represents an advanced form of dynamic pricing, the age-old practice of adjusting prices based on market conditions. With the help of algorithms and reams of data, some businesses are taking a new, personalized approach: <a href=\"https:\/\/www.politico.com\/news\/2025\/05\/28\/trump-surveillance-pricing-00370566\" rel=\"nofollow noopener\" target=\"_blank\">surveillance pricing<\/a>. Dynamic pricing is perfectly legal, but surveillance pricing and the accompanying privacy concerns are new.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">Suffice to say, consumers don\u2019t like the idea of companies using AI to set prices. On Wednesday, Democratic Rep. Greg Casar announced plans to introduce a bill that would <a href=\"https:\/\/www.nbcnews.com\/politics\/congress\/congress-ban-bill-surveillance-pricing-personal-data-rcna219381\" rel=\"nofollow noopener\" target=\"_blank\">ban surveillance pricing<\/a> at a federal level. Arizona Sen. Ruben Gallego <a href=\"https:\/\/x.com\/RubenGallego\/status\/1945138645783990445\" rel=\"nofollow\">accused<\/a> Delta of \u201cusing AI to find your pain point \u2014 meaning they\u2019ll squeeze you for every penny\u201d and sent the company <a href=\"https:\/\/www.gallego.senate.gov\/wp-content\/uploads\/2025\/07\/Delta-AI-Letter.pdf\" rel=\"nofollow noopener\" target=\"_blank\">an angry letter<\/a>, which was cosigned by Sens. Mark Warner of Virginia and Richard Blumenthal of Connecticut. And earlier this month, New York <a href=\"https:\/\/www.clarkhill.com\/news-events\/news\/new-york-enacts-algorithmic-pricing-disclosure-requirements-effective-date-of-new-ai-disclosure-quickly-approaching\/\" rel=\"nofollow noopener\" target=\"_blank\">enacted a law<\/a> that requires sellers to disclose when personalized algorithmic pricing is in effect, with similar legislation under consideration in other states.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup _1iohv3z2 xkp0cg9\">Consumers don\u2019t like the idea of companies using AI to set prices.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">When I asked <a href=\"https:\/\/cdt.org\/staff\/george-slover\/\" rel=\"nofollow noopener\" target=\"_blank\">George Slover<\/a>, general counsel of the Center for Democracy and Technology, about pricing models like this, he said, \u201cThis is a different animal than what the airlines have been doing in the past, and it is more personalized and more intrusive.\u201d<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">Delta denies anything untoward is happening here. The company said in a statement, \u201cThere is no fare product Delta has ever used, is testing, or plans to use that targets customers with individualized offers based on personal information\u201d and that fares are \u201cbased solely on trip-related factors like advance purchase and cabin class.\u201d In other words, according to the company, AI helps Delta set prices using metrics the airline already uses to determine airfares. Amazon, too, says it doesn\u2019t use surveillance pricing <a href=\"https:\/\/www.latimes.com\/archives\/la-xpm-2000-oct-02-fi-30029-story.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">after a botched experiment 25 years ago<\/a>.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">Still, surveillance pricing is already a documented phenomenon. Kroger offers different discounts to different customers based on personal data, according to <a href=\"https:\/\/www.consumerreports.org\/money\/questionable-business-practices\/kroger-secret-grocery-shopper-loyalty-profiles-unfair-a1011215563\/\" rel=\"nofollow noopener\" target=\"_blank\">a Consumer Reports investigation<\/a> published in May. Target settled a lawsuit and paid $5 million in fines after <a href=\"https:\/\/www.kare11.com\/article\/news\/local\/kare11-extras\/target-settles-ca-lawsuit-alleging-false-advertising-overpricing-fined-5m\/89-ba4a5441-c38e-4c9f-b524-b0d13414042f\" rel=\"nofollow noopener\" target=\"_blank\">a local KARE 11 news investigation<\/a> in Minneapolis found that prices in the Target app changed when customers entered the perimeter of a store. And <a href=\"https:\/\/www.propublica.org\/article\/asians-nearly-twice-as-likely-to-get-higher-price-from-princeton-review\" rel=\"nofollow noopener\" target=\"_blank\">a ProPublica investigation<\/a> revealed that the Princeton Review charged Asian families higher prices for college prep services.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">\u201cIt is a more sophisticated and algorithmically driven and selective price gouging,\u201d Slover said of surveillance pricing, which he <a href=\"https:\/\/cdt.org\/insights\/bespoke-pricing-what-is-the-invisible-hand-up-to\/\" rel=\"nofollow noopener\" target=\"_blank\">calls bespoke pricing<\/a>. \u201cYou are focusing on one particular individual based on their vulnerability and susceptibility.