Wade. In the summer of 2021, a small group of about 12 individuals, including some health care workers, elected officials, and local community activists, in the deep-red state of Wyoming\u2014which didn\u2019t have a single abortion clinic at the time\u2014began planning to open a new clinic in the college town of Casper. This was at the same time that most abortion clinics in red states, seeing the writing on the wall, had begun planning to close or move to a more hospitable location. But not in Wyoming.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"114\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmkcx7419000o3b7ahb1hniet@published\">And this long-shot gamble paid off. <a href=\"https:\/\/wellspringaccess.org\/\" rel=\"nofollow noopener\" target=\"_blank\">Wellspring Health Access<\/a>, which provides abortions as well as other services including family planning, general gynecology, and gender affirming care, opened its doors in spring 2023, almost a year after the Supreme Court decided <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/19-1392_6j37.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Dobbs v. Jackson Women\u2019s Health Organization<\/a>. Since then, the clinic has faced unending legal challenges from the state. However, at each turn, the clinic has prevailed, culminating in a <a href=\"https:\/\/slate.com\/news-and-politics\/2026\/01\/wyoming-supreme-court-slams-sam-alito-dobbs.html\" rel=\"nofollow noopener\" target=\"_blank\">big win before the Wyoming Supreme Court<\/a> last week. This ruling, which may have significance for abortion rights beyond Wyoming, struck down the state\u2019s general abortion ban as well as a specific ban on mifepristone, one of the two drugs used in a medication abortion.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"105\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmkcx744h000p3b7adx8s5epp@published\">How did this implausible turn of events come to pass? Beyond the determination of the community group in Casper, two main factors explain the ultimate success of this venture: Wyoming\u2019s unique libertarian constitution and the savvy and determination of a woman named Julie Burkhart. In a wonderful instance of karma, the famously libertarian citizens of Wyoming, enraged by the passage of the Affordable Care Act, aka \u201cObamacare,\u201d in 2010, <a href=\"https:\/\/slate.com\/news-and-politics\/2026\/01\/wyoming-strikes-down-abortion-ban-republicans-blame.html\" rel=\"nofollow noopener\" target=\"_blank\">amended their constitution<\/a>, stipulating that individuals have the right to make their own health care decisions. This amendment became the heart of the legal strategy used by the would-be clinic\u2019s lawyers, and this argument ultimately prevailed.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"81\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmkcx7481000q3b7aondaepgj@published\">But there needed to be someone to use that constitutional provision, and that\u2019s where Julie Burkhart came in. Julie is a longtime, well-known figure in abortion-providing circles. She is not a clinician, but rather an abortion access strategist and a skillful clinic operator who has a track record of opening abortion facilities in hostile and underserved areas. It was this reputation that led the Casper group to invite her to work with them even when Roe was about to be overturned.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"89\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmkcx74bb000r3b7af7ju7fkn@published\">Julie\u2019s involvement with abortion care began in 2001, when she began work with Dr. George Tiller, the Kansas doctor who was <a