With an <a href=\"https:\/\/www.cnn.com\/2026\/01\/21\/politics\/ice-memo-enter-homes-without-judges-warrant\" rel=\"nofollow noopener\" target=\"_blank\">Immigration and Customs Enforcement memo<\/a> that allows officers to enter homes without a judicial warrant, the Trump administration is seeking to usurp guardrails that are enshrined in the Fourth Amendment and have protected Americans\u2019 civil liberties for centuries, experts in constitutional law and immigration policy told CNN.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf00083b63vlkzbzwx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Even in an administration that has always pushed an expansive vision of its law enforcement authority, the directive is notable for the way it tosses aside longstanding prohibitions against warrantless searches on private property \u2014 a legal concept that predates the creation of the United States and is among the country\u2019s most foundational principles.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf00093b63pifz6376@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe Bill of Rights, we thought, were the first 10 amendments,\u201d said Mark Graber, a constitutional law scholar and University of Maryland professor.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000a3b63tw4zh51n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            With the newly discovered memo, he said: \u201cI guess now we\u2019re down to nine.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000b3b63c336899y@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Immigration officials had typically sought the arrests of undocumented people through two means: a judicial warrant, which is signed and authorized by a judge, or an administrative warrant, which is signed by people who work in the executive branch and fall under the purview of the president.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000c3b63lrm2mowc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A critical difference between the two is that judicial warrants allow law enforcement to enter and search a person\u2019s home or a non-public area of a business, while administrative warrants do not.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000d3b63mx6iu8k0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Most immigration arrests are carried out under administrative warrants because they require a lower bar to issue, and Trump administration officials have long harbored frustrations over limitations on officers pursuing targets on private property.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000e3b633wk0990h@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The internal memo, which was issued in May 2025 but revealed by a whistleblower complaint and first reported by the Associated Press on Wednesday, authorizes ICE officers to forcefully enter homes using only administrative warrants, essentially bypassing the neutral, third-party arbiters who would have reviewed evidence before signing a judicial warrant.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000f3b6325gerytq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Administrative warrants are signed by ICE officers after an immigration judge orders the removal of an undocumented immigrant. But these immigration judges work for the Department of Justice at the pleasure of the attorney general, and the Trump administration refers to them as \u201cdeportation judges.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000g3b63rj8vl837@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt would essentially be the same as if you were at the local police department, and the police officer that is both collecting the evidence and arresting you then goes and types up his own warrant to search your house because he thinks he has probable cause,\u201d said Emmanuel Maule\u00f3n, an associate professor of law at the University of Minnesota.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000h3b63m07iije9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt\u2019s deeply concerning, because there\u2019s absolutely no safeguards and no accountability built into the system,\u201d he said.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000i3b63p7usipqx@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The history of the Fourth Amendment is rife with examples of local, state and federal law enforcement agencies seeking to challenge or whittle away its protections.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000j3b63d3h9tjf8@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But this memo, Maule\u00f3n said, is \u201cnot the sort of incremental wearing down that we\u2019ve seen over time.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000k3b63lmlbjfe7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt is what you might think of as crossing the Rubicon,\u201d he said. \u201cIt is declaring that the fundamental protections that every court has recognized up to this point just don\u2019t apply to DHS and to immigration stops.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000l3b63z66h94lr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Department of Homeland Security defended the directive in a statement in which spokesperson Tricia McLaughlin said people who are served administrative warrants already had \u201cfull due process and a final order of removal.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000m3b6304vzcw8c@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The administration\u2019s own data <a href=\"https:\/\/www.justice.gov\/eoir\/media\/1344881\/dl?inline\" target=\"_blank\" rel=\"nofollow noopener\">shows hundreds of thousands of people last year<\/a> were issued removal orders in absentia by immigration judges after they failed to show up to court.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000n3b63ext5tgpu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The memo was not broadly distributed to ICE field offices in a departure from the way major policy chances have been typically announced internally.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000o3b63ms9qlp7n@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Instead, in at least some cases, the guidance appeared to only be shared verbally, according to a source familiar. Some ICE officials learned about the guidance for the first time only after the Associated Press reported the change.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000p3b63nyj0dhzy@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            News of the memo prompted widespread alarm among civil liberties advocates and Democratic lawmakers. Sen. Richard Blumenthal of Connecticut called on Homeland Security Secretary Kristi Noem and acting ICE Director Todd Lyons to testify before Congress about the memo. Minnesota Gov. Tim Walz, whose state is experiencing the most intense surge of immigration enforcement in DHS\u2019s history, said in a <a href=\"https:\/\/x.com\/GovTimWalz\/status\/2014114020844798249\" target=\"_blank\" rel=\"nofollow\">post<\/a> on X \u201cevery American\u201d should be \u201coutraged by this assault on freedom and privacy.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000q3b6329y96265@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            A Trump administration official told CNN the directive is \u201cnot a green light to randomly kick down doors.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000r3b630xyqki03@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But it comes after months in which officers carrying out the president\u2019s massive deportation mandate have used <a href=\"https:\/\/www.cnn.com\/interactive\/2026\/01\/09\/us\/dhs-immigration-crackdown-ice-arrests-protests-vis\/index.html\" rel=\"nofollow noopener\" target=\"_blank\">brutish tactics, largely unchecked<\/a>, to detain immigrants and citizens alike.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmkq3u3uf000s3b6341zpeolr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThis administration\u2019s general stance is that immigrants are \u2018invaders\u2019 and immigration officials should be allowed to expedite their arrest, detention and deportation,\u201d said Kathleen Bush-Joseph, an attorney and analyst at the Migration Policy Institute.
