{"id":421553,"date":"2026-01-21T21:26:16","date_gmt":"2026-01-21T21:26:16","guid":{"rendered":"https:\/\/www.newsbeep.com\/us\/421553\/"},"modified":"2026-01-21T21:26:16","modified_gmt":"2026-01-21T21:26:16","slug":"duke-is-suing-its-star-quarterback-as-college-footballs-transfer-portal-shuffle-breaks-new-ground","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us\/421553\/","title":{"rendered":"Duke is suing its star quarterback as college football\u2019s transfer portal shuffle breaks new ground"},"content":{"rendered":"<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobjr5500b02co2djkkbp0r@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            There is a new <a href=\"https:\/\/www.cnn.com\/2026\/01\/20\/sport\/football-ncaa-can-indiana-stay-on-the-mountaintop\" rel=\"nofollow noopener\" target=\"_blank\">Mendoza line<\/a> in sports and unlike the one in baseball, which signifies lousy offense, this one is all about winning: Everyone wants the <a href=\"https:\/\/www.cnn.com\/2026\/01\/20\/sport\/football-fernando-mendoza-curt-cignetti-indiana\" rel=\"nofollow noopener\" target=\"_blank\">next Fernando Mendoza.<\/a>\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s700033b6pt9up0ljd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Heisman Trophy-winning quarterback\u2019s stunning success at Indiana has upped the premium on <a href=\"https:\/\/www.cnn.com\/2026\/01\/09\/sport\/football-ncaa-calendar-transfer-portal-cfp\" rel=\"nofollow noopener\" target=\"_blank\">transfer quarterbacks.<\/a> The inevitable capitalistic evolution of the <a href=\"https:\/\/www.cnn.com\/2025\/06\/06\/sport\/settlement-colleges-pay-athletes-millions-spt\" rel=\"nofollow noopener\" target=\"_blank\">House settlement<\/a> that allowed for the paying of athletes guaranteed there would be winners and losers, and the winners are \u2013 no surprise \u2013 the signal-callers.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s700043b6pqdc6b1s3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            That is what is at the root of the lawsuit filed by Duke University against its quarterback, Darian Mensah. The university is trying to block its second-team All-ACC QB from <a href=\"https:\/\/www.cnn.com\/2024\/12\/17\/sport\/college-football-transfer-portal-penn-state-spt\" rel=\"nofollow noopener\" target=\"_blank\">entering the transfer portal<\/a>, going so far as to file suit in the Durham County Superior Court to prevent it. The school argues \u201ccontracts mean something,\u2019\u2019 and that it had paid Mensah <a href=\"https:\/\/www.cnn.com\/2024\/05\/23\/sport\/ncaa-settlement\" rel=\"nofollow noopener\" target=\"_blank\">for exclusive rights to his NIL.<\/a>\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s700053b6p8mevgh9h@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The school asked for a temporary restraining order to block him from leaving until the two sides could go through arbitration as the contract outlined.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s700063b6ppmm8vqw0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Ruling from the bench, a judge denied Duke\u2019s request but that only means Mensah can enter the portal; he is not free to actually enroll in another school until the matter is settled. The hearing is currently scheduled for early February. Mensah\u2019s lawyers want that date moved up.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s700073b6pob2q1abg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cMr. Mensah has an existing contract with Duke which the university intends to honor, and we expect he will do the same,\u201d a Duke Athletics spokesperson said in a statement to CNN Sports. \u201cThe court-ordered temporary restraining order (TRO) issued yesterday ensures he does not violate his contract. The university is committed to supporting all our student-athletes, while expecting each of them to abide by their contractual obligations.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s700083b6p0mpuee07@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Like a lot of messy divorces, this started with a wandering eye, a lover scorned and boils down to the money.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s700093b6pei4se6pq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Just last month, Mensah pledged his loyalty to Duke in a heartfelt Instagram post that ended, \u201cI wouldn\u2019t trade any of it for the world.\u2019\u2019 And after beating Arizona State in the Sun Bowl, he said of his wide receiver Que\u2019Sean Brown, \u201cI wouldn\u2019t want to do this with anyone else.\u2019\u2019\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000a3b6phn3xicph@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Until someone else came along.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000b3b6pvecncmty@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            From the lawsuit: \u201cUnder the NCAA rules and regulations, other schools may not contact student-athlete, directly or indirectly, until the student-athlete has entered the transfer portal. At 2:07 p.m. ET on Friday, January 16, 2026, sports media reports began to circulate that Mensah was considering entering the portal and was being offered purported \u2018buyout\u2019 of his contract with Duke University.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000c3b6pxaej5rcs@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Translation: \u201cSomeone else dangled some more cash in front of our quarterback.