{"id":416332,"date":"2026-01-19T06:59:15","date_gmt":"2026-01-19T06:59:15","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/416332\/"},"modified":"2026-01-19T06:59:15","modified_gmt":"2026-01-19T06:59:15","slug":"worlds-first-legally-binding-treaty-to-protect-oceans-and-marine-life-takes-effect","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/416332\/","title":{"rendered":"World&#8217;s first legally binding treaty to protect oceans and marine life takes effect"},"content":{"rendered":"<p class=\"paragraph_paragraph__iYReA\">The world&#8217;s first legally binding agreement to protect marine life in international waters has taken effect, marking a historic moment for ocean conservation after nearly two decades of negotiations.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The High Seas Treaty or Biodiversity Beyond National Jurisdictions (BBNJ) Agreement, will govern about two-thirds of the planet&#8217;s oceans including vast areas beyond any country&#8217;s borders.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The treaty entered into force 120 days after it reached the threshold of ratification by 60 countries in September.\u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\">As of January, 83 countries had ratified it, including the recent addition of major maritime powers such as China and Japan on December 16.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The high seas face mounting threats from destructive fishing practices, shipping, plastic pollution, overfishing and potential deep sea mining, all compounded by climate change.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Currently, only about 1 per cent of these international waters are protected.<\/p>\n<p><img decoding=\"async\" alt=\"Underwater photo of a pink coral similar to an upside down bell and orange fish swimming amid reef.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2026\/01\/6dceb459889e13e9bbd75e8217c8c0ce.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Ratifying countries can propose new areas for marine protection. (AP: Annika Hammerschlag)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Eliza Northrop, director of the UNSW Centre for Sustainable Development Reform, said that for the first time, the treaty provided legally binding measures to help manage and protect areas beyond national jurisdictions.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;I think it really shows that countries do want to cooperate, they do see the value of working together in this area,&#8221; <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2026-01-18\/naus_highseasnbk_1801\/106241700\" data-component=\"Link\" data-uri=\"coremedia:\/\/audio\/106241700\" rel=\"nofollow noopener\" target=\"_blank\">she told the ABC<\/a>.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Ms Northrop said the high seas were like the &#8220;wild west&#8221; because no single country had ownership or responsibility over them.<\/p>\n<p>&#8220;You could do do whatever you want out there.&#8221;<\/p>\n<p class=\"paragraph_paragraph__iYReA\">She said the ocean was the planet&#8217;s largest ecosystem and was critical for migratory mammals and fish, and a source of genetic resources used in developing pharmaceuticals.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The ocean also absorbs carbon dioxide and produces oxygen, making its health critical for addressing the climate crisis.<\/p>\n<p>Immediate obligations for countries<\/p>\n<p class=\"paragraph_paragraph__iYReA\">From now on, ratifying countries must begin working together on ocean science and technology and help developing nations build capacity to participate in ocean governance.\u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Companies planning activities that could harm marine life must also conduct environmental impact assessments that meet the treaty&#8217;s standards.\u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Those conducting research on ocean organisms that could be used commercially, such as for new medicines, must notify other countries and share their findings.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Countries must now also promote the treaty&#8217;s conservation goals when they participate in other international bodies that regulate ocean activities, such as regional fisheries organisations, the International Maritime Organization and the International Seabed Authority.<\/p>\n<p><img decoding=\"async\" alt=\"a yellow spindly, coral resembling tree branches emerges out the side of a reef with turquoise water around\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2026\/01\/5eb24d860b69f45df3dd799994d19903.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">About 1 per cent of the high seas are protected, leaving them at risk of overfishing and pollution. (AP: Annika Hammerschlag)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">While key institutions like the treaty&#8217;s secretariat and scientific body are still being developed, countries can begin preparing proposals for Marine Protected Areas immediately.\u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Potential sites include the Emperor Seamounts in the North Pacific, the Sargasso Sea in the Atlantic, and the Salas y G\u00f3mez and Nazca Ridges off South America.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But how those protected areas will actually be monitored and enforced is undecided and will pose a challenge.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Rebecca Hubbard, director of the High Seas Alliance told the Associated Press that countries were exploring various options, like satellite technology, coordinating patrols between multiple nations, and using other UN agencies to help with oversight.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Within a year, the treaty&#8217;s first Conference of Parties (COP) will meet to decide key operational details, from budgets to the makeup of various committees.<\/p>\n<p><img decoding=\"async\" alt=\"wide photo of a grey, rocky coastline with blue sea and sky behind.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.newsbeep.com\/us\/wp-content\/uploads\/2026\/01\/22d38b3b3adafcfece3bbf2abe45058f.jpeg\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">A possible area proposed for marine protection is the waters around Isla Salas y G\u00f3mez near Chile. (Flickr: Government of Chile)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Countries have been working through many of those questions at preparatory meetings, with a final session scheduled for late March.\u00a0<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The earliest any Marine Protected Areas could actually win approval would be at the second COP, since the scientific body that will review proposals is not yet established.<\/p>\n<p>Keeping the momentum<\/p>\n<p class=\"paragraph_paragraph__iYReA\">One hundred and forty-five countries have signed the treaty and advocates emphasise that broad support must now turn into rapid implementation.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Kirabati was the the most recent Pacific nation to ratify it on December 9 following its regional neighbours like Fiji, Palau, Tuvalu, and the Solomon Islands.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2023-09-21\/high-seas-treaty-australia-agreement\/102885086\" data-component=\"FullBleedLink\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" rel=\"nofollow noopener\" target=\"_blank\">Australia signs landmark agreement to give oceans a &#8216;fighting chance&#8217; <\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Foreign Affairs Minister Penny Wong\u00a0says Australia is working to bring the treaty &#8220;into force as soon as possible&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">But countries like Australia, New Zealand, the United States, and the United Kingdom remain as signatories and have yet to ratify it.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">This means they can participate as an observer but will not have voting rights.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Under international law, signatory countries are expected to comply with treaty objectives even before ratification.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Signatories are also obligated to &#8220;refrain, in good faith&#8221; from acting against the purpose of the treaty, according to the High Seas Alliance.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Ms Hubbard told AP that while it was &#8220;disappointing&#8221; the US had yet to ratify the agreement, it did not undermine the momentum because the rest of the world showed &#8220;broad and strong political support&#8221; for it.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Ms Northorp from UNSW said the success and effectiveness of such agreements relied on the vast majority of countries becoming a party to it, like the Paris Agreement to address climate change.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;It&#8217;s important we don&#8217;t stop at this early juncture now that there&#8217;s enough parties for this treaty to enter into force,&#8221;
