Here are the details.<\/p>\n<p>The ITC looks at the Apple Watch yet again<\/p>\n<p>In recent years, the <a href=\"https:\/\/amzn.to\/4pS6fVw\" rel=\"nofollow noopener\" target=\"_blank\">Apple Watch<\/a> has faced multiple patent challenges related to health and medical features, including disputes with AliveCor and Masimo.<\/p>\n<p>The Masimo dispute even led to an <a href=\"https:\/\/amzn.to\/4pS6fVw\" rel=\"nofollow noopener\" target=\"_blank\">Apple Watch<\/a> import ban in the U.S., following an International Trade Commission (ITC) ruling that found Apple had infringed Masimo\u2019s blood oxygen monitoring patents.<\/p>\n<p>Apple was later able to <a href=\"https:\/\/9to5mac.com\/2025\/08\/14\/apple-watch-blood-oxygen-feature-returning-in-the-u-s-today\/\" rel=\"nofollow noopener\" target=\"_blank\">reverse<\/a> the ban, though the dispute is <a href=\"https:\/\/9to5mac.com\/2025\/11\/14\/redesigned-apple-watch-blood-oxygen-feature-faces-new-itc-scrutiny\/\" rel=\"nofollow noopener\" target=\"_blank\">still ongoing<\/a>.<\/p>\n<p>Now, a new company has filed a complaint with the ITC, in a case that is not limited to just the <a href=\"https:\/\/amzn.to\/4pS6fVw\" rel=\"nofollow noopener\" target=\"_blank\">Apple Watch, <\/a>but also includes \u201celectronic watches with the capability to detect when a user has suffered a fall, and components thereof,\u201d which in practice means smartwatches from Samsung, Google, and Garmin.<\/p>\n<p>The case centers around these devices\u2019 fall detection feature, which Texas-based company UnaliWear alleges violates multiple patents.<\/p>\n<p>From ITC\u2019s <a href=\"https:\/\/www.usitc.gov\/secretary\/fed_reg_notices\/337\/337_1477_notice01082026sgl.pdf\" rel=\"nofollow noopener\" target=\"_blank\">Notice of Institution of Investigation<\/a>:<\/p>\n<p>The complaint, as supplemented, alleges violations of section 337 based upon the importation into the United States, the sale for importation, and the sale within the United States after importation of certain wearable devices with fall detection and components thereof by reason of the infringement of certain claims of U.S. Patent No. 10,051,410 (\u201cthe \u2019410 patent\u201d) and U.S. Patent No. 10,687,193 (\u201cthe \u2019193 patent\u201d). The complaint further alleges that an industry in the United States exists as required by the applicable Federal Statute. The complainant requests that the Commission institute an investigation and, after the investigation, issue a limited exclusion order and cease and desist orders.<\/p>\n<p>In other words, UnaliWear is requesting two key remedies from the ITC: a limited exclusion order that would ban imports of the accused devices, and cease and desist orders that would prohibit the sale of infringing devices already in the United States.<\/p>\n<p>If successful, this could result in a ban similar to the one imposed on the <a href=\"https:\/\/amzn.to\/4pS6fVw\" rel=\"nofollow noopener\" target=\"_blank\">Apple Watch<\/a> in the Masimo dispute.<\/p>\n<p>According to ITC\u2019s document, respondents now have 20 days to respond, or risk a default judgment.