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">Dynamic pricing \u2014 sometimes with an algorithmic boost \u2014 is also controversial and on the rise. In the past year alone we\u2019ve seen outrage over <a href=\"https:\/\/www.axios.com\/local\/chicago\/2025\/02\/20\/beyonce-ticket-prices-regulate-ticketmaster-illinois\" rel=\"nofollow noopener\" target=\"_blank\">irregularities in ticket prices for Beyonc\u00e9\u2019s Cowboy Carter tour<\/a>, an <a href=\"https:\/\/www.businessinsider.com\/wendys-surge-dynamic-pricing-controversy-fast-food-cost-uber-airlines-2024-2\" rel=\"nofollow noopener\" target=\"_blank\">AI-enabled menu at Wendy\u2019s<\/a> that offered items at different prices depending on the time of day, and <a href=\"https:\/\/www.theverge.com\/2024\/8\/23\/24226885\/doj-realpage-antitrust-lawsuit-rent-fixing-software\u2019\" rel=\"nofollow noopener\" target=\"_blank\">rent-<\/a><a href=\"https:\/\/www.theverge.com\/2024\/8\/23\/24226885\/doj-realpage-antitrust-lawsuit-rent-fixing-software\" rel=\"nofollow noopener\" target=\"_blank\">setting<\/a><a href=\"https:\/\/www.theverge.com\/2024\/8\/23\/24226885\/doj-realpage-antitrust-lawsuit-rent-fixing-software\u2019\" rel=\"nofollow noopener\" target=\"_blank\"> software from <\/a><a href=\"https:\/\/www.theverge.com\/2024\/8\/23\/24226885\/doj-realpage-antitrust-lawsuit-rent-fixing-software\" rel=\"nofollow noopener\" target=\"_blank\">RealPage<\/a> that the Department of Justice say enabled collusion between landlords. And going further back, you\u2019ve got Uber allowing massive surge pricing <a href=\"https:\/\/archive.nytimes.com\/bits.blogs.nytimes.com\/2014\/07\/08\/uber-reaches-agreement-with-n-y-on-surge-pricing-during-emergencies\/\" rel=\"nofollow noopener\" target=\"_blank\">during Hurricane Sandy<\/a> and Amazon <a href=\"https:\/\/abcnews.go.com\/Technology\/story?id=119399&amp;page=1\" rel=\"nofollow noopener\" target=\"_blank\">doing random price tests<\/a> on customers buying DVDs.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">If you\u2019re wondering who to blame for this trend for this era of computer-optimized price schemes, the answer is surprisingly obvious: It\u2019s airlines. Well, and Jimmy Carter.<\/p>\n<p>Airline prices have always been a black box<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">The era of dynamic pricing as we know it <a href=\"https:\/\/classes.engineering.wustl.edu\/2010\/fall\/ese403\/software\/Informs%20Articles\/CH18%20Yield%20Management%20at%20American%20Airlines.pdf\" rel=\"nofollow noopener\" target=\"_blank\">started in 1966<\/a>, when American Airlines launched its Semi-Automated Business Research Environment, or SABRE. This computerized reservations system became the company\u2019s nerve center, where data about every reservation and cancellation was kept.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">After President Carter <a href=\"https:\/\/airandspace.si.edu\/stories\/editorial\/airline-deregulation-when-everything-changed\" rel=\"nofollow noopener\" target=\"_blank\">signed the Airline Deregulation Act<\/a> into law in 1978, which allowed airlines to set their own prices, American Airlines leveraged the data they collected through SABRE to maximize profits. The company even created a new system called DINAMO to do so, and within a few years, dynamic pricing <a href=\"https:\/\/airandspace.si.edu\/stories\/editorial\/airline-deregulation-when-everything-changed\" rel=\"nofollow noopener\" target=\"_blank\">became industry standard<\/a>. American Airlines led the way, launching its Super Saver fares and helping <a href=\"https:\/\/jonwms.web.unc.edu\/wp-content\/uploads\/sites\/10989\/2021\/06\/PriceDiscrimination_WP-2021.pdf\" rel=\"nofollow noopener\" target=\"_blank\">drive down the price of flights for leisure travelers<\/a> while business travelers footed the bill for the discounts. However, it wasn\u2019t always clear why some seats were cheaper than others. This is still the black box approach to airfare pricing we\u2019re living with today.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">Airfares can vary widely based on a number of factors, from the number of discounts the airline releases to when the passenger books the flight. The person you\u2019re sitting next to on any given flight could have paid twice as much as you \u2014 or half as much. It\u2019s getting harder to figure out how to game the system, too, as computers have improved and algorithms have gotten more sophisticated. And now there\u2019s AI.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">Does this mean Delta will know when you\u2019re flying to a funeral on short notice and charge you full fare, because it knows you\u2019ll pay it? Probably not, according to <a href=\"https:\/\/ce.gatech.edu\/directory\/person\/laurie-garrow\" rel=\"nofollow noopener\" target=\"_blank\">Laurie Garrow<\/a>, a professor of aviation at George Tech.