Denise Richards<\/a>\u00a0and\u00a0Aaron Phypers<\/a>\u00a0have been ordered to vacate the Los Angeles home they co-leased after the landlord claimed they hadn\u2019t paid rent since February.\u00a0\n<\/p>\n On Friday, Dec. 26, the Superior Court of Los Angeles granted John Karan repossession of his Calabasas, Calif., property, which he first rented to the celebrity couple in 2020, according to court documents.\u00a0\n<\/p>\n The initial complaint, filed by Karan\u2019s attorney, Phoenix Thotta, on Nov. 7, claims Richards, 54, and Phypers, 53, were issued a three-day notice to pay rent or quit the terms of their lease on Aug. 29. The residence housed the couple, their daughter Eloise, and Richards\u2019 daughters Sami and Lola Rose<\/a>, whom she shares with ex Charlie Sheen<\/a>.\u00a0\n<\/p>\n After both defendants failed to respond in a timely manner, the court ruled in favor of Karan by default. In August, Richards requested a court order directing Phypers and his family to leave the property<\/a>, where he lived with his brothers and parents at the time. Richards claimed that although she and Phypers are both named on the lease, she moved out two years ago, believing that Phypers’ family would be living there only temporarily.\n<\/p>\n The filing, obtained by PEOPLE, included photos allegedly showing the state of the home<\/a> when she visited it on Aug. 3 to retrieve some of her belongings. Richards alleged, “Aaron and his parents and brother have severely damaged the [property] and left the house in a state of disarray.”\n<\/p>\n On Sept. 13, a judge granted Richards access to the couple’s residence<\/a> to “retrieve her mother’s and her own personal property, including the dogs,” while Phypers was required to remain 100 yards away from the home, pursuant to a temporary restraining order issued in July.\n<\/p>\n Phypers first filed for divorce on July 7<\/a>, citing \u201cirreconcilable differences\u201d as the reason for the split, according to documents obtained by PEOPLE.