href=\"https:\/\/vimeo.com\/154212089?turnstile=0.Th4lYzaPiPEjRxJRhg1e1ra0DhHMjn4Bi7ox3MKEk9_QJmi6vbdpM_HJ6TyQGv3e1CuT_zBh58kbOU9fb_JbTL8D3Ng84VSUxinQBSY7gG7JVV6UaGY8EouEjfILYpEapkvZKhzBCUBJUH4dnoKjQla5soqqDakwqv9KEJ5F30yYzvsae9FJcaihF3kgR-brvIO6nc6GO7V6LLy8MuMgZr45UCEQP8q4Me7d0n8QgcqfMHeM8EackqOxdqjrdBQs7v0B3L3aK8DzPTw_OriZTAPyNUZL8j4xs43njofcyqZ576LygMGMHE__8l5dU98l0phUqlGSYWpNGvFbD9MiD2Yuv9ZP69_8uV8-5edOFf7ymc0wIJg8zwrp4BgVz3Nnm4gkuhv1citM9B6z7ck-4fmiX_8J8yALtFlLs25Ebkc4X6qmwBteEvuTa6JevLc9bsRWpOlX4IPeO9HbesIJd58ztqy-SS5c_xAt3QTRVWHaDHRysy7ekbbEgWuwXkPer7CRrNmzTI58TZjslVfXUXfN7WycXoWh5pdnxIoiiC7bNk3akWQ5NTgpC2W9A0ILtiniW9LJFl8FyRDHPbZSqKfeowbLfhMFzBzd3sNiZPFrGCiXGZIATH66bx0EE9RtUFKFzdLAwThj4GE48L8Pc-vJyRc24CxGyYj3kgukFt7f2Cej3Go6H3lcVnlYw9y92ofg79qkWItjHZILzXX8XuD3w53xEyacWRJysObubya353Xrqmun4Hr5zhRACcSkKJkPuNqCgtwy9S13mgG0wAt3eXLIvV-bOS8Y-wZQ45XF2C5lZD6uHX9bf9ZZ6qvo7amDD8g9Y8VCtqw8qjDiYE0gmQnPlilkwVqbvuGcy6PXHoxcOX0j7AEMEAD8CUSErRM-wKpNT2SceBC11a8yASljuuQaNgEHyrXzOGZMQrQ.I_oO2HsDhV0FuuUJnqIHSw.20d9671060dada54f20461da74194c4243fe62e71ca832665121c9864387bddd\" rel=\"nofollow noopener\" target=\"_blank\">assassinated in 2009<\/a> in his church by an anti-abortion fanatic. Tiller\u2019s mentorship was deeply influential for Julie, and she has worked in the abortion field since his death. She purchased his Wichita clinic from his widow and reestablished abortion there, a city that had been left without such care after Tiller\u2019s death. She also went on to open a clinic in Oklahoma, as well as several other places.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"61\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmkcx74e8000s3b7a35tbcf5m@published\">As part of a <a href=\"https:\/\/www.beacon.org\/After-Dobbs-P2154.aspx\" rel=\"nofollow noopener\" target=\"_blank\">book project<\/a> on how people in various sectors of the abortion-providing community were preparing for and then responding to the Dobbs, we interviewed Julie three times over the course of 2022. These interviews took place at the very beginning of that year, immediately after the decision was announced in June, and finally at the end of 2022.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"74\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmkcx74j8000t3b7aay1zv9nq@published\">Our first interview with Julie, in January 2022, took place while she and her Casper allies were already actively planning how to move forward with an abortion clinic. A lucky break occurred, she told us, when a wealthy donor purchased a facility from a medical practice that had closed and donated it to the group. This purchase was especially fortuitous as the facility was in an area already zoned to permit a medical clinic.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"115\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmkcx74nw000u3b7akaeur704@published\">Finding a contractor to upgrade the clinic for abortion services was a challenge, though. Abortion providers have <a href=\"https:\/\/www.vice.com\/en\/article\/obstacles-to-opening-new-abortion-clinics-include-anti-abortion-harassment\/\" rel=\"nofollow noopener\" target=\"_blank\">long faced difficulties finding people willing to work with them<\/a>. Even if the individual workers involved are not opposed to abortion, they often have realistic fears of being targeted by anti-abortion forces and being subjected to boycotts. Julie did manage to convince a local contractor to do the necessary work, vaguely telling him the clinic was for a \u201cwomen\u2019s health center.\u201d The contractor did eventually learn the intended purpose of the facility, but continued to do the work, and tellingly, did not post a sign on the site giving the name of his company, as is normally done.<\/p>\n<p>    <a href=\"https:\/\/slate.com\/news-and-politics\/2026\/01\/supreme-court-decision-sonia-sotomayor-incarcerated.html\" class=\"recirc-line__content\" rel=\"nofollow noopener\" target=\"_blank\"><\/p>\n<p>          <img decoding=\"async\" src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2026\/01\/83107c27-0c14-47f6-a22e-1c6f8e7ccc3a.jpeg\" width=\"141\" height=\"94\"   alt=\"\" loading=\"lazy\"\/><\/p>\n<p>\n          Robyn Nicole Sanders<br \/>\n        Sonia Sotomayor Just Vindicated the Rights of the Incarcerated to Seek Appeals<br \/>\n        Read More\n      <\/p>\n<p>    <\/a><\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"80\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmkcx74rl000v3b7a68bz6jw8@published\">Julie\u2019s fervent hope was to open the clinic about a month before Dobbs was expected to be announced, on the theory that since the clinic would offer a range of services, it could not be shut down, even if providing abortions was no longer legal in the state. As she put it, \u201cSo if something does happen in Wyoming, we will have that presence. We will have community ties. We will have standing if we have to go to court.