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">\u201cThe characteristics that they\u2019re looking at to do this discounting are characteristics about your trip \u2014 how far I\u2019m booking in advance, what market, how many people are traveling together, historic purchase patterns in the aggregate \u2014 that\u2019s what\u2019s being fed to the AI,\u201d Garrow said. \u201cIt\u2019s not things that are being hypothesized, like, \u2018Am I going to a funeral?\u2019\u201d<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">In other words, what Delta knows about is based on the data you\u2019ve given it, especially when shopping for flights.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">It turns out that what\u2019s happening with Amazon prices is a little less nefarious. The company uses dynamic pricing with the help of algorithms \u2014 it constantly changes prices based on supply and demand \u2014 but Amazon says it doesn\u2019t do personalized or surveillance pricing. So that super low price on boxer briefs wasn\u2019t just for me. Amazon <a href=\"https:\/\/www.businessinsider.com\/amazon-price-changes-2018-8?international=true&amp;r=US&amp;IR=T\" rel=\"nofollow noopener\" target=\"_blank\">reportedly<\/a> changes its prices up to 2.5 million times a day, or about once every 10 minutes per product, but those fluctuations show up for all customers.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">\u201cAlgorithmic pricing exploits a vast asymmetry of information,\u201d said <a href=\"https:\/\/publicknowledge.org\/team_member\/elise-phillips\/\" rel=\"nofollow noopener\" target=\"_blank\">Elise Phillips<\/a>, policy counsel at Public Knowledge. \u201cGiven that there is often little transparency in how these algorithms function, it\u2019s fundamentally unfair to consumers.\u201d<\/p>\n<p>What you can do to avoid the algorithm\u2019s gaze<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">It may feel impossible to escape the reach of dynamic pricing both online and off. Again, it\u2019s not just airlines and Amazon doing it.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">Ticketmaster, which is infamous for dynamic pricing, and its parent company Live Nation are being sued by the Federal Trade Commission (FTC) <a href=\"https:\/\/www.justice.gov\/archives\/opa\/pr\/justice-department-sues-live-nation-ticketmaster-monopolizing-markets-across-live-concert\" rel=\"nofollow noopener\" target=\"_blank\">for illegally operating a monopoly<\/a>. (<a href=\"https:\/\/www.vox.com\/technology\/2023\/9\/26\/23835959\/ftc-amazon-antitrust-lawsuit-prime-lina-khan\" rel=\"nofollow noopener\" target=\"_blank\">So is Amazon<\/a>.) Kroger is being scrutinized not only for its personalized discounts but also <a href=\"https:\/\/apnews.com\/article\/electronic-shelf-labels-supermarket-prices-digital-132ef73fbbe2eb13a8c724b55fb458d1\" rel=\"nofollow noopener\" target=\"_blank\">its new electronic shelf labels<\/a>, which change the prices of groceries for arbitrary reasons. Uber has normalized surge pricing, and is now finding <a href=\"https:\/\/www.cbsnews.com\/chicago\/news\/uber-overcharging-congestion-fees\/\" rel=\"nofollow noopener\" target=\"_blank\">new ways to overcharge customers<\/a>.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup _1iohv3z2 xkp0cg9\">If you do find yourself shopping for a flight, a pair of underwear, or even a concert ticket, and you want to be treated like a stranger, make yourself a stranger online.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">You can avoid spending money with companies who use dynamic prices, if there\u2019s a good alternative. (For air travel, unfortunately, that\u2019s nearly impossible because most airlines use a form of dynamic pricing.) Nevertheless, if you do find yourself shopping for a flight, a pair of underwear, or even a concert ticket, and you want to be treated like a stranger, make yourself a stranger online.<\/p>\n<p class=\"duet--article--dangerously-set-cms-markup duet--article--standard-paragraph _1agbrixi lg8ac51 lg8ac50 xkp0cg1\">You can do this several different ways. <a href=\"https:\/\/www.nytimes.com\/wirecutter\/reviews\/wirecutter-show-podcast-20250602-traveling-with-a-vpn\/\" rel=\"nofollow noopener\" target=\"_blank\">Use a VPN<\/a> when you shop online. And then try it using incognito mode in Chrome or a private browser window in Safari to keep data out of the algorithms\u2019 hands. You could even use <a href=\"https:\/\/privacytests.org\/\" rel=\"nofollow noopener\" target=\"_blank\">a privacy-focused browser<\/a>, like <a href=\"https:\/\/duckduckgo.com\/\" rel=\"nofollow noopener\" target=\"_blank\">Duck Duck Go<\/a>, to avoid even more trackers. Heck, try all three approaches and see if the prices change. It is theoretically possible that surrendering your personal data could lead to lower prices.