\u201d The alleged suitor, according to the lawsuit, is Miami, which adds a little spice to things. The Hurricanes aren\u2019t merely an ACC rival for Duke. Mensah threw for 3,973 yards and 34 touchdowns. That\u2019s what this is about.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000e3b6pvrjfbp9i@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Mensah is just the latest quarterback joining the new dance craze in college football: The QB Shuffle. <a href=\"https:\/\/www.on3.com\/transfer-portal\/wire\/football\/\" target=\"_blank\" rel=\"nofollow noopener\">According to On3\u2019s online database:<\/a> Josh Hoover is headed from TCU to Indiana, which means Hoosier backup Alberto Mendoza is headed to Georgia Tech, where the Yellow Jackets needed a QB after Aaron Philo, their backup to the graduating Haynes King, left for Florida, which had lost its quarterback, DJ Lagway, to Baylor, to complete the Texas-to-Texas cycle.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000f3b6p07oir2j9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In this case, Carson Beck is out of eligibility at Miami. The Hurricanes tried to convince Alabama quarterback Ty Simpson to skip the NFL draft and come play for the Hurricanes. He declined, so they need someone \u2013 preferably someone good.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000g3b6pqidtujkx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Duke, in the meantime, understandably, would like to keep the man who led the Blue Devils to their first ACC title since 1962. Plus, their backup, Henry Belin IV left for Missouri State and with the January portal window closed, they don\u2019t really have a Plan B.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000h3b6psoru2tjk@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            As his team was prepping to play for the national title this weekend, Miami athletic director Dan Radakovich took time to talk free market value to a cluster of reporters.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000i3b6p0pyyap1u@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cWe\u2019ve never been able to \u2018rule\u2019 ourselves into competitive equality,\u2019\u2019 he said to Sports Illustrated. \u201cSchools are going to invest differently. I really think we could go around the mulberry bush for an awful long time, but if we just let market forces work, I think over a period of time we\u2019d get level water here.\u2019\u2019\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000j3b6p23r4h9lh@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Miami reportedly offered Simpson $6.5 million to eschew going pro. Odds are the school offered Mensah more than he was making at Duke and no matter how loyal he might be, everyone has a little bit of Rod Tidwell in him: Show me the money.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000k3b6pr1ob5xll@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            So here we are.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000l3b6pua24rrss@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The question is: Where do we go?\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000m3b6plp2kqkob@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The basis of Duke\u2019s argument, centering around its lawsuit, is hardly invalid. There is a signed contract. No doubt it is also music to the ears of many a coach and administrator in college athletics. Plenty have fumed that, while they do not begrudge their athletes making money, they fail to understand why the deals aren\u2019t enforceable.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000n3b6pv1c12tel@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            <a href=\"https:\/\/www.cnn.com\/2024\/05\/30\/sport\/ncaa-drop-transfer-rule-division-i-athletes-justice-department\" rel=\"nofollow noopener\" target=\"_blank\">The concept of the transfer portal started <\/a>in large part as a reaction to the NCAA rules that let coaches leave without impunity but forced athletes to sit out. Coaches and schools, however, are beholden to their deals. They can\u2019t just walk away without at least some sort of financial penalty. Schools typically have been reticent to push back when players ask to leave, fearing both the bad look and lawsuits to come.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000o3b6p9ypl87kr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But the Mensah mess comes just weeks after Demond Williams announced his intentions to leave Washington, with all indicators suggesting a reported relocation to Baton Rouge and Lane Kiffin.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000p3b6pguyp365s@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Forty-eight hours later, Williams had a change of heart: \u201cAfter thoughtful reflection with my family, I am excited to announce that I will continue my football journey at the University of Washington.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000q3b6pi36ljhzf@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In between, his agent quit on him and Washington threatened to sue over his contract, <a href=\"https:\/\/www.espn.com\/college-football\/story\/_\/id\/47554312\/demond-williams-jr-transfer-stay-washington\" target=\"_blank\" rel=\"nofollow noopener\">according to ESPN.<\/a>\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkobk2s7000r3b6pmdddgf5q@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Perhaps, then, the tide may turn on enforcing NIL contracts.