\u201d<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"64\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmkcx74uy000w3b7a9iq4h6u0@published\">But this hope of a pre-Dobbs opening was dashed in May 2022 when Julie awoke to a phone call informing her that the nearly finished clinic had been <a href=\"https:\/\/kffhealthnews.org\/news\/article\/wyoming-clinic-abortion-fire-arson\/\" rel=\"nofollow noopener\" target=\"_blank\">firebombed<\/a>. Upon going to the clinic, she learned that most of the building would need to be gutted and rebuilt. <a href=\"https:\/\/www.theguardian.com\/us-news\/2023\/dec\/28\/wyoming-abortion-clinic-arson-attack-lorna-green-restitution\" rel=\"nofollow noopener\" target=\"_blank\">The arsonist was eventually caught<\/a>, but this set the clinic\u2019s opening back by almost a year.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"127\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmkcx74ye000x3b7a1bnhncs3@published\">The summer of 2022 got even worse weeks later with the announcement of the Dobbs decision. When we spoke to her shortly after the Supreme Court ruling, Julie was predictably devastated. \u201cI was so angry, so hurt,\u201d she said. Julie spent the day after the decision listening to music at very high volume\u2014including old feminist anthems from the 1970s. But neither the firebombing, the Dobbs decision, nor the Wyoming Legislature\u2019s vote to ban abortion, if the Supreme Court allowed it to do so, broke her and caused her to retreat. As she said to us with more passion in her voice than in previous conversations, \u201cI want to tell you, in Wyoming, we are going to litigate; we are going to fight this thing to the end.\u201d<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"82\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmkcx7524000y3b7a3dx812er@published\">Finding legal representation proved yet another challenge. Several national legal groups who represented abortion clinics, while very supportive of the idea of a new clinic in Wyoming, were reluctant to get involved, feeling that the aspiration was unrealistic and that their limited resources in the face of a hostile U.S. Supreme Court were better spent elsewhere. But Julie and her comrades finally located local lawyers willing to represent them. Several lower court victories allowed the clinic to open in 2023, when it began serving not only people in Wyoming but also those from surrounding states which have banned abortion. Julie has since told us there has been both community support and opposition to the clinic. Tellingly in this era of anti-trans sentiment, in some instances, the hostility is as much about the clinic\u2019s provision of gender-affirming care as about abortion.<\/p>\n<p class=\"slate-paragraph slate-graf\" data-word-count=\"117\" data-uri=\"slate.com\/_components\/slate-paragraph\/instances\/cmkcx759800103b7a79l4eziv@published\">With the resounding victory from the Wyoming Supreme Court last week, Julie was celebratory when we emailed with her. However, nothing is \u201cover\u201d when it comes to abortion conflicts, especially in a place like Wyoming. In response to the decision, <a href=\"https:\/\/governor.wyo.gov\/news-releases\/governor-voiced-deep-disappointment-in-supreme-court-s-rejection-of-constitutionality-of-abortion-ban-calls-for-immediate-legislative-action\" rel=\"nofollow noopener\" target=\"_blank\">the state\u2019s governor has called for a ballot measure in the 2026 election<\/a> to amend the state constitution to ban abortion. These kinds of measures since Dobbs have <a href=\"https:\/\/statecourtreport.org\/our-work\/analysis-opinion\/voters-seven-states-pass-measures-protect-abortion\" rel=\"nofollow noopener\" target=\"_blank\">mostly supported the pro-choice position<\/a>, even in red states. It is unclear how the vote would go in Wyoming, if indeed it is on the ballot.
